JUDICIAL AFFIDAVIT

This Judicial Affidavit is executed to serve as a direct testimony in the


instant case. This Judicial Affidavit is formally offered to prove that:

1. Due to the incident, his left leg was amputated;


2. That he was run over by a red Toyota HiLux on February 14, 2021 at the
intersection between Oscars St., and Globes St., Cebu City while he was
attempting to cross the road;

3. That he recognized Steven Yeun as the driver of the red Toyota HiLux when
Steven Yeun got off the vehicle when he realized that he had hit someone;

PRELIMINARY STATEMENT

I, MINARI MINARO, Filipino, of legal age, single and a resident of 143


Junquera St., Brgy. Kamagayan, Cebu City, Cebu City, after having been sworn to
in accordance with the law do hereby depose and state:

QUESTIONS were propounded by Atty. CARMEL JO ANGELI HO in


Cebuano, which I understand, while the ANSWERS were given in both English
and in Cebuano, the latter being translated by Atty. Carmel Jo Angeli Ho to
English. The taking of this affidavit was done at her office at Cebu City.

That I am answering the questions herein fully conscious that I do so, under
oath and that I may be criminally liable for false testimony or perjury.

Q2: Sir ngano man ka nag gama aning imong apidabit?

(Sir, why are you executing this affidavit?)

A2: Para musulti sa mga nahitabo para makasohan si Steven Yeun ug


Reckless Imprudence Resulting in Serious Physical Injuries na ipasa sa korte
diri sa Cebu.

(I am executing this Judicial Affidavit to narrate the facts and events relevant
to the information to be filed at the MTCC in Cebu charging Steven Yeun of
the crime of Reckless Imprudence Resulting in Serious Physical Injuries.)
Q3. Sir, unsa may labot nimo ani nga kaso?

(Sir, what is your involvement in the case?)

A3. Ako ang nabanggaan ug tungod sa akong pagkabangga giputol akong


tiil. Tan-awa oh. *gipakita ang giputol na tiil* Giputol nalang sa doktor kay di
na masalbar tungod sa kakusog sa pagkabangga. Di-a ra akong papeles gikan
sa doktor, Atty.

(I am the injured party here. The incident resulted to my foot being


amputated. Look at this. *Shows the stump due to the amputation* The
doctor had no choice but to amputate my leg since the impact was very strong.
Here is my medical certificate from the doctor )

Manifestation: I will now mark this medical certificate showing the doctor’s
certification as to the amputation of Minari Minaro’s leg as EXHIBIT “A” and
have it attached to the Judicial Affidavit.
Q4: Unsa diay una nahitabo, Sir?

(What first happened, Sir?)

A4: Ato tong Valentines Day aning tuiga. Naghuwat ko na mu green ang stop
light para makalabang ko gikan sa Oscars St., paingon sa Globes St.

(It was Valentines Day of this year. I was waiting for the stop light to turn
green to be able to cross the street. I was intending to go to Globes St., from
Oscars St.)
Q5. Unsay sunod nahitabo?

(What happened next?)

A5. Paglabang nako naa ray nikalit pakusog na pula na HiLux. Wa ko


kalikay kay perteng kalita ug perteng kusoga pagpadalagan. Nabanggaan kog
grabe sa akong wala na tiil.

(While I was crossing the street, a very fast red HiLux came out of nowhere. I
was unable to dodge since it was very sudden and it came very fast. I was hit
with so much force on my left leg.)
Q6. Nya unsay sunod nahitabo, Sir?

(What happened afterwards?)

A6. Pagkahuman ato natumba nako dayon nanaog ang driver kato si Steven
Yeun sa sakyanan. Nitawag siyag ambulansya. Perteng sakita Atty murag
gihulugan ug dako kaayong bato akong tiil. Daghan na kaayong tawo gatapok
ato.

(I fell immediately after I got hit. The driver of the vehicle, Mr. Steven Yeun,
got out of the vehicle and called an ambulance. It was very painful, Atty. It
seemed like a very huge rock was dropped to my leg. A crowd formed around
us.)
Q7. Kato gahulat mos ambulansya unsay nahitabo?

(What happened while you waited for the ambulance to arrive?)


A7. Gipangutana nako iyang ngalan. Ana siya si Steven Yeun kuno siya.
Maayo gani wa ko niya biyae na murag hit-and-run ba Atty.

(I asked for his name and he told me he was Steven Yeun. It was a relief that
he didn’t leave like in hit-and-run cases.)

Q8. Nya unsa nahitabo, sunod, Sir?

(What happened next, Sir?)

A8. Pag-abot sa ambulansya gisakay kos stretcher. Gasunod ra si Steven Yeun


sa ambulansya nya gahulat siya sa ospital hantod naabot akong anak sa
ospital. Sila nay nag storya.

(When the ambulance arrived, I was immediately put on a stretcher. Steven


Yeun followed the ambulance and he waited at the hospital until my son
arrived. They were the one who talked)

Q9. Mao na ni tanan, Sir?

(Is that all, Sir?)

A9. Mao na na. Pagkahuman ato giputol na akong tiil. Siyay nibayad sa
ospital pero mao lagi ni di nako katrabaho kay putol na akong tiil mao ng
nikaso ko. Di sayon.

(That’s it. After that my leg was amputated. Steven Yeun paid the medical bill
but since my leg was amputated I can no longer work. That’s why I filed a
case. It’s not easy.)
Q10. Mu sumpa ka ani tanan Sir na tinuod ug sakto ni tanan hantod sa imong
nahibaw-an ug ang imong gihatag na papeles kay tinuod?

(Do you swear under oath that all of the foregoing statements are true and correct
to the best of your personal knowledge and based on authentic records?)

A10. Oo, Atty.

1. I am the lawyer who supervised the examination of Minari Minaro, the


injured party in a criminal case to be filed before the MTCC in Cebu City.

2. I faithfully caused to be recorded the questions propounded to Mr. Minari


Minaro, as well as the latter’s answers/responses to the questions.

3. Neither I nor any other person influenced, provided answers to, or,
otherwise dictated, Mr. Minari Minaro in the course of the examination.

4. I execute this attestation in order to attest to the truth of the foregoing


statements.
