    I. MATTERS TO BE INVESTIGATED

    a. Circumstances surrounding the vandalism at male


    locker/comfort room.

    II. PURPOSE OF THE INVESTIGATION

    a. To determine the facts leading to the vandalism


    incident
    b. To determine the responsible person/s behind the
    vandalism.

    III. FACTS OF THE CASE


    a. That OOA 0900H 5 June 2017, a report of vandalism at
    male employees CR/Locker was reported to the
    undersigned during the OPSCOM meeting.
    b. That said report was verified by the undersigned by
    proceeding personally to the said location.
    c. That right there and then the undersigned saw the
    hand writings on the wall of 4th cubicle of the male
    CR. The writings on the cubicle walls were referring
    to the final result of the ongoing 2017 NBA Finals.
    d. That the undersigned immediately took pictures of
    the hand writings on the walls.
    e. That 00A 0900H 6 June 2017, the undersigned proposed
    to the Human Resource Department that the hand
    writings on the wall can be detected thru
    handwriting examination.
    f. That the undersigned suggested to the HRD that a
    sample specimen of all employees be taken. HRD
    obtained the hand writings of male employees by
    giving their suggestions in the upcoming
    “Hotelympics”.
    g. That after the receipt of the original copy of hand
    writing specimen, it was submitted by the
    undersigned on 19 June 2017 to Dr. Jezreel Vicente
    for handwriting examination.
    h. That the vandals are still unidentified as of this
    time.
    i. That as of this writing, the findings of the said
    examination have not yet finished.

    IV. DISCUSSION

    On the facts presented, detecting vandals is very


    difficult most specially if made inside a private area
    because privacy ends when the door closes hence vandalism
    by means of writing is inevitable. Even if we browse the
    entire log books available to check all the male employees
    who have gained access on a specific time, it is wrong to
    assume that one or several of them were the vandals.

    The implemented memo to make male employees pay the


    amount of two hundred pesos (P200) was a good deterrence
    likewise the general assembly was also a good move to
    inform the employees that these acts are not tolerated.

    However, someone must still be answerable to this kind


    of misdeeds.

    It was proposed by the undersigned that the


    photographed hand writing specimens be examined by a hand
    writing expert. After it was approved and sent for
    examination, the result is yet to be released. The results
    takes a long time to be released due to numerous and
    different hand writings submitted to Dr. Vicente, he cannot
    examine all the hand writings in one sitting plus his other
    obligations in their school.

    Thru this kind of method, the undersigned believes


    that the vandals can be detected. But the question is what
    if the latter’s employment has already been severed? What
    is our next move?
    The answer is we can go after the agency that employed
    him. It’s the best thing that we can do.

    V. CONCLUSION

    In view of the foregoing, the liability of the


    employee may be shifted to the agency that employed him.
    Under the vicarious liability doctrine in the context of
    the principal-agent relationship means an imposition of
    responsibility on the principal on the acts of the agent.

    VI. RECOMMENDATION

    a. Installation of hasp locks on the cubicle doors.


    Said doors must be locked and its keys will be
    retrieved at Sierra 3. Any employee who shall
    retrieve such key shall log in at the key log book.
