INFORMATION

The undersigned Assistant Prosecutor accuses RIZALDO SONIO, a resident of Barangay

Pangabua, Jamindan, Capiz, of the crime of MURDER, committed as follows:

That on or about 3:00 o clock in the afternoon of November 21, 2000, in Barangay Pangabuan,
Jamindan, Capiz, said accused arned with a pointed knife (Kotselyo), did then and there wilfully,
unlawfully, and feloniously attack and wound therewith MELINDA ANDONE Y SARANDONA, 60 years old,
inflicting upon her multiple stab wounds on the different parts of her body, with treachery, taking
advantage of superior strength and known premeditation, said accused, Rizaldo Sonio in a sudden and
unexpected manner inside the store which is the dwelling house of the latter; and as a result thereof
said Melinda Andone y Sarandona died instantly.

Due to the death of Melinda Andone y Sarandona, her heirs are entitled to death indemnity in
the amount of SEVENTY FIVE THOUSAND (Php 75,000) PESOS and other damages that may be awarded
in consonance with the Civil Code.

All contrary to law, with the qualifying circumstance of alevosia and taking advantage of
superior strength; and generic aggravating circumstance of evident premeditation and and dwelling.

November 2000, Entry No. 10137, Page 677, series of 1997 to wit:

SPO3 Nestor Vipinosa, PNP assigned as beat patrol at the vicinity of Jamindan Municipal and
Roman Catholic cemetery, arrived station with the following information: that on or about 3:00 oclock
in the afternoon of November 1, 2001 at Barangay Pangabuan, this municipality, one Melinda Andoni y
Sarandona, 60 years old, married, illiterate, while inside her sarisari store in said place was stabbed to
death by suspect Rinaldo Sonio, alias Nono a resident of same place. Victim suffered multiple stab
wounds in the different parts of her body that cause her instantaneous death, immediately team led by
SP04 Visto conducted hot pursuit to the suspect but fled adter the incident towards sitio Bitayan
Mambusao, Capiz.

This certification is being issued upon the request of the interested party for whatever legal
purpose it may serve him/her best.

SWORN STATEMENT OF LEOPOLDO ANDONI TAKEN BY SP01 LAURO DELATORRE, PNP INVESTIGATOR IN
THE INVESTIGATING SECTION, JAMINDAN, POLICE STATION, JAMINDAN, CAPIZ IN THE PRESENCE OF
SP02 EDGARDO LOPEZ, PNP, THIS 5TH DAY OF NOVEMBER, 2000 AT AROUND 4:00 IN THE AFTERNOON.

Prel: The affiant was duly informed of the nature of the Investigation, and after having been advised of
his rights as prescribed in the New Constitution of the Philippines, testified as follows:

1.Q: Do you swear to tell the truth, the whole truth and nothing but the truth?
A: Yes.
2.Q: State your name, age and other personal circumstances.
A: Leopoldo Andoni y Vesales, 53 yrs. Old, trisikad driver and a resident of Brgy. Pangabuan, Jamindan,
Capiz.
3.Q: Why are you here at the office of the investigator of Jamindan Police Station, what can we do for
you?
A: Im here to file a case against Rizaldo Sonio wherein he was stabbed my live-in partner, Melinda
Andoni, inside our store which resulted to her instantaneous death.
4.Q: Could you narrate to the investigator all the details of what happened?
A: Yes. Last Nov. 1, 2000 at 3:10 in the afternoon, more or less, I was commissioned to gather gravel, I
was told by my nephew, alias Botsoy that something happened in our house. I immediately went
home to our house from the Poblacion and when I arrived, saw my wife bathe in her blood, lying
and when I touched her, I know that shes dead already. Then someone told me that my wife was
stabbed by Rizaldo Sonio, my son-in-law which later killed her instantly.
5.Q: Do you know if your live-in partner Melinda Andoni and your son-in-law had any quarrel?
A: What I know is when the daughter of my wife and her son-in-law separated a few times, my wife
was thought to cause the trouble between them.
6.Q: Have Rizalino Sonio and her wife who is the daughter of your live-in partner lived together for
long?
A: From what I remember, about seven (7) years.
7.Q: We have no more questions, do you ahve somethingsomething to add or deduct from your
voluntary declaration?
A: None at the moment.
8.Q: Will you sign your voluntary declaration?

EDGARDO LOPEZ, PNP, THIS 5TH OF NOVEMBER, 2000 AT AROUND 5:00 IN THE AFTERNOON.

Prel: The witness was duly informed of the nature of the Investigation and after having been advised of

A: Lydia Balbino y, Venencio, 27 yrs. Old, married and a resident of Brgy. Pangabuan, Jamindan, Capiz.
3.Q: Why are you here at the office of the investigator of Jamindan Police Station, what can we do for
you?
A: Im here to report that I have witnesses Rizaldo Sonio stabbing his mother-in-law, Melinda Andone
which caused her death.
4.Q: Could you narrate to the investigator all the details of what happened?
A: Yes. Since we live in the house of Leopoldo Andone, last Nov. 1, 2000, at 3:00 in the afternoon,
more or less, without anyone expecting him, Rizaldo Sonio arrived in the house of Leopoldo and
Melinda Andone and Melinda Andone is inside the store, then Rizaldo Sonio entered the store with
his knife already unsheathed held Melinda Andone and continued stabbing her until, she was bathe
in her own blood and I saw Rizaldo Sonio running away with his bloodied knife. I then saw Melinda
Andone crawling from the store then she lost consciousness.
5.Q: What did you do during the incident?
A: Since I was surprised, I just shouted for help and many people arrived but Melinda Andone is
already dead.
6.Q: How many meters are you from Melinda Andone when Rizaldo Sonio was stabbing her?
A: In my estimate, about two (2) meters only.
7.Q: Have you known Rizaldo Sonio for a long time?
A: A long time, because we live in one place only at Brgy. Jaena Norte, Jamindan, Capiz.
8.Q: We have no more questions, do you ahve somethingsomething to add or deduct from your
voluntary declaration?
A: None at the moment.
9.Q: Were you threatened, cajoled or promised any money or any favour to declare this?
A: No.
10.Q: Will you sign your voluntary declaration?
