JUDICIAL AFFIDAVIT OF VICTORIA LAZO


(Witness for the Private Complainant)

I, Victoria Lazo, of legal age, Filipino citizen, married and currently


resides at ________________________, after having been duly sworn to in
accordance with law, depose and state:

PRELIMINARY MATTERS
The Judicial Affidavit was formally conducted by Atty. Felicito Garcia Jr.,
at his office at Regional Legal Office 7, Camp Sergio Osmeña Sr., Cebu City.
That I answer his question fully conscious that I do so much under oath and
under oath of criminal sanction of false testimony and perjury.

PURPOSE
The testimony is offered to prove the material allegations stated in the
COMPLAINT and to PROVE that the respondent committed grave threats and
slight physical injuries towards the complainant.

Q1: Please state your name, and other personal circumstances


for the record.
A1: I am Victoria Lazo, Filipino, and currently a ______________. I
am a Board Member and Officer of the Mandaue Creekside
Residents Association, Inc., (MANCRA).

Q2: What is the purpose of your visit to this office?


A2: I am here to give my voluntary testimony as witness in
relation to the grave threats and slight physical injuries case filed
against respondent John Jun Orencio.

Q3: Do you know the complainant in the case?


A3: Yes, He is the current Vice-President of Mandaue Creekside
Residents Association Inc., or MANCRA, a fellow MANCRA Officer
and Board Member.

Q4: Do you know the respondent in this case?


A4: Yes, he is also a resident of MANCRA Orel Road Banilad,
Mandaue City, like me.

Q5: Please state what you have witnessed in this incident you
are referring to?
A5: Yes, I was in the scene when the respondent gravely
threatened and physically injured the complainant.

Q6: Can you briefly state the relevant facts that you witnessed
relating to the said incident that cause the complainant to file the
said case?
A6: Yes. On April 30, 2021, at 7:00pm, the officers of the
association scheduled a meeting. The respondent was there at that
time.

Q7: What happened at that time?


A7: When the complainant who is also the Vice President of the
Association, entered in the meeting place, the respondent started
“finger pointing” the former and uttered towards the complainant,
“Ikaw, baba na sa imong pwesto”.

Q8: What happened next, if any?


A8: The respondent was advised to go outside the meeting place.
When the respondent was already outside the meeting place, he
then shouted and uttered threats towards the complainant
“GAWAS DIRI KAY PATYON TAKA” (Get out here so I could Kill
You).

Q9: Was there anything else that happened after that “pointing
finger” and “threat” incident?
A9: Yes. People, even those who are not members of the
association like by standers gathered in the meeting place. That is
why the officers decided to cancel the meeting because it was
already 9:00pm in the evening.

Q10: What happened next, if any?


A10: When me and the complainant went outside the meeting
place, the respondent suddenly approached and punched the
complainant.

Q11: What happened then?


A11: My fellow officers Virginia Anoba and Marginia Colina whent
near to the complainant and grabbed his waist so that former
would not retaliate to the respondent.

Q12: Would you like to add some more to your statement?


A12: There is none for the meantime. I am reserving my right to
inform the court of all material and relevant information from my
personal knowledge which I may failed to mention in this affidavit.

SWORN STATEMENT BY COUNSEL


CONDUCTING THE JUDICIAL AFFIDAVIT
I, Atty. Felicito R. Garcia Jr., of legal age, single, Filipino, having my
office at Regional Legal Office 7, Camp Sergio Osmeña Sr., Cebu City. After
having been duly sworn to in accordance with law, hereby depose and state:

That I am the lawyer who conducted and supervised the examination to


be truthful and accurate;

That I faithfully recorded the person then present or assisting me


regarding the latter’s answer;

That neither I nor any other person then present or assisting me coached
the witness regarding latter’s answers’;

I further certify that I confronted the witness with the documents during
the taking of the foregoing and I warrant that the same are faithful copies or
reproduction of the original;

That I am aware that a false attestation shall subject me to disciplinary


action; including disbarment.
