FIR Explanation:
First Information Report (FIR) is a written document prepared by the police when
they receive information about the commission of a cognizable offense. It is a
report of information that reaches the police first in point of time and that is why
it is called the First Information Report. It is generally a complaint lodged with the
police by the victim of a cognizable offense or by someone on his/her behalf.
Anyone can report the commission of a cognizable offense either orally or in writing
to the police. Even a telephonic message can be treated as an FIR. It is a duty of
police to register FIR without any delay or excuses. Non-registration of FIR is an
offense and can be a ground for disciplinary action against the concerned police
officer.

Cognizable Offense:
A cognizable offense is one in which the police may arrest a person without
warrant. They are authorized to start investigation into a cognizable case on their
own and do not require any orders from the court to do so.

Non-cognizable Offense:
A non-cognizable offense is an offense in which a police officer has no authority
to arrest without warrant. The police cannot investigate such an offence without
the court’s permission.

Importance of FIR:
FIR is a very important document as it sets the process of criminal justice in
motion. It is only after the FIR is registered in the police station that the police
start investigation of the case.
Eligibility criteria for lodging an FIR:
Anyone who knows about the commission of a cognizable offense can file an FIR.
It is not necessary that only the victim of the crime should file an FIR. A police
officer that comes to know about a cognizable offense can file an FIR
himself/herself. You can file FIR if:
 You are the person against whom the offense has been committed.
 You know yourself about an offense, which has been committed.
 You have seen the offense being committed. The police may not
investigate a complaint even if you file an FIR, when:

I. The case is not serious in nature.


II. The police feel that there is not enough ground to investigate.
III. The police resources are already over-committed in investigating more
serious offenses. However, the police must record the reasons for not
investigating and in the latter case must inform you (Section 157 of the
Code of Criminal Procedure, 1898).

Things that should be mentioned in FIR:


1. Your name and address;
2. Date, Time, and Location of the incident you are reporting;
3. The true facts of the incident as they occurred, including the use of
weapons, if any;
4. Names and description of the persons involved in the incident;
5. Names and addresses of witnesses, if any. (Format used by the police for
the registration of FIR is attached).

Things that should be ignored:


a) Never file a false complaint or give wrong information to the police. You can
be prosecuted under law for giving wrong information or for misleading the
police (Section 182 of the Pakistan Penal Code, 1860).
b) Never exaggerate or distort facts.

c) Never make vague or unclear statements.

d) One who refuses to sign his statement of FIR can be prosecuted under
section 180 of Pakistan Penal Code, 1860.

e) One who lodges a false charge of offense made with intent to injure a person
can be prosecuted under section 211 of Pakistan Penal Code, 1860.

Procedure of Filling an FIR:


The procedure of filing an FIR is prescribed in Section 154 of the Code of
Criminal Procedure, 1898. It is as follows:

 When information about the commission of a cognizable offense is given orally,


the police must write it down.
 It is your right as a person giving information or making a complaint to demand
that the information recorded by the police is read over to you.
 Once the police have recorded the information in the FIR Register, the person
giving the information must sign it.
 You should sign the report only after verifying that the information recorded by
the police is as per the details given by you.
 People who cannot read or write must put their left thumb impression on the
document after being satisfied that it is a correct record.
 Always ask for a copy of the FIR, if the police do not give it to you.
 It is your right to get a copy of FIR free of cost.
Analysis:
The FIR was registered as the victim told the police about how he was returning from
the college at 9:30 and two people who were riding onto Honda 125 bike came who
were completely covered in the shawl, aging about 30-35, and pulled up the gun at
him and as the victim got scared, the offenders snatched the bike and ran away. The
victim submitted an FIR against the offenders very soon after the snatching.

We can see how the offenders snatched the bike by pulling out the gun. The first
question here occurs is from where did they get that gun. As they were offenders,
and law doesn’t mean anything to them, they might have gotten that weapon
illegally which is a serious concern for the State Government and their policies. The
next thing is as they were professional offenders, they might have committed more
crimes such as snatching and even murder. So, once the criminal get caught there
should be proper questioning about their other wrong doings, if any. They should be
asked about their links with other offenders and gangs.

Once the FIR was registered by the victim, the police started its investigation which
is totally a good thing. Sometime after, police found the criminals and charged them
with 20000 rupees fine and the repairing of the bike plus they got jailed too for a
specific time of period. We can see that in our country, not all the police stations and
personnel are useless, some work with integrity.

The process might not have been easy for the officers to find the criminals as they
ran away in dark after snatching the bike, but they tracked the snatched bike by its
registered number. The bike was returned to the victim once found.

At the end, we can see FIR report play pivotal role in finding the criminals if state’s
police work with integrity. It is necessary for us if something unusual happens to us
(God forbid) we should immediately report it to the police so they can start working
to find out the offenders.
Conclusion:
We can see how the case was intelligently handled by the police and the action was
taken immediately to find out the criminals. Our stat’s police do work hard, but some
of them have just lost their integrity somewhere. Although it is relaxing to see that
our police do work and the rumors about it are not somewhat true. FIR procedure is
very important and the person should do it properly. The procedure here in Pakistan
is good, but it could be better by introducing some technological advancement like
GPS tracking and CCTV cameras.

As we have seen in the above case that the victim didn’t get scared and reported
immediately to the police. Some of us doesn’t trust the police and they don’t even
file the FIR report which increases the offenders and crimes because they feel they
are not accountable. The one to whom the offense has been committed shouldn’t
get worried and report the crime to Police.

In the above section, we defined what are the basic procedures to file an FIR.
Everyone should keep these procedures in mind and most importantly shouldn’t
misguide the police or file false report against someone, as it can hit you back even
more harder. Don’t just let bygones be bygones, if something bad happens, act
against it.
