IV. ANALYSIS AND EVALUATION

Background investigation on herein petitioner revealed that had never been


involved in any trouble in the community except for one allegation that he physically
abused his live-in partner but did not reach the office of the barangay chairman. He is
described by residents to be a simple and industrious individual.
Petitioner’s presence in the community is rare and his address is vague that his
immediate family cannot locate him. They just wait for his visit or call. The family
plead that he be given a second chance but was forthrightly informed that his
disappearance and failure to report to the Probation Office is a clear manifestation that
he is not interested on his petition for probation in which the office will be forced to
manifest to the Court for his warrant of arrest. Much as they want to help him but they
do not have the resources to locate him.
Records check conducted in the course of the investigation proved that this is
petitioner’s first offense.
Lately, it came to the knowledge of the investigating officer that petitioner
appeared to So. Leyte PPO asking for leniency for his misconduct of non-appearance
to the office and disregarded his petition for probation.

V. RECOMMENDATION

WHEREFORE, In view of the foregoing, it is respectfully recommended to the


Honorable Court that the petition for probation of JULAN ALBERCA Y PETERE be
GRANTED.
