BARANGAY COUNCIL RESOLUTION ADOPTING THE STANDING

RULES OF THE BARANGAY 198 BARANGAY COUNCIL


WHEREAS, Barangay 198 is a basic political unit of the Republic of the Philippines;

WHEREAS, pursuant to the provisions of RA 71601, otherwise known as the Local Government Code of 1991, Book 1,
Chapter 3, Section 50, Paragraph B, Number 6, wherein the Sanggunian shall adopt such other rules that may improve the
delivery of basic services to the constituents thereof;

WHEREAS, it is necessary that a standing rules be adopted and enforced for the effective and efficient delivery of
basic services;

NOW THEREFORE, on motion presented by Ethics Committee Chairman Engr. Alexander Elizaga, and duly
seconded by all, be it.

RESOLVED AS IT IS HEREBY RESOLVED by the Sangguniang Barangay of Barangay 198 to adopt the following
Standing Rules for an effective and efficient Public Administration.

RULE 1 – CODE OF CONDUCT AND ETHICAL STANDARDS

SECTION 1 – Public officials shall always uphold the public interest above personal interest. The resources and
powers of their respective duties and responsibilities shall be employed and used efficiently, effectively, honestly and
economically, particularly to avoid wastage in public funds and revenues.

SECTION 2 – Public officials shall perform and discharge their duties with the highest degree of excellence,
professionalism, intelligence and skill. They shall serve with utmost devotion and dedication to duty.

SECTION 3 – Public officials shall remain true to the people at all times. They must act with justness and sincerity
and shall not discriminate against anyone.

SECTION 4 – Public officials shall extend promptly, courteous, and adequate service to the public.

SECTION 5 - Public officials shall act promptly on letters and requests by the public.

SECTION 6 - Kagawads shall submit a hard copy (Printed or handwritten) of their Purok and committee
accomplishment report during the last regular meeting of each quarter.

SECTION 7 - Official documents shall be processed and completed at the soonest possible time.

SECTION 8 - Public official on duty shall always attend to anyone who wants to avail of services by acting on it
promptly and expeditiously.

SECTION 9 – All public documents shall be made accessible to and readily available for inspection by, the public
within reasonable working hours.

SECTION 10 - Public officials are strictly prohibited in divulging valuable information of a confidential in nature,
acquired by his/her office or by him/her on account of his official position to unauthorized persons, or releasing such
information in advance of its authorized release date.

SECTION 11 – Public officials shall always strive to be efficient and competent in the discharge of official duties.
RULE 2 – GENERAL

SECTION 12 – Smoking inside the Barangay hall is strictly prohibited at all times. Penalty for violation of this
section is
First Offense – P300.00
Second Offense – P500.00 and will be given a memorandum to explain such behavior.
Third Offense – P800.00 and will have a 1 day suspension without pay.
Fourth Offense – p1000.00 and will have a 3 days suspension without pay.
Fifth Offense - P1300 and will have a 7 days suspension without pay.
Sixth Offense - Termination

SECTION 13 – Gambling inside the Barangay hall is strictly prohibited at all times. Penalty for violation of this
section is
First Offense – P300.00
Second Offense – P500.00 and will be given a memorandum to explain such behavior.
Third Offense – P800.00 and will have a 1 day suspension without pay.
Fourth Offense – p1000.00 and will have a 3 days suspension without pay.
Fifth Offense - P1300 and will have a 7 days suspension without pay.
Sixth Offense - Termination

SECTION 14 – Drinking intoxicating beverage inside the Barangay hall is strictly prohibited except on special
occasions. Penalty for violation of this section is P1000.00.
First Offense – P1000.00 and will be given a memorandum to explain such behavior.
Second Offense – P1500.00 and will have a 1 day suspension without pay.
Third Offense – P2000.00 and will have a 3 days suspension without pay.
Fourth Offense – p3000.00 and will have a 7 days suspension without pay.
Fifth Offense - Termination

SECTION 15 - Dress Code, such as casual, semi-formal and, formal shall be strictly adhered to by the Public official
on duty is P500.00.

SECTION 16 – Public officials shall wear their official t-shirt uniform during special or regular meetings. Penalty for
violation nature from Monday to Friday. However, Secretary may render duty upon call. of this section is P500.00.

SECTION 17 – Public Officials shall come early before the commencement of the Barangay General Assembly and
shall only be allowed to leave after its adjournment. Penalty for violation of this section is P500.00.

SECTION 18 – Elective officials as well as the Secretary and treasurer shall file their sworn statement of assets,
liabilities and net worth before the end of January.

SECTION 19 – The use of the Photocopying machine is strictly for official use only unless private citizens needs to
use it for emergency purposes provided not to exceed five (5) copies and shall pay two pesos (P2.00) per copy.

SECTION 20 – Public Officials shall properly return items used at their proper place before retiring from duty.

SECTION 21 – The use of the computer is strictly for official use only unless requested for use on emergency
situation provided that requesting person shall not introduce or insert his/her USB and not to explore the contents and/or
documents of the CPU.

SECTION 22 – The use of the Barangay hall for meetings, seminars, symposium, dialogue and the like, by private
individuals, organizations and, associations, are for free, provided that a request letter by the requesting party be properly
received by the Barangay at least three (3) days prior to its utilization to avoid conflict of schedule and to maintain
cleanliness after its use.

SECTION 23 – The use of rowdy, loud, unruly, disruptive, vulgar languages and behavior inside the Barangay hall is
strictly prohibited.

SECTION 24 – Public official concerned who absents himself/herself for the following activities shall be fined
correspondingly:

· Regular Meetings P1000.00

· General Assembly P1000.00

· Barangay Activities P500.00

(Pasada, Clean & Green, Caroling, Christmas Program)

· Parade P300.00

SECTION 25 – Public officials shall be present on the first day of a wake of constituent and on the day of burial.
Death aid shall be collected and turned over to the bereaved family as soon as possible.

SECTION 26 – Emergency meeting may be called for at any time and at any given date specially in times of calamity
such as earthquakes, super typhoons, Fire, volcano eruption, flood and the like.

RULE 3 – BARANGAY KAGAWAD

SECTION 27 – Kagawad on Duty shall report at 8:30 AM to 11:30 AM and 2:00PM to 5:00PM and refrain from
constantly leaving the Barangay hall unless of necessity in nature.

SECTION 28 – Purok Kagawad in Charge shall personally interview and inform constituents acquiring business
clearance regarding their duties and responsibilities before signing the attestation and releasing thereof.

SECTION 29 – Kagawad on Duty may sign postal ID form and pre-requisite postal ID clearance in the absence of the
Punong Barangay.

SECTION 30 – Kagawads are prohibited to sign clearances and/or certifications in regards to the following:

a) All matters relating to motor vehicles

b) All matters relating to land, lot or, building construction

c) All matters relating to loan

SECTION 31– Kagawad on Duty shall fill up properly the Daily Journal Log Book, stating the date and name of
officer on duty and other pertinent activities of the day before retiring from duty.

SECTION 32 – Kagawad on duty shall ensure the cleanliness of the Barangay hall before retiring from duty.
SECTION 33 – All Barangay properties and equipments shall be properly checked and endorsed by the outgoing
duty officer to the incoming duty officer for immediate accounting.

RULE 4 – BARANGAY SECRETARY


SECTION 34 – The Barangay Secretary shall report at 8:30 AM to 11:30 AM and 2:00PM to 5:00PM and refrain
from constantly leaving the Barangay hall unless of necessity in nature from Monday to Friday. However, Secretary may
render duty upon call.

SECTION 35 - The Secretary shall print and issue only one copy for clearances or certificates, in which control
number, name of requesting person, and its purpose are properly recorded on a log book.

SECTION 36 – The number of documents to be reproduced by the secretary are as follows:

a.) Minutes of special or regular meeting – TWELVE (12) copies specifically as distributed to
eight (8) copies for the council, one (1) for archive, one (1) for treasurer, one (1) for health worker and, one
(1) for posting at the Barangay hall bulletin board.

b.) Barangay Resolutions – FIVE (5) copies to be distributed for: one (1) for the proponent, one (1)
for archive, three (3) for offices / institutions / or persons concerned.

c.) Committee and Purok Accomplishment Report – FIVE (5) copies to be distributed as
follows: one (1) copy for the proponent, one (1) for archive, one (1) for Kgd. Balandi for annual
documentation and, two (2) for offices /institutions / or persons concerned.

d.) Minutes of Case Hearings – FOUR (4) copies to be distributed as follows: one (1) for archive,
one (1) for complainant, one (1) for respondent and, one (1) for DILG – Filed Office.

e.) Summons – THREE (3) copies to be equally distributed for complainant, respondent and the
Lupong Tagapamayapa.

SECTION 37 – The Secretary shall post the agenda three (3) days prior to the date of regular or special meeting.

SECTION 38 – In the absence of the Barangay Treasurer, the secretary shall keep the daily collections until handed
over to the treasurer for weekly deposit.

RULE 5 – BARANGAY TREASURER

SECTION 39 – The Barangay treasurer shall be the custodian of all Barangay properties and shall have a complete
list duly itemized and to whom Memorandum of Receipt was issued to.

SECTION 40 – The Barangay Treasurer shall approve and issue routine slip upon payment of a determined amount
by the borrower and to properly record it on the borrowers Log Book.

However, in the absence of the treasurer, the Kagawad on duty shall assume the responsibility provided he/she follows the
proper accounting procedures. The following amount shall be collected for the following items:

 Mono block Chairs P50.00/day/piece


 Heavy Duty Canvass (Tolda) P250.00/day

SECTION 41 – Exemption of rentals are exclusively for the Barangay public officials and for private individuals to be
used during wake. Provided that the maximum length of borrowing shall be seven (7) days).

SECTION 42 – The Barangay treasurer shall, as soon as possible, ensure that damaged or lost items be paid
according to its purchased value or replace it with the same item involved or to be repaired to its functionality.
RULE 6 – BARANGAY TANODS
[adopted from the tanod IRP]

SECTION 43 – TANOD PROTOCOL

 Tanods shall be in proper uniform when on duty.


 Tanods shall wear their identification card conspicuously while on duty
 Tanods shall always bring with them their tanod gears and/or equipment
 Tanods shall maintain self hygiene during duty and other official activities and/or programs
 Tanods shall always be respectful, patient and alert
 Tanods under the influence of liquor is strictly prohibited to join ronda patrol
 Tanods shall always be ready for emergency call.
 Tanods shall conduct periodic night patrols as well as neighborhood watch
 Tanods shall assist the Sangguniang Barangay in the discharge of their duties.

SECTION 44 – TANOD DUTIES AND RESPONSIBILITIES

 Serve as a primary line in the maintenance of peace and order in the Barangay
 Monitor and coordinate the implementation of peace and order programs and projects at the Barangay level
 Serve as an information gathering mechanism
 Monitor and check the nefarious activities of criminal elements
 Identify Barangay constituents with strong deviant behavior
 Maintain continuing dialogue, close coordination and rapport with higher levels of peace and order councils and
law enforcement units.
 Recommend such measures which will improve or enhance peace and order and public safety in area of
jurisdiction.
 Monitor, coordinate, and supervise the operation of all community based anti-crime movements within the
Barangay.
 Make periodic assessment of the prevailing peace and order situation of the Barangay and submit report with
appropriate recommendations to the Sangguniang Barangay.

SECTION 45 – TANOD LIMITATION OF POWER

 Tanods shall not join in any illegal activities


 They shall not over power the police or military
 They are prohibited to perform their duty outside the Barangay
 They are not permitted to organize an offensive group against a group who has a threat, unless, if it is for self-
protection or protection for the citizens life and property or a detected threat of attack.
 House searching is prohibited unless with the consent of the owner of the house.

RULE 7 – HEALTH WORKERS

SECTION 46 – DUTIES AND RESPONSIBILITIES

 Maintain the functionality of the Barangay Nutrition Council by compiling records of activities, minutes of
meeting and formulated Barangay Nutrition Action Plan.
 Conduct regular operation timbang in the Barangay. In the conduct of OPT, the health workers shall have a
calibrated weighing scales, a crib carrier that is in good condition, and salter type or bar scale. Further, growth
monitoring chart and weight for age tables are always on hand and adequate.
 Implement the Barangay Nutrition Action Plan. They shall prepare reports as well as monitoring and evaluation
wall charts for:

- Home, School and Community Food Production

- Micronutrient Supplementation (Garantisadong Pambata)

- Food Fortification (Iodized salt, NAPA, etc…)

- Nutrition Education (Nutrition class)

- Food Assistance

- Nutrition in essential maternal & child services

- Livelihood Assistance

- Enabling mechanism for: a.] Human resource development, b.] Nutrition Advocacy, c.] Resource
Generation and, d] Overall planning, coordination, monitoring and surveillance

 Health worker shall have available, quality and timeliness of nutrition – related records at all times such as the
following:

- Updated spot map and shall be properly posted.

- Copy of the updated Barangay profile

- Master list of beneficiaries as identified by PPAN impact programs

- Consolidation of results of OPT

- Barangay Nutrition Action Plan

- BNC Minutes of meeting

- Graphical presentation of causes of malnutrition in the Barangay (Causal Model) and duly posted.

RULE 8 – STREET SWEEPER

SECTION 47 – The street sweeper shall be in proper uniform and tools in performing his duties.

SECTION 48 – The street sweeper shall perform his duties in the entire Barangay.

SECTION 49 – The street sweeper shall report to the Barangay any person found to be violating RA 9003
otherwise known as the Ecological Solid Waste Management Act.

SECTION 50 – The street sweeper shall report to the Barangay any person found to be violating RA 9275 other
wise known as the Philippines Clean Water Act of 2004.

SECTION 51 – The street sweeper shall report to the Barangay any person found to be violating RA 8749 other
wise known as the Philippine Clean Air Act of 1999.

RULE 9 – UTILITY WORKER


SECTION 52 – The utility worker shall be responsible in cleaning the Barangay hall from 8:00AM to 10:00AM
and 5:00PM to 7:00 pm from Monday to Saturday. Must schedule a twice a month general cleaning.

SECTION 53 – The utility worker shall turn over the Barangay key to Property Custodian Pedro Leander. In case
of the absence of the said custodian, the utility worker shall leave the key to Kgwd. Ramoran.

RULE 10 – SUSPENSION OF RULES

SECTION 54 – Only the chairman or vice – chairman of the committee on Rules can move for the suspension of
Standing Rules.

RULE 11 – AMENDMENTS

SECTION 55 – Any portion of these Standing Rules may be amended by a simple majority vote of all the
Sangguniang Members.

RULE 12 – SEPARABILITY CLAUSE

SECTION 56 – If, for any reason or reasons, any part or provision of this resolution shall be held to be
unconstitutional or invalid, the other parts or provisions hereof which are not affected thereby shall continue to be in
full force and effect.

RULE 13 – EFECTIVITY

SECTION 57 – This Standing Rules shall take effect immediately upon the approval of the Sangguniang
Barangay of 198.
