Administration of Justice
Administration means management and justice means to right and fair treatment. Administration
of justice means the maintenance of right with in a political community by means of the physical
force of the state.
There are three main ideas, which demonstrate the administration of justice:
1. Juridical Process
The juridical process examines the philosophy and science of law, as well as its administration. It
considers the body of law that governs society. The juridical process deals with administrative
and theoretical matters, rather than procedures or individual cases. It serves as a guide for the
judicial process.
The juridical process examines the meaning of the law and the theory behind it. It may try to
determine the intent of the people who made the laws. The juridical process may study the law’s
application and how its principles are to be applied.
2. Judicial Process
The judicial process is the procedure for resolving disputes through the court system. Unlike the
juridical process, it focuses on procedural rather than administrative matters. Procedural matters
include scheduling, the time allowed for filing an appeal, and hearing motions. The judicial
process deals with the matters before it, rather than with concepts. It may look to the juridical
process for guidance.
This is truly a significant milestone, one which evokes tremendous pride for the Judicial
Officers, past and present, the Staff of this Court and me. Public & lawyers should find this web
site a much more satisfying experience in terms of the ease and efficiency with which it can be
navigated. This, it is hoped, will lead to greater and more frequent use, and become the preferred
information tool for keeping abreast of the Court’s work, its schedules/calendar and events. I am
particularly pleased to see this become a reality having regard to the fact that we have launched a
beta version of AJK High Court's website. Effort will continue to ensure that user-experience is
optimized. To this end we would welcome constructive feedback from the Civil Society,
Lawyers, and law students.
Though the information technology has been adopted in our country, yet information is still har
to come by. There are some websites which provide legal information as well as judgments,
statutes, etc., but being managed by private companies, one has to pay handsome amount to
utilize the same. For that reason, the law students, young lawyers and the litigant public are not
be in a position to avail such facility. In such a situation, there is immense need to make
available key information and legal data on freely accessible public domain. The launch of
official website of the High Court of AJK would certainly contribute greatly to overcome this
problem.
Under the supervision of the High Court of Azad Jammu and Kashmir, District and Sessions
Judge, is administrative head on all the subordinate Courts at district level. Our team is making
full efforts to observe the law in performing sacred duty of administration of justice.
My whole team is well aware about the fact that they are custodian of the rights of the people.
We all are trying to adhere to the provision of law, the whole judicial work is done within the
four corner of law. Courts have to follow the limitations and restrictions of law in exercise of its
functions which may not effect the spirit of law. May Allah help all of us, Ameen.
