INQUEST RESOLUTION

Respondent was brought to this office for inquest investigation


after he was arrested for the commission of the offense as above
captioned in a buy-bust sale sometime on June 29, 2018, at around
3:10 pm, near the Elena’s bakeshop at Brgy. Sampaguita, Tacloban
City, Leyte by a joint team coming from PNP Provincial Office, San
Jose Tacloban City and PDEA RO-8, Tacloban City with the aid of a
confidential informant.

Submitted in support of the arrest and the complaint against


him the following among others, to wit:

1. Affidavits of Police Poseur-Buyer/Evidence Custodian,


Arresting Officer, Photographer, and Team Leader;
2. Pre-operation Report;
3. Certificate of Inventory and Receipt of Property Seized;
4. Request for Laboratory Examination;
5. Laboratory Examination Results;
6. Change of Seized Drug Custody Form; and
7. Police Spot Report.

Respondent, when informed of the pending criminal charges


against him assisted by counsel from the Public Attorney’s Office,
Tacloban City, waived his right to preliminary investigation as
provided for under Sec. 7, Rule 112 of the Revised Rules on Criminal
Procedure, thus, undersigned has to resolve the complaint with
dispatch.

The facts as laid out in the affidavits of poseur-buyer and


arresting officer showed that the arrest of respondent was valid and
taken altogether with other evidence on records, documentary or
otherwise, undersigned found that there is enough evidence to form a
well-engendered belief that respondent committed the offenses he is
being charged with.

WHEREFORE, premises considered, it is hereby resolved and


recommended that each INFORMATION for violations of Section 5
and 11, Article II of R.A. 9165 or the Dangerous Drug Law as
amended, be filed against the respondent with the Regional Trial
Courts of Tacloban City under the following details, to wit:

1. Unauthorized selling of one (1) small plastic sachet containing


white crystalline substance found to be positive with the
presence of Methamphetamine Hydrochloride marked as “LAB”
and weighing approximately 0.0262 gram, a non-bailable
offense;

2. Illegal Possession of Dangerous Drug for his unauthorized


possession of two (2) pieces of small plastic sachets containing
white crystalline substance found to be positive with the
presence of Methamphetamine Hydrochloride marked as “LAB-
1, LAB-2, and LAB-3” with respective approximate weights in
gram of 0.4502, 0.7694 and 0.6454 for a total approximate
weight in gram of 1. 865, bail is recommended at P200, 000.00;

So resolved.
