I, JONES GANIA PETRAS, @ “JOJO”, 40 years old, single, Filipino
and a resident of Purok III, Brgy. Baluntay, Alabel, Sarangani Province, after having been duly sworn to in accordance with law, hereby depose and state;
1. That, herein affiant is the respondent in Crim. Case No. 00484-17
and Crim. Case No. 00485-17, for ALLEGED GRAVE THREAT and SLIGHT PHYSICAL INJURY, respectively.
2. That, herein affiant vehemently denied the allegations imputed
against me by Jimuel Manos Abarquez, the truth being;
3. That, herein affiant was working in San Lorenzo Ruiz Farm located in Purok IV-B, Brgy. Baluntay, Alabel, Sarangani Province. I was tasked to place fertilizers on the planted corn.
4. That, on September 27, 2018, about 1:00 in the afternoon, when
herein affiant was placing some fertilizers on the corn, I noticed that the work of Jimuel M. Abarquez was not properly done. That some of the fertilizers were placed at the grasses and not on the roots of the corn. That I told him to work properly as the fertilizers will be wasted. That he was also placing the sack of fertilizers in the side and not in its proper place. While we were conversing, herein complainant was so arrogant and then he suddenly boxed me but I managed to elude and I boxed him also hitting his face.
5. That, after the incident, he immediately went to the police and filed a complaint against the herein respondent without passing through barangay conciliation. However, on January 03, 2018, an AFFIDAVIT OF DESISTANCE was executed by the Complainant, after realizing that the Complaint filed against herein affiant was frivolous and unfounded, which is hereto attached as Annex “A”.
6. That, such Affidavit of Desistance was executed with his free will and volition purposely to drop and close the Complaints against me.
