Sub : Official Committee, 2009 – Revision of scales of pay and allowances,


pension / family pension ordered – Payment of revision of arrears,
pension and pensionery benefits for the period from 1—1—2007 to
31—5—2009 – Instructions – Issued.

I am directed to invite your attention to the references cited.

2) In the Government Orders first and second cited, orders have been issued
revising the scales of pay of Government employees / teachers notionally with effect
from 1—1—2006 and with monetary benefit from 1—1—2007 and also revision of
pension and pensionery benefits. Among others, it has also been ordered that the
arrears accruing on account of pay revision and revision of pension / family pension
for the period from 1—1—2007 to 31—5—2009 shall be arrived at as ordered
therein after adjusting the interim arrears already paid and the net balance arrear
amount due shall be paid in cash in three equal annual instalments i.e. first
instalment during 2009—10, second instalment during 2010—11 and third and final
instalment in 2011—12.

3) Certain individuals have raised doubt as to whether the arrears due to


revision of pay / pension in the case of an employee, pensioner / family pensioner
who expired during the period between 1—1—2006 to 31—5—2009 or subsequent
dates be paid in full to the legal heirs or in three annual instalments as ordered in
the Government Orders cited.

4) I am directed to clarify that in the case of an employee / pensioner who


expired on or after 1—1—2006, the entire Pay Commission arrears consequent on
revision of pay, the difference in retirement benefits such as Leave Salary, Gratuity
etc. shall be paid in one lumpsum to the spouse / legal heirs of the deceased
employees. Likewise the Pensioner / Family Pensioner who expired on or after
1—1—2006, the arrears of Pension / Family Pension if any due to them shall also
be paid in one lumpsum to the spouse / legal heirs of the deceased pensioner /
family pensioner after adjusting the interim arrears already paid to them. In case of
employees / pensioners / family pensioners who expires after receiving the first
instalment of arrears, in such cases also the entire balance amount due to the
deceased employees / pensioners / family pensioners shall be paid to the spouse /
legal heirs of the deceased employees / pensioners / family pensioners in one
lumpsum.

5) I am also to request all the Head of Departments / Head of Offices /


Pension Pay Officer / Treasury Officers and Sub-Treasury Officers concerned as the
case may be to follow the above instructions scrupulously in disbursing the claims
preferred by the spouse / legal heirs of the deceased employees / pensioners /
family pensioners.
