V/S-Carmona was pushed and slapped on the left side of his face by V/S-Guzman. V/S-Carmona refused medical attention.
Weapon: V/S-Guzman used her hands to push V/S-Carmona. She also used her right hand to slap V/S-Carmona on the face. Background: V/S-Guzman and V/S-Carmona were involved in a dating relationship in the past and they previously lived together at V/S-Guzman's residence. There have been previous incident of domestic violence in the past, some reported and some not reported. V/S-Guzman was arrested on 12-16-11 (DR# 11-8827) for domestic battery, however V/S-Carmano later refused prosecution and wrote a letter stating so to Detective Sgt. Flores. On 0816-12, V/S-Guzman saw V/S-Carmano kneeling down next to her vehicle which was parked in her driveway. The next morning, V/S-Guzman saw that all four of her tires had been flattened (DR# 12-8161). As a result of this incident, V/S-Guzman obtained a temporary domestic violence restraining order (Court case # BQ038006, see attached) against V/S-Carmona. Alcohol and drugs were not involved today, no other weapons were used.
Summary: On the above date and time, Officer Contreras and I were dispatched to 820 S. 5 th street regarding a restraining order violation. Dispatch further advised that V/S-Guzman has a valid restraining order against V/S-Carmona and that he slashed the tires to her vehicle today and left the location. Upon arrival, Officer Contreras conducted an area check for V/S-Carmona but was unsuccessful in locating him Upon arrival, I contacted V/S-Guzman in her residence at which time her cellular telephone rang. The telephone number displayed was 323-849-5043. V/S-Guzman said that that was V/S-Carmona's cell phone number and it was he that was calling. I instructed V/S-Guzman to answer the telephone. She answered the phone and put it on speaker so that I could hear. When she answered, I heard a male voice say, "Now what are

It was at that time I spoke to the male and identified myself as the police. I asked V/S-Carmona to come to the residence so that I could speak to him about the incident. V/S-Carmona then said, "She pushed me." Once again I asked V/S-Carmona to come back to the residence to speak to me. V/S-Carmona agreed and minutes later arrived in his vehicle. Officer Contreras and I contacted V/S-Carmona at which time he said, If I'm going to jail, so is she." He then said, "Look at my face, she slapped me." I looked at the left side of V/S-Carmona's face and saw that the entire left side was in fact red as if he was hit. I asked V/S-Carmona what happened and he said that V/S-Guzman slapped him on the face and then pushed him out of the house. V/S-Guzman then slammed the door and he got into his vehicle and drove away. I asked V/S-Carmona what he was doing at the residence since there was a restraining order against him. He related that V/S-Guzman picked him up last night and that he spent the night with V/S-Guzman at her residence. Based on the phone call I witnessed along with the fact that V/S-Carmona arrived at the residence within minutes at my request, it was my opinion that the caller I spoke to on the phone was in fact V/S-Carmona. As a result, V/S-Carmona was placed under arrest for violation of the domestic violence restraining order in my presence. Officer Contreras transported V/S-Carmona to the Montebello jail for booking. V/S-Carmona's vehicle was stored incident to arrest (see CHP180 same DR# for further). Once at the Montebello jail, Officer Contreras took photos of V/S-Carmona's injuries. V/S-Carmona requested a restraining order. V/S-Carmona was granted an Emergency Protective Order. V/S-Guzman was later served at the Montebello jail by Detective Antista. I examined V/S-Carmona's cell phone and saw that there were 20 phone calls made to V/S-Guzman today. I then spoke with V/S-Guzman who related the following. She said she received a phone call from V/SCarmona who told her that he wanted to come over and pick up his clothes. She told him that she would leave his clothes on the back porch for him. She did however remind him that if he came to her residence, that he would be violating the restraining order. V/S-Guzman said that at approximately 1330hrs, there was a knock at her front door. When she opened it she saw that it was V/S-Carmona. She said they began to argue and V/SGuzman became fearful of V/S-Carmona and asked him to leave. They continued to argue and moments later, she pushed V/S-Carmona so she could close the door and lock it. She then called the police. She further related that V/S-Carmona threw his clothes onto the roof and then left in an unknown location. V/S-Guzman is desirous of prosecution for violation of the restraining order. I asked S-Guzman if she slapped V/S-Carmona and she said, "No way, I only pushed him in order to close the front door." I did observe that there were clothes on the front portion of V/S-Guzman's roof. V/S-Guzman went on to say that she is scared of V/S-Carmona and that she has spoken to him on the phone in the past and has sent and received text messages to and from him as well. V/S-Guzman handed me her cell phone to show me the text messages. I saw that there were text messages from as far back as 08-24-12 and as recent as 08-31-12. Most of the text messages appear to be friendly conversation. There are a few messages from V/S-Carmona where he appears to be upset with V/S-Guzman. Refer to the photos of the text messages for details. V/S-Guzman said that V/S-Carmona has violated the restraining order in the past by showing up to her house, neighbors have seen V/S-Carmona's car drive by and have called her to repot this, but V/S-Guzman did not report these incidents.

Based on the visible injury to V/S-Carmona, V/S-Guzman was placed under arrest for 273.5PC and transported to the jail for booking. Detective Antista was advised of the incident and responded to conduct his investigation. Refer to his report for further. Both cell phones from V/S-Gimnan and V/S-Carmona were later booked into evidence. Property receipts were issued for both.

It is enforceable by any law enforcement agency that has received the order, is shown a copy of he order, or has verified its existence on the California Law Enforcement Telecommunications System (CLETS).
