TRANSFERS
1. General

1.1 All employees are expected to serve in any part of the Island as a

condition of service. Subject to the provisions below, it is mandatory to

transfer all employees out of Station after serving 5 years in one Station.

1.2 A list of employees who are transferable according to 1.1 will be published

every year by DGM (Personnel) before the end of April each year.

1.3 It shall be the responsibility of the HRO of each Branch to prepare the list

accurately and forward to DGM (Personnel) by the end of March each

year. Employees in the above list shall apply for annual transfers or else

they shall be transferred according to administrative requirements.

1.4 These guidelines shall not be applicable to any transfers ordered on

disciplinary grounds, exigencies of service or for administrative reasons.


1.5 For the purposes of this Circular, Station means the Municipal or Urban

Council or Pradeshiya Sabha Area where the employee is posted to and

any change of work place within such an Area will not be considered as a

change of Station for the purpose of transfers.

1.6 For each Station, depending on the category as shown below, there shall
be a minimum period after which a person becomes eligible to apply for

transfer and a maximum period after which a person may be transferred

out to accommodate transfer request of another.

1.7 For each category of staff, transfers within same Branch as specified in

Schedule I and II in respect of such category shall be considered to have

served in the same station when determining the period for transferring

out.

2. Annual Transfers

General Rules

2.1 There is a minimum period of 2 years at a Station, after which the person

is eligible to apply for a transfer.

2.2 A transfer within the same Station is considered as having served the

same Station when determining the period for transfer.

2.3 All employees covered under these rules should either apply for a vacancy

to secure a change of Station or shall apply for annual transfer before the

end of the 5 year term in the Station. Transfer Board shall consider

applications where the employee has served for more than 5 years in the

same Station and arrange a transfer considering the respective applicants’

preferences. If the employee fails to apply for a transfer and failed to show

personal preference after 5 years of service in the same Station, the

Transfer Board may consider that the employee is prepared to serve in

any part of the country.

2.4 Employees who have served the period beyond specified period for

mandatory transfer but not transferred under these Annual Transfer Rules

are also liable to be transferred by the relevant Transfer Boards.

2.5 Those who have not applied for transfer but were involuntarily transferred

to another Station under mandatory transfer scheme or those who were

transferred to a Station other than of the employee’s choice, the service

period prior to such transfer together with the service period of new station

is counted as one station for determining eligibility of such person to apply

for Annual Transfers in the following years. For example, if a person has

served 5 years in Station A and he/she applied for transfer to Station B, C,

or D. However, due any reason his/her transfer could not be granted but

on account of request by another person to transfer to Station A, he/she is

transferred to another Station, he/she can apply for transfer the following

year even though the service at new Station is 1 year (service is counted

as 6 years). However, for the purpose of determination of maximum period

and/or mandatory transfer period, only the service in the new station will

be counted.

2.6 All mutual transfers effected within one year prior to next annual transfer

date shall be ratified by the Transfer Board and in order to accommodate

a request by another eligible person, the Transfer Boards may decide to

reverse such mutual transfers. For example, a person who has completed

3.5 years in Station A may have obtained a mutual transfer to Station B.

By the time the next annual transfers are considered, such person may

have completed maximum service period had he continued in Station A

whereas his replacement in Station A may not have completed maximum

period, even counting his/her service in both Stations A and B. By effecting

such mutual transfer, chance of any other eligible person who wishes to

secure a transfer to Station A may be deprived and therefore the Transfer

Board may decide to reverse the mutual transfer, and consider the person

has served the maximum period in Station A and effect a transfer to

accommodate the request of the other person. Similarly, the person who

got the mutual transfer to Station A from Station B will have to report back

to Station B.

2.7 Those who have secured mutual transfers within one year prior to next

annual transfer date, service period at Stations prior to such mutual

transfers shall not be counted for the purpose of mandatory transfer

scheme.

2.8 If any employee had undergone a specialized training pertaining to the

position he holds, such employee has to serve the mandatory period

specified for the training, irrespective of the minimum and maximum

periods mentioned above Clause 1.6. Special consideration may be given

in circumstances when Head of the Branch has valid and cogent reasons

to retain any employee at the present Station.

2.9 Special consideration shall be given to those who are required to work in

hazardous environments (i.e. The Stations where a hardship allowance is

paid) and they should be mandatorily transferred to another station after

serving stipulated maximum period so that they are not exposed to difficult

environment for long period of time.

Heads of Divisions

2.10 Transfers of Heads of Divisions are not governed by the above transfer

rules.

Officers of Class I Level

2.11 Special consideration will be given for Transfers of Deputy General

Managers / Project Directors/ Addl. Finance Managers in view of

experience and qualifications as provided below. However 5 year

mandatory transfer rule as provided in Clause 2.3 shall generally be

applicable.

2.12 Posts at the Class I level which require similar experience (e.g. Posts of

Provincial DGM, DGM (Projects & Heavy Maintenance), Complex DGM,

Divisional AFM etc.) so that they may be transferred amongst such posts

by application of the Clause 2.3.

2.13 Transfers of DGM/Project Directors/AFM will be decided by the Corporate

Management Team. In determining such transfers at Class I level,

weightage will be given to previous experience and qualifications. CEB

has now recognized the requirement of specialized cadre and the

positions identified as specialized posts will be excluded from these

Transfer Rules.

Class II Grade I and Class II Grade II Levels

2.14 The staff at this level shall be allowed to transfer freely across the

Divisions and with the view of gaining overall knowledge related to the

activities of the organizations, subject however to the provisions of the

previous Clauses.

Engineering Assistants and Junior Executive Levels

2.15 The staff at this level shall be allowed to transfer freely across the

Divisions and with the view of gaining overall knowledge related to the

activities of the organizations, subject however to the provisions of the

previous Clauses.

Superintendents

2.16 Electrical / Mechanical/ Civil Superintendents may initially be allowed to

move among Divisions to gain overall knowledge and decide on their

preferred area. They should seek transfers in similar functions. Transfers

from dissimilar functions such as Generation to Distribution is discouraged

if they had work more than 10 years in the same functional stream.

2.17 In selection of employees for transfer out of a Station where there are

more than one such employee, the general rule will be that the employee

who had served the longest in that Station will be liable for transfer.

Employees in the Clerical and Allied Services and the Office Employee

Service

2.18 When clerical staff employees are transferred, the one to one transfer shall

preferably be of employees in the same grade.

2.19 In selection of employees for transfer out of a Station where there are

more than one such employee, the general rule will be that the employee

who had served the longest in that Station will be liable for transfer.

Field Staff

2.20 When field staff employees are transferred, the one to one transfer shall

be of employees in the same Grade and doing the same function for

skilled Grades. For example a Welder cannot be replaced with a Lathe

Operator.

Transfer Boards

2.21 Transfer Boards are appointed by the General Manager. Separate

Transfer Boards for different categories of employees will be appointed.

2.22 A Transfer Board shall Comprise of:

a. Two or more executive officers representing the Management.

b. One representative from each of the Trade Unions having a

membership of not less than 15% of the employees in any service.

2.23 Under extraordinary circumstances, General Manager may use his

discretion to decide Transfers not in accordance with Transfer Board

Recommendations.

2.24 The Annual Transfers approved by the General Manager will be notified to

the Branches by Deputy General Manager (Personnel) by the end of

September each year. The transfers will take effect from 1st January of the

following year unless otherwise decided for any particular cases.

3. Appeals on Transfer Board Decisions

3.1 An Appeal Board will be appointed by the General Manager in respect of

every category for which a Transfer Board is appointed.

3.2 The decisions of the General Manager arrived at on the recommendations

of the Appeal Board will be intimated to the Branches by the Deputy

General Manager (Personnel) by 15th November each year.

3.3 Transfers may be cancelled or deferred on account of the following

reasons and any other special circumstances as may appear reasonable

to the Appeal Board:

a. Sickness of the employee certified by a District Medical Officer or

Medical Superintendent as applicable. Where necessary the

recommendations of a Government Medical Board may be

obtained.

b. Serious sickness of a member of the employee’s family certified by

District Medical Officer or Medical Superintendent as applicable.

c. Grave personal hardships which make it necessary for the

employee to continue in the present station for a further period.

d. To allow an employee over 58 years of age to continue in the

present station for until retirement.

e. To provide facilities for an employee to work in a station close to the

place of work of his spouse.

4. Exclusions from Transfer Board proceedings

4.1 Transfer Boards need not be consulted with regard to the following

transfers:

a. Transfers not involving a change of Station

b. Transfers on disciplinary grounds

c. Transfers due to exigencies of service or for administrative reasons

d. Transfers upon promotions

e. Mutual transfers, subject to Clause 5 below

f. Transfers ordered at the request of employees outside annual transfers

in consideration of any special circumstances. subject to Clause 5

below.

5. Mutual Transfers

5.1 Mutual transfers arranged by employees may be allowed provided that

such arrangements do not affect the annual transfers. This facility shall not

be used to revert or override annual transfer decisions.

5.2 Mutual Transfers should not normally be allowed unless the employees

concerned have completed at least one years’ service in their present

station, provided that an exception may be allowed by the General

Manager in consideration of any special circumstances.

6. Posting on promotions

6.1 A condition governing promotions will be that the employees concerned

should be prepared to accept postings from their present Stations to

Stations where vacancies exist, even though such an employee has not

completed his normal period of service in the present Station.

6.2 A promotion given may be cancelled if an employee transferred out of his

present Station on promotion does not report in the new Station on the due

date. Such event, however, will not exempt him from his normal liability to

be transferred in accordance with the transfer rules at the Annual

Transfers.

7. Transfers outside Annual Transfers

7.1 Transfers between the Divisions due to exigencies of service and on

account of administrative requirements may be ordered outside Annual

Transfers in respect of all categories of Employees by the General

Manager.

7.2 Transfers within the Divisions due to exigencies of service and on account

of administrative requirements may be ordered outside Annual Transfers

in respect of employees below Class I Level by the respective Additional

General Managers or the Finance Manager, as the case may be.

7.3 Transfers on disciplinary grounds may be ordered by the appropriate

Disciplinary Authority.

7.4 Transfers on requests by employees should not normally be considered

outside annual transfers with the exception of mutual transfers. However,

where under special circumstance it become necessary to consider a

request for a transfer involving a change of Station, the Additional General

Manager or the Head of the Branch concerned should ensure that such a

request is not granted without due consideration being given to any

requests received at the annual transfers which have not been granted.

7.5 In granting any request for a transfer involving a change of Station, the

Additional General Manager or the Head of the Branch should ensure that

these Transfer Rules in general are followed.

8. Travelling Expenses

8.1 An employee transferred from one Station to another is entitled to change

of Station travelling expenses in accordance with the rules relating to

same except in the following instances:

a. When an employee is transferred on disciplinary grounds.


b. When transfer is ordered at the request of an employee who has
not served the minimum period in the present station.
8.2 Every transfer order must state whether travelling expenses will be paid by

CEB or not.

9. Concessions to Office Bearers of Trade Unions

9.1 Key office bearers of Trade Unions should be posted to stations where

their services are required for the work of Unions. They will not be liable to

transfer under the normal transfer rules.

9.2 An employee posted to a station under the above provision will become

liable to transfer under the normal rules on his ceasing to hold the office

which entitled him to the concession.

9.3 An employee posted to a station under the above provision will become

liable for transfer on promotion, if the promotion is given to fill a vacancy in

another station.

9.4 The concession allowed under the above provision will be subject to

exigencies of service and to administrative or disciplinary requirements. If

it becomes necessary to transfer an employee who is allowed the

concession for such reasons, the approval of the hon. Minister of Power

and Energy should be obtained.

9.5 A Trade Union which desires to avail itself of this concession should inform

DGM(Personnel) giving:

a. The names of the office bearers, designations and their present


stations.
b. Stations to which they are to be posted.
c. The current membership of the Union.
9.6 The concession referred to above is allowed normally to office bearers of

the parent Union. If recognized Branches of the Union have separate

office bearers in any station, they will be granted this concession only on

specific approval by the General Manager. In applying for such

concession, the Union concerned should provide satisfactory evidence

that the Branch Organizations are specifically provided for in the

constitution of the Union.

9.7 If an employee who is entitled to exercise his political rights holds office in

the Central Committee of a recognized political party in the capacity of

President, Vice President, Secretary, Assistant Secretary or Treasurer he

should be allowed the concession of service in a Station close to the

Headquarters of the Central Committee and will not be subject to the

normal transfer rules.

9.8 An employee to whom this concession is allowed will become liable for

transfer under the normal transfer rules on his ceasing to hold office in the

Central Committee or on being promoted to a higher post, class or grade.

9.9 The grant of this concession at all times is subject to the exigencies of

service and disciplinary requirements.

9.10 An employee who wishes to avail himself of this concession should apply

to the General Manager supported by documentary evidence stating the

designation of the office he holds in the Central Committee, the name and

address of the political party and the station in which he desires to serve.

9.11 A recognized political party for this purpose is a political party recognized

by the Election Commissioner.

9.12 If an employee who is entitled to exercise his/her political rights has been

elected as a member of a Local Government Body and if he/she is serving

in an office within the area of such a Local Authority, he/she should

immediately be transferred to a not too distant station outside that area of

Local Authority of which he/she is elected as a member. Under normal

circumstances, he/she should not be subjected to the normal transfer rules

as long as he/she continues to be a member of such Local Government

Body.

10. Application Procedure

10.1 Those who wish to be transferred out shall apply for transfers giving 3

preferences in the order of priority.

10.2 Those who wish to continue in the present Station but have served

mandatory period for transfer which he/she has become liable for

transferring out shall indicate his/her preferences to Head of the Branch,

who shall show this in the staff schedules sent to respective Transfer

Boards. Transfer Boards shall endeavor to transfer them to one of their

preferred station as much as possible.

10.3 Heads of the Branches shall prepare separate schedules for each of these

categories giving all the particulars in the format given in Appendix I. In

this schedule, the details related to 1.1 to 1.6 above and the preferences

indicated by those who have served the maximum period but wish to

continue in the present Station shall be clearly indicated. This schedule

also should clearly indicate the current position and/or other relevant

details of any existing transfer order or a mutual transfer of the nature

referred to in Clause 2.6 or transfers differed in a previous Year.
