2009-5-6-09 County Call

Ronnie did DOT application online from Dr. Phil 34689# on Tues night call says how to fill out the MCS150. Be
sure to get local tags, less than 6 passengers non, commercial, non business; mcs150.c9m. Ronnie did the
application online and got his DOT number within 10 seconds. Someone else who got the DOT number who has
been hassled royally has no more hassling.

Dr. Phil 5-5-09 question for 150 form. Dont remember which week it was.
Been 3 or 4 weeks april 14, ..
Jerry applied 2 weeks ago online; they put in red if you make mistakes and give you a chance to correct; when
completed (they) give the DOT number. Then Dr. Phil said to contact Sherry? And tell her you got the number, the
registry number.

If you have the TV and radio in the house, you turn it on. While you have access, you can watch the shows, listen.
If you turn them off, nothing happens. Do not call in and deactivate the number. You can click on license and
registration section from main menu and it says find the status of company by DOT number in the SAFER system.

The objective is to have the number active. When you applied and you did it correctly and you go in and run the
number, it will show your status is private and noncommercial and you have private cargo. That will substantiate
you as being exempt from the state and federal statutes that regulate commerce on the highway. If a law
enforcement officer runs your number and you deactivated it you are going to have problems.

Note the highlighted section because two weeks earlier he said to inactivate or deactivate the number

Caller got a private listing 2 days after he talked to Ms Wu. Dr. Phil says he better check it tomorrow. You want
your number operational and active, not deactivated.

Dr. Phil: At one point in time people were talking about deactivating the number and he didnt support (it). If you
ever want to deactivate, do it; but I do not recommend it. Keep the number you get.

Ronnie, did you tell folks what happened when the state trooper asked you about your number? Yes, Ronnie said
the trooper said when they see that US DOT its out of their jurisdiction and they shouldnt pull you over or stop
you. If you have that number exposed, that will tell them to leave you alone, when they see the information. Thats
why you keep the number active and its the only way the officers know you are private and exempt from the
regulations.

When you do this online you can do this the way you really need to do it.

Caller: (Said she) put her name is all caps.


Dr. Phil: Its immaterial whether its all caps or upper & lower. The system will put everything in all caps. The
status of the account and the cargo is the only thing with any real significance there. Go on the home page and go to
the section that says Registration and when you click on it, you will se blue boxes on the left and find the status of
a company and click on that and do by number. Type in your number, and when the search button comes up, youll
see 3 columns. Then type in Company Status and that will bring up your US DOT number. From that point on, I
recommend that you make a tag and put it on the back of the car. When you put the US DOT number on the back of
the car, you are private. That status location I just gave will say if you are private, non-commercial, if you filled the
form out properly. Thats all you need.

Other Caller: Print that out and carry copies in your car.

Dr. Phil: Many times people put out incorrect information. Someone several years ago got a DOT number, and had
a number deactivated and never had any incidents. So the assumption was that he did it correctly. When I
researched the process, I found that you did not want to deactivate the number. Maybe that man who did that never
got pulled over. If the cops ever run it, they will find that its not in the SAFER system and you are going to get a
ticket.

Caller: Cop in a restaurant was asked about the MSDOT numbers. He said no, it was not part of his job. That is a
federal issue and no state law enforcement agencies have anything to do with that.

Dr. Phil: You should put USDOT. A DOT is different from the USDOT. Each one of the states, or certain states,
have their own DOT regulations and those are called DOT numbers, so they would be reflected by the state on the
tag. If you have DOT then that well that number should still go to the USDOT. Be sure you make USDOT and
the number your identifier. There is a difference between a DOT number and a USDOT number. Its right there on
the website. When you make your tags, make sure you have the USDOT. You dont have to put private, or not for
hire because that is all reflected in the DOT material.

Caller: The individual, Bill, who talked about doing this, talked about getting a ticket.

Dr. Phil: I missed one of those calls.

Caller: He was trying to figure out how to handle the ticket.

Dr. Phil: No matter what you do you may have a defiant law enforcement eager beaver. Let them do what they
think they need to do, and you go before a judge; it will resolve right there. That shouldnt happen. These people
have to learn the restrictions and limitations on their jurisdiction.

Dr. Phil: I know people with apostilles from the SOS and verification from the Hague convention and they are
hauled in. If you have a situation like that, you have to take the necessary measures to see that it doesnt happen
again. If it were me, Id hang the guy by his fingernails and make an example of him. They need to stay in their
jurisdiction. In commerce and in common law you dont enforce beyond your jurisdiction. When you look at all the
facts, most of these people are cooperating in their jurisdiction, even though we think they are not. Once you do this
and get this DOT, you still have to cancel out the contract with the local DMV.. All those drivers licenses
and registrations have to terminated. If the record shows you are active in that venue,the cops will enforce the
active side. Any official from any state will be able to enforce their laws on you wherever you are if you have that
contract in place. So there is a cleanup operation to do there.

Caller: Would you have to have a different number for each vehicle?

Dr. Phil: No, you make the same tag on every vehicle. If theres husband and wife, you each want your own
numbers. Well go over this. When it asks for how many drivers, then put at least 2 drivers and it doesnt matter.

Caller: How do you go about canceling the contract with the state with DMV? We thought we did it when we
turned in our drivers license, but it put us in suspension.

Dr. Phil: Each MVD has a form where you can terminate your license. One of the easiest ways to get rid of the
registration is to sell the car to your husband. In Delaware when you get a certificate of title, at the bottom there is a
perforated part and you fill it out and say you sold the car to so and so, address unknown. The title is transferred to
the buyer.

Question: Could you scrap out or junk out the car?

You have to notice DMV that you junked the car. Just do it with MVD.

Dr. Phil: I dont know how it is set up in your state. Just notice the main office of the DOT of the state of the
action.

Caller: If you do that, will they want some kind of paperwork that the car was sold to a junkyard?

Dr. Phil: In Delaware, once you have informed them that you have junked the car, they may contact the junkyard.
Just sell the car. Create a private company that you own for private purposes, and say that you sold the vehicle. I

went to MVD and said. I want to terminate the registration of the vehicles and they are going to be moved out of
the state of Delaware. I said that was private affairs and I am canceling the registration. They gave (me) a
document on their letterhead that listed all the vehicles and the registrations, and that they were no longer registered;
and it was signed by a manager/supervisor.

I wanted to terminate the drivers license and they gave me a form. I terminated the license and that was it. In some
cases they were still carrying the drivers license as expired. If Im out there on the road now, and I have the
USDOT number, it doesnt matter; it will supersede what they have, that it has expired. I have the documentation
with their letterhead, signed by a department manager, stating the license was turned in and the registration
terminated. The DOT is uniform across North America.

Question: If its a commercial instrument, the DOT number, could you open a bank account with it? Just curious if
anyone has done that.

Dr. Phil: The best way to answer that is to go to the bank and talk to them. I get things done in banks and others
say they cant get it done. These things have variables. Act as a sovereign and conduct your business as a
sovereign and be assertive. They will send a letter and thats all you will need.

Dr. Phil: You need to terminate the contract with the state motor vehicle department. Lots of states MVD are
going over to DOT. They are gradually getting away from the MVD and itll start happening in most states. No
matter what, the DOT is supreme. The USDOT is the overall, supreme controller and regulator of movement of
goods and products up and down the highways. The USDOT normally allows each state, within the territorial
bounds of that state, to operate through their state laws, which have to conform to the USDOT regulations. The
states are controlling and regulating. The USDOT is overseeing and making sure the states are consistent with their
regulations.

Caller: OK, I just registered online and I have the DOT number and the form is completed. I just registered my
vehicle and there werent a bunch of questions. I went in as a registrant only and got the DOT number and didnt
have to answer 50 questions.

Dr. Phil: When I did that and got to completion, it wouldnt give me a number.

Caller: I got a pin number also.

Caller: Please start from the beginning of the application and walk us through that.

(NOTE from note taker: When filling out the online application, do not use a browser with pop-up restraints.
Youre better off to use Outlook Express or something similar).

Dr. Phil: For those who have your computers go to the fmcsa webstite.

www.fmcsa.dot.gov Thats the Federal Motor Carrier Safety Administration website.

Click on Registration & Licensing.


Click on the Online Registration choice.
Select USDOT Number, Operating Authority.
You want to go to the box that says Register Now Without Help and go to the bottom of that block.
Now you go to a window called registration options. It says you need a credit or debit card to proceed
electronically. (Your card will NOT be charged.)
Click the first block on the left, I think I need to register.to get a DOT number.
Click that box. Then go to the bottom of the page and click Continue.

That will bring up the page that says New or Existing Registration. Skip section A and go to section B, Type
of Business, and click Motor Carrier. (If you want to know the definition of motor carrier you can click on the
blue word and you get the definition.)
Check the box Motor Carrier and go to C and find your state; select it and then
Go to D and click Private.
Go to E and click Interstate.
On F, click No, I do not carry hazardous materials
Skip G.
Go to H and click the box that says gross vehicle weight of 10,000 or more and click passenger vehicles for 9-
15 passengers.
On I, you will skip or click Non-Applicable. Hit the Continue button.

The next page says new or additional registration. Save this page or print it, because it has your registration
tracking number and personal identifier and you need these numbers to complete your registration.
Then click, file electronically. That brings the page that requests your credit card information. Your credit
card will not be charged. They ask for this because the information serves as a signature identifying you
because there wont be a signature on the electronic filing and they are using the credit card to verify you are
who you are. You cant use anyone elses card, but your own. Fill the information in and be sure you put the
correct information in there. You have the registration tracking number and personal identifier.
Once that is completed and the information is correct, then click on Continue or Submit.

That brings up a page that says complete my pending registration.


Type in the tracking number and the personal identifier. Once you type that, click Continue and go to the next
page.

The next page is the new USDOT number MCS150 and the name of official authorized to complete this form.
Put your name the way it is on the credit card or debit card. The title of the official, Dr. Phil put
contracting agent. (You can put CEO, CFO, name of a business you want to use. The first time I did it I was
going to use my business name and I modified it. I put in contracting agent based on standard form 28.) Dont
add anything such as without recourse or anything like that. It is only going to take the name as it appears
on the credit or debit card. If you have a suffix such as Jr, do not put in Jr., as it doesnt like the period. Just do
it the way it shows up on your credit or debit card.
You will see it shows the registration number and the personal ID number, so click on Continue and go to the
next page.

Now you have the USDOT number and the type of carrier and it will show the status as active. Now you put
the name on the credit card where it asks for legal name in both places unless you want to put the name of
your own business. That USDOT number may not show up there, just fill in the highlighted blocks and move
on.
Now you are on the page that says USDOT, and then company type, then carrier, then legal and DBA name,
status active. The legal name is the name on the credit card. Put the DBA name as the same. Then fill out
your location address, phone, fax, mailing address. EIN and Social Security numberput the SS# in both places
with no dashes. Put in your email address. Make sure you are doing all correctly. You dont need to put cell
phone. Do what you like on those white areas that are not highlighted as a requirement to fill. If there is no *
beside a box, then leave it blank. They are asking if the mailing address is different from the physical address.
If they are the same, leave it blank. Leave MX number blank.
If you dont have anything to put in the EIN box, no tax ID, or employee ID, or SS#, leave it blank, but you
probably cant go any farther. If you have the email address in, go down the rest of the page.
Officer name is your name, the full name and put [living man] and then as officer title, put contracting agent.
Then open a Word document and type in your full name in ALL CAPS and add the symbol and cut that and
paste it in. Then put [private trade name] and for the officer title, I put partner. JUNE HANNA DOE you
dont need a second officer if you dont want to put it in there. The contracting agent is only for the first
name, and dont put it for the second one. Follow what he said to do above.

When you get to the bottom of the page, the carrier operation should have a mark in it. If you hit the return
twice and hit the back page, youll probably lose the information and itll take you back towards the beginning.
If you went back six pages, click forward six pages to get back where you were.
Dont put any dashes in the phone number when you fill it out. No spaces, no dashes.
Jot down the identifier and PIN. Registration number is the identifier, and PIN is the personal identifier
number. If you get an error, it will be highlighted in red. [Caller: How about trustee? Dr. Phil: I use
contracting agent and support that with form 28, the affidavit of surety, and the contracting agent does so for the
strawman. One could put trustee if thats what they want to put in.] At the bottom of the page you have
interstate highlighted. Now go to the next page.
That next page has the legal name and you put the same name youve been using and then put in Carrier.
The next section on mileage is zero and the mileage year just leave blank.
The next section is operation classification, Check all that apply. [I checked private property and then check
other: and add private non commercial classification.
In the next section where it has cargo classification, I went to the bottom to other and put private non-
commercial cargo. I didnt check any other blocks.
The next section deals with hazardous materials carry, skip that whole section.
The next section says number of vehicles that can be operated within the United States and it has owned
vehicles. For straight trucks put one (1); for tractor trailer, I put zero (0); for trailer, I put one (1); and the other
two as you go across have zero (0).
Terms leased, put zeros (0) all the way across.
Trip lease, as you go across, put 1 in straight truck, 1 in truck trailer, then 1 in trailer and leave the rest with 0.
The number of vehicles carrying the number of passengers, put 0 in everything.
In the next section it says drivers subject; interstate 100 mile radius I put 2 in there; interstate beyond 100
mile radius, I put 2 drivers there. That will give you a total of 4 drivers. Put 0 for total of CDL drivers.

Registration Confirmation
The following not needed if filled out as above

The next section has safety certification for application. MCS150A and this form have to be filled out to get
the USDOT number. Just click yes for everything until you get to #7 where it talks about hazardous
material. When you complete that under #7, it has hazardous materials: on everything there, click not
applicable.

That takes you to #8: that goes down to item 8A and then you see a section that all applicants must certify the
following and you click all three items yes. Everything is non-applicable. When you get to C, 1,2,3 - all of
those were yes.

When you are satisfied with all that, go to the bottom of page and click, add, when you click add you should
see registration confirmation, DOT number and a carrier PIN. If you got a warning message, you have to go
back up the page and find the red highlighted item and correct it.

It could be looking for mileage year 2009. If we put 0 for the mileage you may have to put 1 in there. Dr. Phil:
How can you have mileage if you dont have a number?

The following are questions and answers, which may be repeats of the above information. People on the call were
asking to have information repeated.

You have to put 1 in the straight truck and trailer in the previous section; term lease put 0, and trip lease put 1 in the
first 2 boxes and then 0s.

Dr. Phil: In the first area where it asks for safety certification for application put yes in all the blocks until you come
to number 7 that mentions hazardous materials, and you put non-applicable in that section until you come to C, and
then you put yes in C1,2,3. (107.37 on tape).

If you follow what Ive suggested you shouldnt get any error messages.

You should have the DOT number and the PIN. If you didnt have errors it should be at registration completion and
you would have those 2 numbers. Write them out or print them where they are easily accessible. If you modify
or change anything, it will ask for those 2 numbers. Go back in the form and find your error message if you dont
have the number. Any place with non-applicable box, put NA so you dont get error messages.

Recap questions: (129.00 on tape) Back where you were filling in the number of drivers, you can put 4, if you have
a spouse and then 2 children. If you do that in both boxes, youd have 4, up to 8 drivers. You dont need to bother
with Intrastate. The next section was safety certification for application of 150A and you want to check all those
boxes yes until you come to item #7. After item #7 that deals with hazardous materials, you check all the NA boxes.
You would check those all through that section. At C, the applicant must certify as follows, check yes in those 3
boxes. Go to the bottom and click add.

If you need to update your information, or make changes

Click online registration, then click I need to update my USDOT number. When you do that, you will get the
window that says go ahead and electronically file and the next window asks for the DOT# and the PIN and the name
of the authorizing official and title, you put that in. When you hit continue it asks for the Credit card info again;
submit that and it will bring up your application, and you make whatever changes you want to make.

If you want to find the status of your account

Go to www.fmcsa.dot.gov and click on registration and licensing and find by company status. Click on the
USDOT# and that window opens up with 3 columns and you click on the company snapshot. Check the USDOT
number and enter the value of that number. When that number is put in and you hit search, it should bring your
account up.

For tags he will find someone out there to make something up, www.cr8-apl8.com expensive, but metal. Or design
your own. FYI: Sami in Nevada can make the plates, as well as decals for the side windows, if you wish. Her
email address is [email protected]. Lynn has ordered their plates in a different size than the regular-sized
plates so that they can be seen from 50 feet away. Theyre 7 x 16

If you go to toll booths, you show the documentation that you may get from Odessa (Texas). They have a copy that
says they are exempt from tolls and the individual at the window lets you go through.
Caller: We just have flashing lights where you just pass under those.youre still paying the toll. You just build up
a credit and then its deducted. You have a windshield sticker where you have paid the account in advance.

Caller: What is the next step? Can this number be utilized on a passport application?
Dr. Phil: I dont know. You might just want to try this. I dont know.
Caller: What about liability issues? If you dont carry insurance are you banking on the 90, 91 and 28? Dr. Phil:
Id be banking on insuring yourself by some type of a bond. I dont have all the specifics on that.
