Note On Grampanchyat Sanctions
Since the formation of HUDA (now HADA) in 1975, permit or sanction for construction
of buildings or development of layouts, in and around Hyderabad can only be granted by
GHMC (MCH) or HMDA.
GHMC / HMDA are the only authorized bodies to grant sanctions for developing layouts.
A layout is a sub-division of a large piece of land into smaller plots by providing
amenities like roads, electricity, water, drainage, parks, etc. The law is very clear
Grampanchyat approved layouts are illegal! Infact, HUDA has on several occasions
issued caution notices in this matter. One such notice is given herein.
As per the revised building byelaws given in G.O. No. 423 of 1998, Grampanchayats
were authorized to give sanction for construction of individual houses on plots not larger
than 300 sq mtrs. However, the said G.O. did not permit the Grampanchayats from giving
approvals/sanctions for apartment complexes, other types of buildings or for layouts. The
limited authority of the Grampanchayats to grant sanctions for individual houses on plots
upto 300 sq mtrs was withdrawn by G.O. 86 of 2006. At no point of time did
Grampanchayats have any authority to grant approvals/ sanctions for apartment
complexes or layouts.
A public interest litigation has been filed in the Honorable High Court of A.P. for
prohibiting the electricity board and the water board from providing these services to
Grmpanchayat approved layouts or buildings. See the news clips enclosed herein
The so called Grampanchyat approved sanctions for apartment complexes or layouts are
illegal and subject to demolition or penalization. Even individual houses built on
unauthorized layouts are illegal.
Caution:
1. Do not purchase plots, flats or individual houses which are not approved by
GHMC or HMDA.
2. Layouts, apartment complexes or individual houses that are under construction
may be denied essential services like water and electricity if the public interest
litigation pending in the Honorable High Court is allowed.
3. Grampanchayat approved apartment complexes and other buildings are liable to
face demolition or may have to pay substantial penal amounts for regularization.

ORDER:
1. In the G.Os. first to sixth read above, orders have been issued fixing standards of
F.A.R. values and other standards of building requirements for different types of
buildings, uses, and occupancies in Municipal Corporations, Municipalities and
other areas of Urban Development Authority areas. Various representations have
been received from different interest groups like builders and developers on one
hand, and environmentalists, academicians and residents on the other, for further
rationalization of the standards of F.A.R. and Building requirements in these areas.
2. Government after holding discussions and deliberations at various levels involving
various groups like builders, developers, architects, engineers, town planners,
representatives f Urban Development Authorities and local bodies, public
representatives, academicians, officials and general public, have decided to further
rationalize the F.A.R. values and standards of Building requirements for different
types of buildings, uses & occupancies in Municipal Corporations, and Urban
Development Authority areas. Accordingly, Government after careful examination
of the matter in details issue following orders:
1. PROCEDURE FOR OBTAINING BUILDING PERMIT:
1.1 No person shall carry out any development or building construction activity without
obtaining permit from the Authority, except in the following cases and unless
exempted by state or central Acts/Rules/Orders.
(a) No prior sanctions of building applications are necessary for the construction of
individual residential buildings in plots uto 100 sq mtrs., and height restricted to
10 mtrs i.e., Ground + 2 Upper Floors (without stilts) subject to the following
conditions:
i) such plot should be less than or equal to 100 sq mtrs., as per the following:
a) Part of an approved layout or sub-division.
b) Allotted by or purchased from a public agency like Housing Board,
Housing Corporation etc.
c) Covered by pattas issued by the Revenue Department.
d) T.S Record or Registered Sale Deed of Date prior to the date of these
orders.
ii) The construction shall be carried out, strictly in accordance with the Maser
Plan/Z.D.P., Zoning Regulations, Building Bye-laws/Rules etc.
iii) The owner shall file with the local authority, copies of drawings of proposed
building along with necessary fee/charges as fixed by the local authorities
together with attested copies of ownership documents and layout plan before
undertaking the construction.
iv) The owner shall file with the local authority an undertaking stating that he
shall leave and surrender land for road widening, if any, free of cost and that
he will not violate any rules, building bye-laws, and that in case of violations
the local authority would be at liberty to summarily remove such deviations
without prior notice and at owners cost.
v) Such application filed with the local authority shall be valid for a period of 3
years for completion of building and it would be mandatory to file building
completion certificate with the concerned local authorities.
(b) In respect of construction of individual residential buildings in plots upto 300 sq
mtrs., and height upto 10 mtrs. i.e., i.e., Ground + two upper floors (without stilts)
no prior approval from the local authority/Urban Development Authority is
necessary, provided that such type of individual residential buildings are got
approved by empanelled licensed personnel i.e., qualified Architects, Engineers,
Town Planners and Surveyors; and it shall be ensured by the licensed technical
personnel that the construction is undertaken and carried out as per the approved
building plans. Such plots should form part of a layout or subdivision approved
by the competent authority. Further,
i) The licensed technical personnel shall be completely and solely responsible
for ensuring that such residential building conforms to all regulations, bye-
laws, other stipulations in force.
ii) The construction shall be commenced by the owner only after filing with the
local authority a copy of the building drawings approved by the licensed
technical personnel along with prescribed fee/charges as fixed by the local
authority together with attested ownership documents, copy of
layout/subdivision, etc., in the prescribed format.
iii) The owners shall file an undertaking stating that he shall leave & surrender
the land affected in road widening, if any, free of cost and that he shall not
violate any Regulations, bye-laws or the approved drawings signed by the
licensed technical personnel and in case of any violations, the local authority
would be at liberty to summarily remove the same without prior notice at the
owners cost.
iv) Such building drawings approved by the licensed technical personnel shall be
valid for three years from the date of filing a copy of approved building
drawing with the local authority. Building completion Certificate shall be
filed by the owner with the local authority through the licensed technical
personnel within this period.
v) If it comes to the notice of the local authority that the approval of building
drawings are in violation of rules or if the facts have been misrepresented in
the following cases, the licensed technical personnel will be held solely
responsible and his licence will be liable for cancellation, disqualification, etc.
a) If the building proposal is approved in a plot forming part of an unauthorized
layout or subdivision.
b) If the building proposal is approved in violation of Zoning Regulations, Bye-laws,
Master Plan/Zonal Development Plan etc.
c) If the building proposal is approved in a plot of 300 sq mtrs. Or less but the same
is actually having an extent more than 300 sq mtrs on ground.
d) Where the dimensions of the plot are no tallying with documentary plan, ground
situation to that of sanction plan by licensed technical personnel.
e) If the site details are wrongly represented in the drawings.
vi) If it cones to the notice of the local authority that the owner after obtaining
sanction of building by the licensed technical person takes up construction in
violation of Rules, Regulations etc., and against sanctioned plan, action will
be taken against such constructions as per rules including demolition by the
local authority.
vii) The local authority shall also monitor the construction of above buildings and
take necessary action against unauthorized constructions/deviations as per
rules.
1.2 However, any person can also apply to the concerned local authority for sanction in
respect of buildings in plots upto an including 300 sq mtrs.
1.3 For all other types of residential and non residential buildings prior written
permission of the local authority/Urban Development Authority is necessary.

O R D E R:
In the reference 1st read above, Government have issued Comprehensive Building
Rules which are applicable to Municipal Corporations, Municipalities and areas
covered by Urban Development authorities. Since then these Building Rules have
governed building activities in urban areas.
2. It has been brought to the notice of the Government that the above
building stipulations are cumbersome with too many parameters for regulating and
controlling developments and building activities and there is a need for simplifying the
building stipulations by stipulating minimal parameters. Further due to changes in
building technologies, massive and rapid urbanization, escalating land prices, and
certain shortcomings experienced relating to the existing building stipulations
Government have decided to review the building stipulations and come out with
comprehensive building rules thereby, making the building stipulations clear, easy to
comprehend, user-friendly, promoting various types of development and building
activities, besides giving design freedom and choice with optimum usage of land on one
hand, and reducing the trend of violations and unauthorized constructions on the other,
without compromising on the community good.
3. Initially a draft was prepared in consultation with experts from various fields and
the same was notified in the Andhra Pradesh Extraordinary Gazette No. 4, dated
22.01.2005 for inviting public objections and suggestions. A number of objections and
suggestions were received from individuals, professionals Municipalities, Municipal
Corporations, Urban Development authorities and other Departments. Further
discussions and deliberations were held at various levels involving various groups
like builders, developers, architects, engineers, town planners, representatives of
Urban Development Authorities and local bodies, public representatives, academicians,
officials and general public, and have received many suggestions and comments on
the said draft building rules. After careful examination of all the objections and
suggestions received, Government have come to the conclusion to further rationalise
the standards of Building requirements for different types of buildings, uses &
occupancies in the Municipal Corporation of Hyderabad, and Hyderabad Urban
Development Authority, Hyderabad Airport Development Authority, Cyberabad
Development Authority and Buddha Purnima Project Authority so as to have uniform
application of the rules relating to regulation of building construction, etc. in the above
areas. Therefore in suppression of the Rules issued vide G.O.Ms.No.423 M.A.,
dated 31-7-1998 and the Municipal Corporation of Hyderabad Building By-laws 1981 to
the extent specified in these Rules Government hereby issue the following Notification
and the same will be published in Andhra Pradesh Extraordinary Gazette dated
04.03.2006.

Do Not Provide Facilities To Houses Constructed Without Permission.

A petition was filed by C. Ramesh in the High court pleading to give orders to the
concerned authorities to those layouts, apartments, independent houses which are
constructed without permission of GHMC or HMDA should not be provided electricity &
water connections. The petition was filed against MD, AP Transco, Director APCPDCL,
Municipal Authority (concerned hierarchy), Commissioner GHMC, Vice Chairman
HMDA. Mr Ramesh in his petition has told that some real estate owners are constructing
apartments and making layouts without taking appropriate permissions. They are selling
the said layouts and apartments without giving basic amenities by luring the customers
with cheaper rates. He also told that the builders are in the thought that they can
regularize the unauthorized buildings after constructing the apartments. By this the
customers who are buying the flats or plots are facing severe problems. In Mumbai,
Chennai and in other cities the authorities do not provide electricity and water
connections for unauthorized constructions. In Hyderabad surroundings there are so
many such layouts where builders are constructing the apartments without any
appropriate permissions from concerned authorities and the authorities are also not taking
any steps to stop such constructions. He pleaded that it is against article 14 (of the
constitution). Though village panchayats are not having the authority to give
permissions, they are going out of way and grant permission for such type of
constructions.

10 Sarpanches Face Axe

As many as 10 sarpanches of villages under the Hyderabad Metropolitan Development
Authority (HMDA) face dismissal as it has been detected that they have given building
and layouts permissions unauthorisedly. The sarpanches have already been given notices
to explain why they should not be removed.
For instance, the sparpanch of Keesara village has sanctioned 19 permissions in the last
few months though he has no powers to do so.
Ranga Reddy district officials have initiated action against the sarpanches for flouting the
rules.
Notices have been served on the sarpanches of Keesara, Koheda in Hayatnagar mandal,
Meerpet and Mamidipally in Saroornagar mandal, Aushapur in Ghatkesar mandal, on
charges of giving permissions to layouts, buildings unauthorisedly, district panchayat
officer of RR district J Aruna told TOI on Tuesday.
Some sarpanches were also served notices for embezzlement of funds, the district
panchayat officer said. As per section of 249 of the AP Panchayat Raj Act, sarpanches
can be removed by the district collector within 15 days of giving notices, if found guilty.
Grampanchayats are empowered to give permission for up to ground + two floors in their
jurisdiction, that too for residential buildings. For above ground + 2 floors, the approval
has to be obtained from the Director of Country and Town Planning (DTCP) or
Hyderabad Metropolitan Development Authority (HMDA).
Similarly, permission for layouts up to 1,000 sq yards can be sanctioned by
grampanchayats. For above, 1,000 sq yards, panchayaths should seek technical approval
of either DTCP or HMDA.
There are several instances of high-rise buildings and apartments coming up in gram
panchayat limits with collusion between builders and sarpanches. Even permission for
school and hospital buildings are being cleared by sarpanches in Saroornagar and
Hayatnagar mandals.
There are also instances of sarpanches putting their stamp of authority on hundreds of
illegal layouts without technical approval.
Ranga Reddy district collector Dana Kishore held a review meeting on Tuesday officials
and sought a report within a week from 286 village panchayat secretaries in HMDA
limits on the illegal buildings and layouts within their jurisdiction.

The Hyderabad Urban Development Authority (HUDA) was constituted in October 1975 with a jurisdiction of 1840
sq.kms., which included the erstwhile Municipal corporation of Hyderabads 12 surrounding municipalities namely
LB Nagar, Uppal Kalan, Gaddiannaram, Malkajgiri, Kapra, Qutbullapur, Alwal, Serilingampally, Rajendra Nagar,
Kukatpally, Patancheruvu, Ramchandrapuram (now the Greater Hyderabad Municipal Corporation area) and 123
Gram Panchayats. HUDA has delegated its power to GHMC for areas within the jurisdiction of GHMC.
For comprehensive development of the surrounding areas, the Government of Andhra Pradesh, through G.O.
Ms.No.:274 MA Dtd.: 20-04-2007 and G.O. Ms.No.:430 MA Dtd.: 08-06-2007 , issued orders expanding the
jurisdiction of HUDA. This was the first step towards the constitution of the Hyderabad Metropolitan Development
Authority.
The constituent areas of the expanded jurisdiction include 16 Mandals of Hyderabad district, 10 Mandals of
Medak district, 22 Mandals of Ranga Reddy district, 2 Mandals of Mahaboob Nagar district and 5 Mandals of
Nalgonda district with a total of 626 (as per the table given below).
As per the provisions of Andhra Pradesh Urban Areas (Development) Act, 1975, HUDA is the competent authority
for approving any Layout or Land development Scheme for which prior approval has to be mandatorily obtained
by the owner/developer before undertaking any development activity. HUDA has already undertaken preparation
of the Master Plan for the said extended area with a view to promoting and securing developments in accordance
with the said Master Plan.
The Government of Andhra Pradesh through Memo No.: 8326/11/07 Dtd.: 09-05-2007 and Memo No.:
8118/11/07 Dtd.: 13-06-2007, issued instructions relating to the transition management of development control
functions in the extended area so as to ensure that no inconvenience is caused to the public in matters relating to
Layout approvals.
To avoid inconvenience to the public, it has been also decided that the District Office/Regional Office/ Head Office
of DTCP shall accept all layout applications in the extended area in the prescribed Application form of HUDA
directly from the applicants.
After Scrutiny of the Application, the DTCP will forward the layout pattern to be approved to the Vice chairman for
further necessary action as per HUDAs procedure for approval of Draft and Final Layouts.
HUDA has a system of Verifying the title over the land. Therefore, HUDA approved implies clear title over the
land.
The Layout Applications in the extended area can be filed in any of the following Offices of the Directorate of
Town & Country Planning (DTCP) i.e., (1) Head Office of the DTCP at AC Guards, Hyderabad / DTCP Regional
Office, Old Malakpet (2) DTCP Office, Annapurna Apartments, Old Malakpet, Hyderabad for the areas covered
under Ranga Reddy District (3) DTCP Office, Shanthinagar, Sangareddy for areas covered under Medak District
(4) DTCP office , Opp. NGO Home, Subhash Nagar, Mahaboobnagar for areas covered under Mahaboobnagar
district (5) DTCP office, Old VT Colony, Nalgonda for areas covered under Nalgonda district.
This Public Caution Notice is issued to make the public aware that HUDA is the competent authority for saction of
any Layout or Development Scheme in accordance with the layout regulations and the Hyderabad Revised
Building Rules, 2006. Any layout which does not comply with the above or any layout sanctioned by Gram
Panchayats which does not have the approval of HUDA or the Directorate of Town & Country Planning , AP is not
a valid layout and is unauthorized development.
HUDA, Extended HUDA Area/ HADA- it has come to the notice of HUDA that certain builders/developers
are undertaking unauthorized layout developments in HUDA area and promoting these without valid
layout approval, thereby cheating the public/plot buyers. Public and interested bodies/agencies, etc., are
therefore cautioned not to buy/enter into transactions of properties/plot etc., in such unauthorized layouts
that do not have the approval of HUDA or the Director of Town & Country Planning, Andhra Pradesh.
Despite the above, if the general public, builders, developers, promoters, public agencies and other interested
bodies/agencies are entering into transactions or buying plots in the said listed areas, they would be doing so at
their own risk and may force consequences as per law.
Public and interested bodies/agencies, etc., are further cautioned that as per Rule 24 of the Hyderabad Revised
Building Rules, 2007, any developer/builder understanding development or any firm doing property business in
HUDA area or soliciting, property sale/transactions or advertising as such in case of above, shall necessarily
mention the details of the approval given by HUDA /DTCP together with the Permit/File number and its validity for
information and verification of public/prospective buyers.
Absence of the above or suppressing of the above facts would invite penal action including debarring of the Real
Estate/ Development Firm/Company area besides prosecution as per Law.
