IN THE COURT OF SENIOR CIVIL JUDGE, LAHORE

Petition No. /2019

Shahzad Son of Mehnga Masih, Resident of Loharaan

Wala Kooh, Mohala Madina Colony, Multan Road Lahore

VERSUS

MST. Rubina Bibi Daughter of Taluka Masih, Resident

of Raiwind Road, Bhatta Pind, Lahore

1. That the petitioner was married with the respondent

on 04-12-2016 according to Christian Rites and Ritu-
als. It is pertinent to mention here that no children
were born out of this wedlock.
2. That the relationship between the couple remained
cordial only for a few months after the marriage
whereafter the relationship went downhill. That the
relationship reached its lowest ebb when the re-
spondent left the petitioners house with her dowry ar-
ticles on 12-08-2019.
3. That the petitioner has tried on countless occasions
to mend the relationship between the two, however
respondent refused to reconcile and has since then
adopted an extremely aggressive behavior towards
the petitioner. In addition, the respondent has since
leaving the petitioner’s house refused to perform her
part of marital obligations towards the petitioner.
4. That after having failed all avenue of reconciliation
with the respondent the petitioner has reached the
conclusion that there is no chance of reconciliation
between the two parties and hence he has decided
to file this petition.
5. That the petitioner is entitled to seek divorce under
section 10 of the Divorce Act 1869 which now al-
lows christians to seek dissolution of marriage solely
on the basis of there being no chance of reconcilia-
tion.
6. That the cause of action accrued in favour of the peti-
tioner and against the respondent firstly at the time of
marriage, secondly when the respondent left the
house of the petitioner on 11-10-2018 and lastly
when the respondent refused to reconcile with the
petitioner which clearly shows that the cause of ac-
tion is still accruing.
7. That the prescribed court fee of Rs.15/ has been
fixed on the petition.

It is therefore most respectfully prayed that a decree for

dissolution of marriage may very graciously be passed in
favor of the petitioner and against the respondent.
