    COUNTER-AFFIDAVIT
    I, JETTMAR VARGAS, of legal age, a resident of 123 Brgy.
    Sineguelasan, Bacoor City, Cavite, after having sworn to in
    accordance with law depose and say that:

    1. I am the person who is charged by one MYLENE


    ABELLA, the complainant herein, of having committed the
    crime of rape against her daughter, MIRALYN ABELLA, in
    January 25, 2019. The rape allegedly occurred inside the
    room of MIRALYN in their residence.

    2. I categorically deny the accusation that I raped


    Miralyn in January 25, 2019, allegedly inside her room. I
    recall having conversation with Miralyn during her 10th
    birthday on the phone as I greeted her Happy Birthday.
    On that day, I stayed at home as it was my rest day as a
    zumba instructor and I chose not to attend Miralyn’s
    birthday because I’m afraid of her parents.
    3. Miralyn and I were in relationship since December
    25, 2018. As a result of my hard work and patience, she
    accepted my love for her and we were very happy as a
    couple from that day until her birthday on January 25,
    2019.

    4. As Miralyn was only 9 years old when she accepted


    my love, her mother, the complainant herein, was furious
    when she learned about our relationship and as a result,
    she hated me so much that she even told me that her
    husband will beat me if he will learn about my relationship
    with Miralyn.

    5. Having said that, the accusations against me by the


    complainant are all baseless and are products of personal
    grudge. She accused me of raping her daughter so that my
    relationship with Miralyn will come into end as she was
    against our relationship. She wanted me to be separated
    from Miralyn since I am only a Zumba instructor. It was
    all the complainant’s plan and purpose in filing the
    complaint to cause humiliation on my part.

    6. I ask, pursuant to law and in the interest of justice,


    that the complaint be dismissed as it was only filed to put
    me in humiliation and are only products of personal
    resentment.

    IN WITNESS WHEREOF, I have hereunto, said my hands
