respect of marriage of the Petitioners
solemnized on the 22/04/2018, in accordance
with the provisions of the Hindu Marriage
Act, 1955.
MAY IT PLEASE YOUR HONOUR

1. The Petitioners are Citizens of India and are residents of


State of Maharashtra, at .........i and __________
respectively. The Petitioners were Hindus by religion at the
time of marriage and are so at the time of filing of this
petition.

2. The Petitioner No.1, was a bachelor at the time of this


marriage and the Petitioner No.2, was a spinster with
maiden name Pratiksha Nivalkar. The marriage was
solemnized on 22/ 04/ 2018, according to the provisions of
the Hindu Marriage act, 1955 and as per Hindu Vedic rites
and rituals at Vasai (W), Mumbai- 401202. Hereto
annexed and marked as Exhibit “A” is Affidavit of
Petitioners marriage. The said marriage is not registered as
per the Registration of Marriage Act.

3. The Petitioners state that after the marriage, both stayed


together, as husband and wife, at Panvel, which place
became their matrimonial home. The Petitioners say that
the marriage has been duly consummated.

4. The Petitioners state that their marital life was happy,


cordial and warm in initial years of the marriage, however,
thereafter, differences started arousing between the
Petitioners and they discovered that they have incompatible
temperaments and varying views on life. On many aspects
of marital life, strong differences of opinion began
appearing, leading to constant friction, bickering,
disharmony and tensions in their matrimonial life,
adversely affecting both the Petitioners and families. The
Petitioners themselves and through their relatives and
friends have attempted to resolve and patch up their
differences but soon discovered that their differences are
irreconcilable and too wide to be amicably bridged to enjoy
their matrimonial life. The Petitioners state and submit that
under the circumstances, it became impossible for them to
live and reside together, hence, since 01/ 12/ 2021., for
more than a year, both the Petitioners are residing
separately and have not co-habited or stayed together since
then.

5. The Petitioners, due to efforts made to prevent their


marriage from breaking, expected some sort of
reconciliation between themselves but the same proved to
be unsuccessful. Now, they have realized and agreed that
they cannot continue with their marriage and live together
as husband and wife. In the circumstances, the Petitioners
have been living separately, since 01/ 12/ 2021, for a period
of more than a year and they have not been able to stay and
co-habit together and they have mutually agreed that
their marriage should be dissolved. The Petitioners
submit that it is in their best interest that they should
separate permanently and that their marriage should be
dissolved.

6. The Petitioners have agreed not to file any judicial


proceedings, Civil or Criminal, against each other for any
reliefs whatsoever after dissolution of marriage and have
agreed not to claim any property against each other after
divorce. The exchange of properties between the Petitioner
No. 1 and Petitioner No. 2 is complete and there is no claim
of any property against each other.

7. The consent of neither of the Petitioners, to this petition,


has been obtained by fraud, coercion or undue influence
and the Petitioners are filing this Petition on their own
option and desire and the consent to this petition is
irrevocable.
8. The Petitioners have agreed and consented not to raise or
make any claim against each other, of whatsoever nature,
after passing of decree and dissolution of marriage.

9. The Petitioners’ matrimonial home was at Panvel and both


last resided together at Panvel, at present Petitioner No.2
residing at ____________ as such, this Hon’ble Court has
jurisdiction to entertain, try and dispose of this petition.

10. The Petitioners have paid fixed Court fees of Rs._____/- to


this Petition.

11. There is no collusion or connivance between the Petitioners


in filing this Petition.

12. The Petitioners have not filed any other Divorce Petition,
Mutual Consent or otherwise before any other Court in
India.

The Petitioners therefore prays:-

a) That this Hon’ble Court may be pleased to pass a Decree of


Dissolution of marriage solemnized between the
Petitioners on_________.

b) The Petitioners be granted such further and other reliefs as


the nature and circumstances of the Petition may require
and / or warrant.
