Executive Director Cullem gave a brief summary regarding the Environmental Impact Report
(EIR) issues brought up by the Administrative Law Judge (ALJ).

On a motion by Member Cullem, seconded by Member Narigi, and carried by the following
vote, the MPRWA Technical Advisory Committee received the report on the consolidated list of
issues from the Administrative Law Judge and added the size of the desal plant to the list of
issues to be addressed:

3. Receive, Discuss, and Provide Comments to the Water Authority Board on the Geosyntec
Report on Groundwater and Hydrogeologic Impacts, Including Modeling Issues, Raised by the
Marina Coast Water District (MCWD) in its Comments on the MPWSP DEIR/DEIS - Cullem
Action: Received report; discussed; Preliminary comments will be given to the Authority
Directors, and TAC will readdress the report at a future meeting

Executive Director Cullem introduced the draft memorandum prepared by Gordon Thrupp of
Geosyntec. He stated that Geosyntec was asked to provide an analysis on the EIR comments,
particularly those from Marina Coast Water District, the groundwater and hydrogeologic
impacts, and desal plant modeling issues. The TAC members discussed the Geosyntec report
and agreed that more time should be spent reviewing it before giving a full analysis to the
Authority Directors.

Requirements and the Status of the Test Slant Well and Installation of the Transfer Pipeline -

3. Receive, Discuss, and Provide Comments to the Water Authority Board on the Marina Coast
Water District (MCWD) Letters to the Monterey Peninsula Water Management District
(MPWMD) and the Seaside Groundwater Basin Water Master on Sept 27, 2017 Concerning
Possible Sale of MCWD Water to Assist in Meeting CDO 2016-0060 Requirements -
Cullem/Stoldt/Scuito
Action: Received report; discussed; comments from TAC members will be presented to
the Authority at a future meeting

TAC Member Stoldt gave a summary of the proposed sale of Marina Coast Water District
(MCWD) water to the Monterey Peninsula Water Management District (MPWMD) for the
expansion of the Pure Water Monterey Project. Executive Director Cullem said that the
proposal of the sale of water between MCWD and MPWMD would be an interim solution while
waiting for California American Water’s (Cal Am) desal project to be built and in turn save the
ratepayers money. He added that it will help the relationship between MCWD and Cal Am.

PUBLIC COMMENTS:

• Michael Warburton, Public Trust Alliance, said that the public is unaware of the potential
lawsuits with the water supply project.

The TAC members discussed the sale of water proposal from MCWD, and the potential for
MCWD to litigate against Cal Am’s desal project.

Member Peake said there appears to be consensus on the TAC to continue on its current path
towards the Monterey Peninsula Water Supply Project (MPWSP) and to continue discussion
regarding the MCWD proposals until the CPCN is approved in Spring 2018. Member Stoldt
added that there seems to be agreement to not undo what has already been done and to
continue on the current path and await the CPCN. Member Narigi said he does not support any
movement toward another project or mini project that detracts from the Cal Am desal plant
construction. Member Riley said that the proposal with MCWD is simply a contingency plan that
is necessary and is the best option for now.

Chris Cook, Engineering Manager with Cal Am, gave an update on the overall MPWSP
schedule, Monterey pipeline construction, and an update on the test slant wells. He answered

Chris Cook, Engineering Manager at Cal Am, gave an update on the test slant well and gave
feedback on the Hydrogeological Technical Report. He answered questions of the board.

• Michael Baer, resident, asked a question of Chris Cook regarding the slant well and
groundwater divide. He also asked about protecting local wells.

SUBJECT: Receive Staff Report Accepting the 1 August 2017 Draft Geosyntec
Technical Memorandum on MCWD Comments on the DEIR/DEIS as Final

RECOMMENDATION:

It is recommended that the Water Authority TAC accept as final the 1 August 2017 draft
Geosyntec Technical Memorandum on issues raised by MCWD with respect to the
Monterey Peninsula Water Supply Project MPWSP DEIR/DEIS as the final eport

DISCUSSION:

Interested parties were required to provide comments on the MPWSP DEIR/DEIS to the
CPUC by March 29, 2017. Accordingly, the Water Authority Board approved a contract
change order with Separation Processes, Inc.(SPI) and its sub-consultant Geosyntec to
review the DEIR/DEIS and provide an independent analysis of the intake structures and
brine disposal in advance of MPRWA comments on the documents.

In April 2017 a review of the submissions to the CPUC identified a number of issues
raised by the MCWD and the City of Marina that suggested an independent analysis
would better inform the Board and the public. Accordingly, at its meeting of May 13,
2017, the Board approved change order #6 to the SPI contract to have Geosyntec
expand its analysis to conduct a "high-level review of the MCWD comments reference
groundwater/hydrogeologic impacts from the MPWMD source water wells", in particular:

1) MCWD letter pgs 1-4, 7-8, sections C.1 (pg 50-54) and C.2 pgs 55 -64

2) HGC Comments on pgs 1-8, and comments #23-28, #31, #35, #38, & #39

3) GeoHydros Comments- all

4) EKI Comments- parag #5

Geosyntec was also tasked to review and comment on the California Unions For
Reliable Energy’s Comments concerning the vertical infiltration rates to the source wells
at pages 38-41 of their comment letter and the supporting technical memoranda.

In addition, Geosyntec was to consider any other issues raised by the MCWD with
respect to the groundwater models.

For each comment on a groundwater/hydrogeologic impact or issue, Geosyntec was


tasked to explain whether:

1) it agreed with the comment/reasoning,

2) disagreed with the comment/reasoning and why, or

3) are uncertain as to the accuracy of the comment/reasoning and how greater


certainty concerning the subject could be obtained (e.g., how the issue would be further
tested for determination).

On August 7, the Water Authority Technical Advisory Committee considered the


Geosyntec draft report dated 1 August 2017 (Attachment A to staff report #9, 10 Aug
2017 or TAC staff report #3, 7 Aug 2017) and formulated comments and suggestions for
Authority Board consideration.

Since no further action was directed by the Water Authority Board the Executive
Director recommends the draft report be accepted as final.

SUBJECT: Receive Report and Discuss the Operation of the Test Slant Well, Pipeline
Installation, and Detailed MPWSP Schedule

RECOMMENDATION:

It is recommended that the Water Authority TAC receive a report from Cal Am on the
latest "Detailed" MPWSP schedule and the status of the test well operation and pipeline
installation.

DISCUSSION:

Cal Am will provide the most recent Detailed MPWSP schedule, and discuss the status
of the test slant well including monitoring well results that may be affected by CEMEX or
other non-slant well influences. Cal Am will also provide an update on the pipeline
construction.

Of particular interest is the current salinity of the source water and the explanation for
any significant changes from the previous report.

Note that regular updates on the MPWSP are available at Cal Am's project web site:
www.watersupplyproject.org .

SUBJECT: Receive and Discuss Report From Executive Director Noticing the
Dissolution of the MPRWA TAC Effective 1 July 2018 and Providing
Recommendations to the Water Authority Board

RECOMMENDATION:

It is recommended that the Water Authority TAC receive a report from the Executive
Director on the dissolution of the Technical Advisory Committee (TAC) effective 1 July
2018.

DISCUSSION:

On May 7, 2018, the Water Authority received a letter from Monterey County advising
that, due to a $36 million budget deficit, it would be unable to make its $88,160 fair-
share contribution to the Water Authority for FY 2018-2019.

Accordingly, at its meeting of May 10, the Water Authority Board adopted a reduced
budget of $200,000. In addition to reductions in those line items that are partially
discretionary, the smaller budget will not support a TAC in the new fiscal year.

Fortunately, at this time there has been a reduction in the need for technical review of
documents or for technical advice to the Board since the MPRWA development and
approval process has largely moved to legal activities at the CPUC.

Over the last 5 years the contributions of the TAC, especially its recommendations to
the Water Authority Board, have been invaluable in moving the community toward a
viable MPWSP. The Board is much appreciative of the hours devoted by TAC members
over the years, and hopes that members will feel free to address the Board on any
issues of concern throughout the year.

FISCAL CONSIDERATIONS:

The approved FY 2018-2019 Water Authority budget does not contain sufficient funds to
support the operation of the TAC after 30 June 2018.
