How to Start a TASKA in Malaysia

Setting up a TASKA, i.e. childcare centre or nursery, and taking care of children is a weighty
undertaking. Childcare providers are guided by strict licensing laws and regulations under
the Childcare Centre Act 1984. The Act defines a childcare centre as “any premise that receives four
or more children under the age of four years from more than one household are received to be looked
after for reward”. It is a requirement for childcare centres to be registered with the Department of
Social Welfare, or more commonly known as Jabatan Kebajikan Masyarakat (JKM).

In comparison, a TADIKA is defined as any premise where preschool education is provided to ten or
more students aged 4 to 6 years. It is a centre-based operation that is required to be registered with

Before you become a licensed childcare centre, the following areas should be taken into consideration:

Start by identifying the kind of childcare centre that you would like to set up:
Minimum Requirements for Establishing a TASKA

As a reference, the minimum requirements for establishing a childcare centre are listed below:

1. The caretaker is a Malaysian citizen and is 18 years or older;

2. Entrepreneurs and caretakers must attend and pass the Basic Childcare Course (KAAK);

3. The ratio of children to floor space should be 2.5 metres per child (TASKA at Home); 3.5 metres
per child (TASKA Institution, Community and at Work);

4. Prepare a balanced food menu for children;

5. Schedule age-appropriate daily activities for children;

6. Use safe and kid-friendly equipment to meet the needs of children;

7. Prepare and maintain records of childcare centre;

8. Maintain cleanliness and security of the premise; and

9. The ratio of caretakers to children should be:


TASKA Registration Procedure

After creating a solid business plan and completing the preliminary steps, it is now time to get your
centre registered and licensed.

The registration procedures for setting up a childcare centre are as follows:

a. Find a location for your childcare centre. Do note that for terrace houses, only corner lots are
allowed; for condominiums, only ground floor is permitted. This is also subject to the consent
of the neighbouring home owners within twenty metres of the selected location and within
two hundred metres if located on a dead-end. Consultation on the address availability and
application for registration can be made through the District Social Welfare Office (Pejabat
Kebajikan Masyarakat Daerah [PKMD]).

b. Purchase the “Guidelines for Setting Up a Childcare Centre” (Garis Panduan Prosedur
Memproses Permohonan Penubuhan TASKA) from the nearest PKMD for a fee of RM10.00.
You will find the guidelines, key forms, and basic requirements and procedures set by the
PKMD, the local authority, Fire & Safety Department and Health Department.
c. Register centre’s name at Suruhanjaya Syarikat Malaysia (SSM) or Pendaftar
Pertubuhan (ROS). Then, get confirmation from Jabatan Kebajikan Masyarakat (JKM). The
name of the childcare centre must begin with the word “TASKA”.

d. Applicant completes forms and forwards to related agencies:


1. Local authority (Pihak Berkuasa Tempatan);

2. Fire and Rescue Department (Jabatan Bomba dan Penyelamat);

3. Health Department (Jabatan Kesihatan); and

4. Land and Survey Department (Sarawak only) (Jabatan Tanah dan Survei).

e. Upon approval from above-mentioned departments, submit approval letters to JKM.

f. The JKM officer will process the application and the following documents:

1. Layout plan with clearly defined measurements and usage of space;

2. Schedule outlining appropriate development activities for children;

3. A menu in line with the needs of children; and

4. List of staff, stating qualifications and experiences, in line with the ratio specified in
the Childcare Centre Act.

g. The officer will submit the report to the State Welfare Office for issuance of the TASKA
Registration Certificate. Any correction of the certificate shall be submitted within 14 days.
Notes:

a. Application for TASKA Registration can be processed online through eJKM or in person at the
office.

b. Registration fee is:

1. RM50.00 for TASKA At Home; or

2. RM250.00 for TASKA Institution; TASKA at Work and TASKA Community.

c. The validity period of the registration is for 5 years. Renewal from the Department of Social
Welfare will be required every 5 years. However, renewal from other related agencies – Local
Authority, Fire and Rescue Department, and Health Department – are required to be done
annually.
