How to Get Started
This CD-ROM operates under Microsoft Windows 95, Windows 98 or
Windows 2000

You need Adobe Acrobat Reader 5.0 with Search or later to use the JEFFERSONS WELDING
ENCYCLOPEDIA on CD-ROM. Before loading the latest version of Adobe Acrobat Reader, you must
uninstall the old version.

To install Adobe Acrobat ReaderTM with Search:


Adobe Acrobat Reader with Search 5.05 has been included on this CD-ROM for Windows 95, 98, 00. If you are

are displayed in a search results box, listing the
documents that contain your search criteria. Select
the document you would like to view by double-
clicking the document from the search results box.

ticular purpose. In no event will IHS or AWS or any of their respective affiliated companies, be liable to licensee or any
third party for any loss or injury caused in whole or in part by the use, manipulation, interpretation, delivery, accuracy
or otherwise of the software and information, and in no event will IHS or AWS or any of their respective affiliates be
liable to licensee or third parties for any indirect, consequential, special or punitive loss or damages, even if advised of
the possibility of such loss or damage.

Terms and Conditions

1. DEFINITIONS: Software for the purposes of these Terms and Conditions shall mean the AWS Jeffersons
Welding Encyclopedia electronic product created by Global Engineering Documents. Subscriber for the pur-
poses of these Terms and Conditions shall mean any purchaser of the Software product.

2. SCOPE: These Terms and Conditions shall apply to any and all Software in optical disc form and/or equip-
ment purchased or leased by Subscriber from Global Engineering Documents. The Software will consist of the
Global databases listed in Subscribers purchase order, which will be delivered to Subscriber in optical disc
form proprietary to either Global or a third party, user documentation, and Software support.

3. PRICING: The rate in effect on the date of a purchase order shall govern the price paid by a Subscriber.
Taxes will be added to each invoice in accordance with Section 4 where applicable.

4. TAXES: Subscriber agrees to pay all personal property taxes, ad valorem taxes, sales taxes, use taxes,
and/or taxes on purchased and leased computer equipment, which are now or which may hereafter be
imposed on the software purchased, other than Federal, State and Local income taxes, whether the same
shall be payable by or billed or assessed to Global or Subscriber, together with any penalties or interest.

5. PAYMENT TERMS/PAYMENT ADDRESS: Payment is due upon receipt of invoice. If payment is not received
within ninety (90) days, a final invoice may be processed at the rate in effect at the time of invoicing, plus the
applicable surcharge. Monthly, quarterly and semi-annual payment provisions are available at a surcharge of
10%. All remittances should be sent to Global Engineering Documents at the address indicated on the invoice.

6. DELIVERY: Delivery of Software to Subscriber shall be made approximately four to six weeks from receipt of
order. Global shall not be liable for any delay in delivery. Shipment of the database, computer equipment and
Software are prepaid surface transportation within the continental United States, Alaska, Hawaii and Puerto
Rico. In all other instances, shipping charges will be added to the purchase order.
7. TITLE: Global retains title to optical discs, Software and computer equipment (if leased).

8. RETURNS AND RETENTIONS: Subscriber incurs the contractual obligation to return to Global, FOB
destination Englewood, Colorado, all outdated computer equipment and Software at Subscribers expense.

Subscriber shall return to Global, FOB destination Englewood, Colorado, all items including leased computer
equipment supplied hereunder at Subscribers expense.

9. MAINTENANCE AND SERVICE: Global will respond by telephone to Subscribers reasonable inquiries
regarding the use of the equipment and the Software and problems encountered therewith. Such service shall
be provided to customers from 7:00 a.m. to 5:00 p.m. Mountain Standard Time (MST). Global will use reason-
able efforts to respond to Subscribers inquiries. However, Global undertakes no responsibility to resolve any
problem or correct any inaccuracies or defects in the data, computer equipment, or Software except as
expressly provided herein.
If computer equipment leased from Global proves defective when used in accordance with the Software and
Globals instructions, Global will repair or replace the computer equipment. Maintenance shall, at Globals
option, be performed at the location designated by Global. If any maintenance is performed by Subscriber on
leased computer equipment, it shall be at Subscribers own risk and expense and invalidate all applicable war-
ranties. Subscriber will be responsible for any loss or damage to the computer equipment resulting from negli-
gence or willful misconduct and agrees to indemnify Global for such loss or damage. Global or its authorized
agents shall at reasonable times, upon notice to Subscriber and subject to reasonable security requirements of
Subscriber, be allowed to inspect the Software provided under these Terms and Conditions. Subscriber agrees
to notify Global of any physical relocation of the Software from the original installation site. Subscriber further
agrees not to remove or permit to be removed any serial number or indicia showing distinguishing
type or model.

For equipment purchased from Global, Subscriber shall have the benefit of any warranties available from the
computer equipment manufacturer. Warranty is ninety (90) days labor and parts effective with the date of
shipment from Global. Should the unit fail during this period, Subscriber will ship the defective unit, freight pre-
paid, to Global where the unit will be repaired or replaced at Globals option. Subscriber shall be solely respon-
sible for the cost of repair for any defects in purchased computer equipment not covered by the manufacturers
warranty or arising after expiration of the applicable manufacturers warranty period.

10. LIMITED RIGHTS DATA: All data contained in the Software, whether in the form of optical discs, print or oth-
erwise, are limited rights data developed at private expense that embody trade secrets or are commercial and
financial and confidential or privileged. The limited rights data is copyrighted and/or the property of Global or
third parties. The data may only be used in accordance with the Limited Rights Notice contained herein.

11. RESTRICTED SOFTWARE: The Software delivered by Global is restricted Software developed at private
expense and comprises valued proprietary and confidential information of Global and its suppliers.
The Software is subject to legal protection under the copyright laws and as a trade secret. Global licenses the
Software to the Subscriber solely for its use in accordance with the restricted rights set out in these Terms
and Conditions. Subscriber may not make any changes or modifications to the Software or duplicate, transfer,
sell or in any other manner commercially exploit the Software. Subscriber understands that proper functioning
of the database requires Software in the format provided by Global. Further, the Software delivered by Global
is not designed for use with any non-Global databases.

12. LOCAL AREA NETWORK PRICING QUALIFICATION CRITERIA: This product may not be used on a net-
work. It is available in a standalone configuration only.
13. USE RESTRICTIONS:
(a) Limited Rights Notice: The Software databases and no part thereof may be copied, downloaded, stored in
a retrieval system, published, transmitted or otherwise reproduced, transferred, stored, disseminated or used,
in any form or by any means, except (1) as expressly provided in these Terms and Conditions, or (2) as may
be permissible in particular cases under the Fair Use provision of the Copyright Act of 1976 (17 U.S.C. 107).
The restricted rights of this license include the right to transfer insubstantial portions of the database into a
storage device under Subscribers exclusive control and to store the data temporarily only to display it internal-
ly. Subscriber may create printouts of the data, for the internal operations at each Subscriber site, but may not
make data or printouts of the data available for any other use by loan, rental, service bureau, external time
sharing or similar arrangement. Any reproduction must be for Subscribers internal use only and must be made
by means of a printer driven by a personal, micro, mini or mainframe computer. All other forms of reproduction
or use are expressly prohibited. Subscriber may not make the databases available to multiple users at one
time or at one location through any networking, terminal access, down-loading, internal time-sharing or similar
arrangements unless provisions have been made for the foregoing and an addendum to these Terms and
Conditions has been executed by both parties. Subscriber may not disclose or reproduce the data for support
of Government contractors.

(b) Restricted Rights Notice: The Software is delivered to Subscriber with restricted rights limited to the
minimum defined uses described in these Terms and Conditions by which Global grants Subscriber a non-
exclusive, non-transferable limited License to access data contained in Global databases by means of
Software provided. The Software may not be used, reproduced, or disclosed except as provided herein or as
may be permissible in particular cases under the Fair Use provision of the Copyright Act of 1976 (17 U.S.C.
107). The Software may be used only with the computer equipment for which it was acquired and may not be
made available to multiple users at one time or at one location through any networking, terminal access, down-
loading, internal time-sharing or similar arrangements unless provisions have been made for the foregoing and
an addendum to these Terms and Conditions has been executed by both parties. The Software may be used
or copied for use in a backup computer if any computer for which it was acquired is inoperative. The Software
may be copied only for backup purposes. The Software may not be modified, adapted or combined with other
computer software, and may not be disclosed or reproduced for use by Government contractors. Subscriber
agrees to permit Global to add appropriate legends if copies of Software and documentation are inadvertently
delivered without such legends.

14. NO WARRANTIES: Global does not warrant that Subscribers use of the Software, including without limitation,
the databases, Software or computer equipment will be uninterrupted or error-free, or that the results obtained
will be successful or will satisfy Subscribers requirements. The data is compiled from materials furnished
to Global by outside sources and should be used as a reference source only. No representations or warranties
are made as to completeness or accuracy.

ALL WARRANTIES (INCLUDING ANY WARRANTY OF MERCHANTABILITY OR FITNESS FOR ANY


PARTICULAR PURPOSE) ARE HEREBY EXPRESSLY EXCLUDED.

Oral or written information or advice given by Global, its representatives, dealers, distributors, or agents, shall
not create any warranty beyond that which is expressly contained herein and Subscriber may not rely on any
such information or advice.

15. LIMITATION OF LIABILITY: Subscriber assumes the sole responsibility for all use of the Software and agrees
to indemnify and hold Global harmless from any liability or claim of any person arising from such use. Global
shall not be responsible for any loss or damage arising out of, or in connection with, the use of the Software,
including without limitation, the databases, or equipment. Globals liability, if any, shall be limited to the price
paid for the Software that gave rise to Subscribers claim. In no event shall Global have any liability for lost prof-
its or for any other indirect, special, incidental, consequential, or punitive damages.
16. TERMINATION OF SERVICE: If within the first thirty (30) days after installation, Subscriber is not completely
satisfied with the Software, the Software may be returned with a 15% restocking fee charged to the Subscriber.
Contact your account representative for further information.

17. SOFTWARE AND EQUIPMENT: Subscriber has the option to lease the computer equipment from Global as
part of the service. If Subscriber exercises this option, Global grants to Subscriber a license to use the equip-
ment with the Software purchased from Global and subject to all of the Terms and Conditions hereof.
Computer equipment, unless purchased, shall remain the property of Global. If Subscriber furnishes its own
computer equipment, Subscriber shall be responsible for providing a microcomputer with which the leased
computer equipment will be used and electrical power and environmental conditions in compliance with the
specifications stated in Globals user documentation. Global shall not be obligated to provide any training in the
use of the computer equipment and Software unless the Subscriber has ordered training for an additional fee.
The Software will be delivered by Global with the computer equipment in magnetic disc form. It is Subscribers
responsibility to install the Software on the microcomputer. If Global delivers to the Subscriber a revised version
of the Software, Subscriber shall be responsible for installing the revised version and shall immediately cease
use of and return the prior version to Global, FOB destination, Englewood, Colorado. Subscriber understands
that proper functioning of the equipment and the Software requires a database in the form provided by Global.
The computer equipment and Software are not designed for use with any non-Global databases.

18. GENERAL TERMS: (a) These Terms and Conditions represent the complete and exclusive statement of the
understanding between the parties and supersede all prior proposals and understandings, oral or written, relat-
ing to the subject matter of these Terms and Conditions and may be amended only by a written document exe-
cuted by Global and Subscriber. In the event Subscriber issues a purchase order or other instrument concern-
ing the Software, it is specifically agreed and understood that such purchase order or other instrument is for
Subscribers internal purposes only and any and all terms contained therein, whether printed or written, shall
be subordinate to the Terms and Conditions contained herein.

(b) Failure by either party to enforce any provision of these Terms and Conditions shall not be deemed a
waiver of that provision or of any other provision of these Terms and Conditions.

(c) Global shall not be responsible for any delay or failure in performance resulting from acts beyond its
reasonable control.

(d) Neither party hereto may assign this Software, or its rights or duties hereunder, without the prior written
consent of the other, except that Global may assign this Software to any company which directly or indirectly
controls or is controlled by or is under common control with Global or to any successor to Globals assets and
business, provided that the assignee assumes all of Globals obligations hereunder. Subject to the foregoing,
this Software shall inure to the benefit of, and be binding upon, the parties hereto and their respective succes-
sors, personal representatives, and assigns.

(e) These Terms and Conditions shall be governed by the laws of the State of Colorado.
