ISSUE:
Cruz and his heirs assert their ownership over the disputed land.
It is the general law governing the classification, delimitation, survey and disposition of
alienable lands of the public domain. One of the modes of acquiring public lands under
this law is by voluntary administrative legalization of imperfect title—more popularly
known as “Free Patent.” It is intended to legalize the undocumented private land rights
of Filipinos who are found to be occupying and cultivating such lands for a certain
period of time.
On July 9, 2006 Mr. Cruz applied for a Free Patent for their land under CA 141, also
known as the Public Land Act. After meeting all the qualifications, submitting the
necessary fees, and paying the fees, they waited for the result of their application.
Sometime in February 2008, they received new that their application was granted and
on March 6, 2008, they were issued a Free Patent for their land.
The Cruz family satisfied all the legal requisites for applying for a Free Patent for the
land they have been occupying. The approval of their application and the subsequent
issuance of a Free Patent for the land they have occupied since 1938 is a recognition of
the title they have acquired over the 12 hectares of land.
