B. DEFINITIONS OF TERMS The terms, phrases and abbreviations shall be deemed to have the following meanings wherever used hereinafter and in all Contract Documents. Approved shall mean approved by the Project Manager at his absolute discretion Directed shall mean directed by the Project Manager at his absolute discretion. Selected shall mean selected by the Project Manager at his absolute discretion. m3 shall mean cubic metre. m2 shall mean square metre. m shall mean linear metre. mm shall mean linear millimeter. Kg shall mean Kilogramme. No shall mean Number. Prs shall mean Pairs. B.S. shall mean the current British Standard Specification published by the British Standards Institution, 2 Park, Street, London, W.I., England. AAMA. shall mean the current Standard Specification published by the American Architectural Manufacturer's Association. FGMA. shall mean the current Standard Specification published by the Flat glass Marketer's Association of the United States of America. ASTM. shall mean the current Standard Specification published by ASTM International. As described shall mean as described in the Description of Materials and Workmanship contained in the appendices to these Bills of Quantities. Ditto shall mean the whole of the preceding description except as qualified in the description in which it occurs. Where it occurs in descriptions of succeeding items it shall mean the same as in the first description of the series in which it occurs except as qualified in the description concerned. Where it occurs in brackets it shall mean the whole of the preceding description, which is contained within the appropriate brackets. Where it occurs in descriptions of succeeding items it shall mean the same as in the first description of the series in which it occurs except as qualified in the description concerned. Where it occurs in brackets it shall mean the whole of the preceding description, which is contained within the appropriate brackets. Fix only shall mean take delivery in Kampala (unless otherwise stated), pay all demurrage and transport charges, load and transport to site where necessary, unload, store, unpack, check contents against orders and packing lists, assemble as necessary, distribute to position, hoist and fix only. "PCC " Shall mean "Particular Conditions of Contract" of the General Conditions of Contract "Clerk of Works" shall mean a person engaged by the Employer and stationed on site to ensure that works are generally executed to the required specified standards and monitors the works on a day to day basis."Site Engineer" shall mean a person engaged by the Employer and stationed on site to ensure that structural and civil works are executed to the required specified standards and monitors the works on a day to day basis. C. GROUPED SIZES. Girths, depths or sizes grouped together in the Bills of Quantities item descriptions by means of hyphenated upper and lower limits shall be interpreted as exceeding the lower limit and not exceeding the upper limit. D. DESCRIPTION OF THE SITE The site of the proposed works is located on Plot 8-10 on Lourdel Road, Kampala in the Republic of Uganda. The site is situated on the slopes of Nakasero Hill, north of the business district of the city. The site is bounded by Yusuf Lule Road and Lourdel Road. The size of the plot is approximately 1.348 hectares with a gentle slope (level difference of 10m) between the southwest and north eastern ends. The site is presently overgrown with grass and bush. Several big trees are on the site, some of which shall be removed and others preserved. There exist eight dilapidated houses on site, which will have to be demolished to pave way for construction. Sewere lines, storm drains, water mains, power lines, telephone and optical fiber utilities exist along Yusuf Lule and Lourdel Roads. The site is surrounded by existing office buildings that are currently in use. The Contractor shall ensure that noise or any other nuisance to these neighbouring properties is avoided or minimised at all times. This information is issued without warranty and the Contractor must visit the site and will be deemed to have satisfied himself with regard to the conditions of the site, the nature of and conditions under which the works will have to be carried out and materials and goods delivered to the site, the supply of and conditions affecting labour, means of vehicular and pedestrian access and circulation, security requirements, hoarding and phasing requirements and the facilities for storage and obtaining the articles or materials referred to in these Bills of Quantities.

No claim by the Contractor for additional payment will be allowed on the ground of any misunderstanding or misapprehension in respect of any such matter or otherwise. Any damage caused to existing accesses, buildings, property and roads must be made good as directed by and to the approval of the Project Manager. E. DESCRIPTION OF THE WORKS. The works within this contract comprise construction of the following:The Works consist of construction to completion of the following: 1. Administration Wing The Administration Wing comprises four floor levels, that is, Lower Ground Floor, Ground Floor, First Floor and Second Floor. Construction is generally of reinforced concrete frame with concrete block walling, steel roof structure, galvanized roof covering, aluminium framed glazed windows, timber, steel and aluminium doors, terrazzo, granito and ceramic wall and floor finishes, mild steel balustrading, joinery and fittings. Under this phase of construction, construction of this wing shall be restricted to the Lower Ground Floor only. Electrical and mechanical installations comprise small power and lighting, installations, voltage regulation, uninterruptible power supply, lifts, structured cabling, surveillance, fire detection, fire fighting, mechanical ventilation, plumbing and drainage installations. 2. Records Wing The Records Wing building comprises five floor levels, that is, Basement, Lower Ground Floor, Ground Floor, and First Floor. Construction is generally of reinforced concrete frame with concrete block walling, steel roof structure, galvanized roof covering, aluminium framed glazed windows, timber, steel and aluminium doors, security doors, terrazzo, granito and ceramic wall and floor finishes, mild steel balustrading, joinery and fittings. Electrical and mechanical installations comprise small power and lighting, installations, voltage regulation, uninterruptible power supply, lifts, structured cabling, surveillance, fire detection, fire fighting, mechanical ventilation, plumbing and drainage installations. 3. Electrical and mechanical installations are to be executed by domestic sub contractors that shall be approved by the Project Manager. This information is given for guidance purposes only and is without warranty. F. VALUATION OF LUMP SUM PRELIMINARY COSTS Lump sums entered in these Bills of Quantities against any item of General Conditions, Preliminaries or any other lump sums will be included in appropriate valuations based on breakdown of lump sums into costs of establishment, maintenance and removal. G. MATERIALS ON SITE All materials and workmanship used in the execution of the works shall be of the best quality and description unless otherwise described. The contractor shall order all imported materials in good time and shall also order materials to be obtained from local sources as early as necessary to ensure that they are all on site when required for use in the works. The Bills of Quantities shall not be used for the purpose of ordering materials. H. PAYMENT FOR MATERIALS ON SITE All materials for incorporation in the works must be stored on or adjacent to the site before payment is effected, unless specifically exempted by the Project Manager. This is to include the materials of the contractor, Nominated Sub-contractors, and Nominated Suppliers. Payment for materials stored off site will only be permitted if the Project Manager is satisfied as to the condition of the store, its security, insurance of materials stored therein and the identification and legal ownership of the materials. I. AGREEMENT AND CONDITIONS OF CONTRACT These works shall be based on the Standard Bidding Documents, Procurement of Small Works, published by the the World Bank, Washington D.C., November 2010 edition together with any other amendments and clarifications published thereafter. Any reference to Clauses will be deemed to mean clauses of the above document. The contractor is advised to acquaint himself with the provisions of these clauses.

J. SUFFICIENCY OF TENDER The contractor shall be deemed to have satisfied himself before tendering as to the correctness and sufficiency of his tender for the works and of the rates and prices stated in the priced bills of quantities, which rates and prices shall cover all his obligations under the contract and all matters and things necessary for the proper completion and maintenance of the works. K. STANDARD METHOD OF MEASUREMENT These bills of quantities have been prepared in accordanace with th Standard Method of Measurement for Building Works, Second Edition (Metric) (Third Reprint), February 1996 Edition, published by the Architectural Association of Kenya. L .DISCREPANCIES IN DESCRIPTIONS Drawings and Technical Specifications shall take precedence over descriptions contained in Bills of Quantities in the event of discrepancies, unless the Project Manager shall otherwise direct. M. MATERIALS ARISING FROM EXCAVATIONS AND DEMOLITIONS Materials of any kind obtained from the excavations and demolitions shall be the property of the client. Unless the Project Manager directs otherwise such materials shall be dealt with as provided in the contract. Such materials shall only be used in the works, in substitution of materials which the contractor would otherwise have had to supply with the written permission of the Project Manager. Should the permission be given, the contractor shall make due allowance for the value of the materials so used at a price to be agreed. N. ALTERATIONS TO BILLS OF PRICING, ETC Any unauthorized alterations or qualifications made to the text of the bidding documents may cause the bid to be disqualified and will in any case be ignored. The contractor shall be deemed to have made allowance in his prices generally to cover any items against which no price has been inserted in the priced bidding documents. All items of measured work shall be priced in detail and bids containing Lump Sums to cover trades or groups of work must be broken down to show the price of each item before they will be accepted. Lump Sums to cover any items of preliminaries shall be likewise broken if so required.

O. PROVISIONAL WORK The work described as "Provisional" in these Bidding documents is subject to remeasurment in order to ascertain the actual quantity executed for which payment will be made. All "Provisional" and other work liable to adjustment under this contract shall be left uncovered for a reasonable time to allow all measurements needed for such adjustment to be taken by the Project Manager. Immediately the work is ready for measuring, the contractor shall give notice to the Project Manager. P. TRADE NAMES Where trade names or manufacturers catalogue numbers are mentioned in these Bills of Quantities, the reference is intended as a guide to the type of article or quality of materials required. The Contractor may use any article or material equal in type or quality to those herein described subject to the prior approval of the Project Manager and at his absolute discretion. The onus of proof as to equivalent quality will rest with the Contractor, whose tender will be deemed to include for the makes described herein.

The Contractor shall cooperate and share the Site with other contractors, public authorities, utilities, and the Employer between the dates given in the Schedule of Other Contractors, as referred to in the Particular Conditions of Contract. The Contractor shall also provide facilities and services for them as described in the Schedule. B ENVIRONMENTAL MANAGEMENT The contractor shall be required to ensure that damage to the environment is avoided or minimized and mitigation measures as prescribed by the National Environment Act (Cap 153 of the Laws of Uganda), National Environment (Noise Standards and Control Regulations),2003, and National Environmental and Management Authority (NEMA) and the Environmental Impact Assessment Statement from time to time are adhered to. C POLICE REGULATION The Contractor shall allow for complying with any relevant police or local authority regulations. D PROGRAMME AND PROGRESS The Contractor shall furnish to the Project Manager, within a period of time specified in Section VIII: Particular Conditions of Contract, for approval and display in the site offices, a Programme and Progress Chart devised in such a way that the lined programme is shown and progress can be marked up as the work proceeds. The Contractor shall keep this chart up to date at all times. This chart shall be generated and up-dated by an approved computer programme such as Microsoft Project or Primavera. Approval by the Project Manager of the programme shall not relieve the Contractor of any of his obligations under the Contract. The Contractor shall not without the Project Manager consent make any material alteration to the approved programme. The Contractor shall submit to the Project Manager for approval an updated Program at intervals no longer than the period stated in the Particular Conditions of Contract (PCC). If the Contractor does not submit an updated Program within this period, the Project Manager may withhold the amount stated in the PCC from the next payment certificate and continue to withhold this amount until the next payment after the date on which the overdue Program has been submitted. The Contractor shall thereafter revise the programme to show the modifications necessary to ensure completion of the works by the Intended Completion Date The Project Manager shall notify the Contractor if the Project Manager decides that the rate of progress of the works or any section, is too slow to meet theIntended Completion Date and that is not due to a circumstance for which the Contractor is entitled to an extension of time under the Contract. Following receipt of such a notice the Contractor shall take such steps as may be necessary, and as the Project Manager may approve, to remedy or mitigate the likely delay, including revision of the programme. The Contractor shall not be entitled to any additional payment for taking such steps. The contractor, upon receipt of instructions on possession of the other sections, in the event that only section I had been taken possession of, revise the programme to incorporate the section or sections taken possession of.

PROGRESS AND RECORD PHOTOGRAPHS The contractor shall provide a digital camera on site for use by the Clerk of Works in taking progress and record photographs every fortnight, throughout the duration of the contract. The contractor shall also allow for downloading of the digital photographs to CD-ROM including provision of the discs and CD - writing facility. The copyright of the digital photographs shall be and remain the copyright of the Employer and shall not be used for any purpose except with the express permission of the Employer.

The Project Manager may, if in his opinion it is necessary or desirable, order in writing that any additional or substituted work shall be executed on a Daywork basis. The Contractor shall then be paid for such work in accordance with Daywork rates and percentage additions as inserted hereafter in these Bills of Quantities. The Contractor shall furnish to the Project Manager all receipts or vouchers as may be necessary to prove the amounts paid and before ordering materials shall submit to the Project Manager quotations for the same approval. In respect of all work executed on a Daywork basis the Contractor shall, during the continuance of such work, deliver each day to the Project Manager a list in duplicate of the names, occupation and time of all workmen employed on such work and a statement also in duplicate showing the description and quality of all materials and plant used thereon or therefore (other than plant which is included in the percentage addition on net amount of wages). One copy of each list and statement will, if correct or when agreed, be signed by the Project Manager and returned to the Contractor. At the end of each month the Contractor shall deliver to the Project Manager a priced statement of the labour, material and plant (except as aforesaid) used and the Contractor shall not be entitled to any payment unless such list and statements have been fully and punctually rendered. Provided always that, if the Project Manager shall consider that for any reason the sending of such list or statement by the Contractor in accordance with the foregoing provision was impracticable, he shall nevertheless be entitled to authorize payment for such work either as Daywork (on being satisfied as to the time employed and plant and materials used on such work) or at such value thereof as he shall consider fair and reasonable. B NO WORKMEN TO BE HOUSED ON SITE Laborers shall not be housed on site. The cost of transporting labour to and from site or elsewhere shall be deemed to be included in the tender. C APPROVED SUB-CONTRACTORS Where in these Bills of Quantities work is described to be executed by an approved Sub-Contractor, the firms appointed will be treated as Sub-Contractors employed by the Contractor and not as nominated Sub-Contractors. The unit prices for such work must, therefore, include not only the Sub-Contractors charges but also the Contractors overheads, profits and attendance.

Description APPROVAL OF PROJECT MANAGER FOR EMPLOYMENT OF SUB-CONTRACTORS The Contractor will be required to obtain approval of the Project Manager in writing before employing any of his own domestic (i.e. not nominated) Sub-Contractors for any portion of work. Subcontracting shall not alter the Contractors obligations.

EXISTING PROPERTY The Contractor shall take every precaution to avoid damage to all existing property including roads, cables, drains and other services and he will be held responsible for all damage arising from the execution of this Contract to the aforementioned and he shall make good all such damage where directed at his own expense to the satisfaction of the Project Manager.
WHITE ANTS AND TERMITES Allow for destroying any white ants and termites nests found in the vicinity of the buildings, destroying Queen Ants, depositing cyanide lumps in holes and tunnels and filling with hard-core and murram well rammed and sealed.
TESTING Allow for all expenses in connection with the testing of materials as specified hereunder including the supply and preparation of materials to be tested, the cost of materials and their packing and conveyance to the nearest approved testing laboratory, equipment, and other charges, etc. The following items of tests on new works will be measured according to the number of tests actually called for by the Project Manager but unsuccessful tests will not be included in the measurement. The Contractor shall allow for all other testing of new materials, apart from the above, required by the Appendices of the Bills of Quantities and he shall be responsible for all expenses incurred in completing such tests including costs of materials and labour, equipment, transport and charges of testing authority, etc. A FORM OF CONTRACT The contractor will be required to enter into a contract which will be based upon the Standard Bidding Documents, Procurement of Small Works, published by the the World Bank, Washington D.C., April 2008 edition except in so far as may be varied hereafter. The Contractor shall furnish at his own cost any samples of materials or workmanship for the works that may be called for by the Project Manager for his approval or rejection and any further samples in the case of rejection until such samples are approved by the Project Manager, and the Project Manager may reject any materials or workmanship not in his opinion up to the approved samples. The Project Manager shall arrange for testing of such materials as he may at his discretion deem desirable but the testing shall be made at the expense of the Project Manager and not at the expense of the Contractor unless the materials fail to pass the test or are in the opinion of the Project Manager not in accordance with the specification, in either case the Contractor shall pay for testing in accordance with the current scale of testing charges laid down by the relevant local authorities. The procedure for submitting samples of materials for testing and the method of marking for identification shall be as laid down by the Project Manager . B GOVERNMENT ACTS REGARDING WORKPEOPLE ETC Allow for complying with all Government Acts, Orders and Regulations in connection with the employment of labour and other matters related to the execution of the works and his bid must include for all costs arising or resulting from compliance with any act, Order or Regulation relating to insurances pensions and holidays for workpeople or to the safety health or welfare of workpeople. The Contractor must make himself fully acquainted with current Acts and Regulations ,including Police Regulations, regarding the movement, housing, security and control of labour, labour camps, passes for transport, etc. It is most important that the Contractor, before bidding shall obtain from the relevant Authority the fullest information regarding all such regulations and/or restrictions which may affect the organisation of the works, supply and control of labour etc., and allow accordingly in his bid. No claim in respect of want of knowledge in this connection will be entertained.

Description SAFETY AND PROTECTION OF WORKMEN The Contractor shall be responsible for the Occupational Health and Safety of the employees and any other visitors to the site. The Contractor shall allow for training all employess on issues of site safety and occupational health that should acquaint them with safety rules, regulations and practical aspects of safety. In addition to this, the Contractor shall be required to maintain on site at all times a safety manual. The Contractor shall ensure that all laws, rules or regulations relating to Occupational Health and Safety as stipulated by the Government from time to time are enforced at all times on site and he shall employ a safety professional that will be stationed on site at all times to ensure compliance. Such a safety professional shall must possess traing in first aid. The Contractor shall allow for providing protective equipment and gear such as overalls, gum boots, steel capped boots, safety harnesses, dust coats, dust masks, gloves and hard hats to his workmen to protect against injury and occupational illness at all times. He shall also ensure that all his equipment is at all times in good, safe working conditions to prevent accidents. The Contractor must also maintain on site at all times a well stocked first aid kit for emergency use and ensure that its contents are replenished from time to time with use. The Contractor shall maintain on site a log and summary of all recordable injuries and illnesses (resulting in a fatality, hospitalization, lost workdays, medical treatment, job transfer or termination, or loss of consciousness) for that location, and enter each recordable event no later than 6 working days after receiving the information. Where the complete log and summary records are maintained at a place other than the site, a copy of the log that reflects the injury and illnesses experience on the site must be completed and current to date within 45 calendar days and must be available at the original site. In addition to the log of occupational injuries and illnesses, each employer must have available for inspection on site within 6 working days after notification of a recordable case, a supplementary record for each occupational injury or illness for that site. An adequate supply of potable water must be provided on site. Portable drinking water containers must be capable of being tightly closed and equipped with a tap. Using a common drinking cup is prohibited. Where single service cups (to be used but once) are supplied, both a sanitary container for unused cups and a receptacle for used cups must be provided.

B VISIT SITE AND EXAMINE DRAWINGS The contractor is adviced to examine the drawings and visit the site the location of which is described in the Particular Conditions of Contract. No claim arising form his failure to comply with this recommendation will be considered. C SITE LEVELS Before commencing work the contractor must arrange for and agree with the Project Manager the existing site levels and similarly establish and agree a bench mark. The levels and bench mark thus agreed will then be used for the duration of the works for all purposes. The contractor should therefore make allowance for all costs incurred. D SETTING OUT The Contractor shall set out the works in accordance with the dimensions and levels shown on the drawings and shall be responsible for the correctness of all dimensions and levels so set out by him and will be required to amend all errors arising from inaccurate setting out at his own cost and expense. In the event of any error or discrepancy in the dimensions or levels marked on the drawings being discovered, such errors or discrepancies must be reported by the Contractor to the Project Manager for his immediate attention. Before any work is commenced by sub-contractors or specialist firms, dimensions must be checked on the site and agreed with the Contractor irrespective of the comparable dimensions shown on the drawings. The Contractor shall be responsible for the accuracy of such dimensions.

Prior to the commencement of any work the contractor is to ascertain from the relevant authority the exact position, depth and level of all existing services in the area and he/she shall make whatever provisions that may be required by the authorities concerned for the support, maintenance and protection of such services. B SITE OFFICES The contractor shall erect and maintain site offices to the approval of the Project Manager. The site office shall accomodate the Contractor's site management staff, Site Engineer, Clerk of Works and shall have adequate space for storage of drawings and bills of quantities. The site office shall also have a meeting room of enough capacity to accomodate a minimum of fifty persons. The same shall be removed at completion and all surfaces disturbed made good. The contractor shall allow for providing furniture for proper storage of drawings,bills of quantities, other records, chairs and meeting desk to accommodate all project team members during meetings. The Contractor shall also allow for making available a water closet and wash basin for the sole use of the Project Manager and other Consultants, and for paying all costs in connection therewith. The contractor shall also allow for providing the services of a messenger, for keeping both office and closet in a clean sanitary condition from the commencement to the completion of the works, and or dismantling at completion and making good all disturbed surfaces. The office shall be completed before the contractor will be permitted to commence the works. C SHEDS FOR STORAGE OF MATERIALS The Contractor shall provide, erect and maintain on the site, in such positions as may be directed, ample temporary watertight, lock-up sheds for the proper storage and protection of cement and other materials liable to damage and shall remove same at completion and make good all surfaces disturbed. He shall also provide space for storage accommodation which Sub-Contractors may wish to erect for themselves.

The Contractor must allow for providing, erecting and maintaining one site signboard located along Lourdel road and adjacent to to the site gate, the size, type of construction and lettering of which shall be to the Project Manager's design. The names of the Consultants are to be in lettering 50mm high. The Contractor shall also allow for any fees payable to the Local Authority in relation to the signboard. The board is to be fixed in an elevated position on the site (s) where indicated by the Project Manager. On completion of the works, the notice board shall be removed and making good shall be carried out as necessary. B SANITATION OF THE WORKS The sanitation of the works shall be arranged and maintained by the Contractor to the satisfaction of the Government and/or Local Authorities, Labour Department and the Project Manager. The contractor shall allow for, erecting and maintaining where directed a lock-up hut containing a pedestal type water closet and wash basin for the sole use of the Employer's Representatives, Project Manager and other consultants, including providing equipment, making temporary connections to drains and water supplies and paying all charges for connections, conservancy and bills arising from the use of the services. The shed and water closet shall be completed before the contractor will be permitted to commence the works. The Contractor shall also allow for providing the necessary temporary toilets for the labour employed on the works, including labour employed by Sub-Contractors and other Contractors employed by the Employer, to the satisfaction of the Health and Medical Authorities and for maintaining the same in a thoroughly clean and sanitary condition and paying all charges. Pit latrines shall not be allowed. The Contractor shall allow for removing the said facilities and leaving the ground clean and free form pollution upon completion to the satisfaction of the Health and Medical Authorities.

Description SUPERVISION DURING THE WORKING HOURS The works shall be executed under the direction and to the entire satisfaction in all respects of the Project Manager who shall at all times during normal working hours have access to the works and to the yards and workshops of the contractor and other subcontractors or other places where work is being prepared for the contract. The working hours shall be those generally worked by good employers in the building and civil engineering trades in Uganda. No work shall be carried out at night or on gazetted holidays unless the Project Manager shall so direct. No work shall be carried out in the absence of the Clerk of Works or Site Engineer without the prior approval of the Project Manager in writing.

HOARDING The contractor shall enclose the whole area of the site or part of the works under construction as directed by the Project Manager, with a hoarding 2400mm high consisting of iron sheets (minimum Gauge 28) on 100 x 50mm timber posts firmly secured at 1800mm centres with two 75 x 50mm timber rails. The hoarding shall have a gate to allow for pedestrian and heavy commercial vehicle and mobile plant accee to the site. The hoarding shall also have a window to enable site security personel to scrutinise visitors to the site. The contractor is in addition required to take all precautions necessary for the safe custody of the works, materials, plant, public and Employer's property on site. The contractor should also allow for any local authority costs associated with hoarding. The Contractor shall also allow for thoroughly maintaining the same throughout the Contract and clearing away and making good disturbed surfaces on completion. All materials arising shall remain the property of the Contractor and he should allow credit against this accordingly. The hoarding shall not be used for advertising.
FOREMAN IN CHARGE The Contractor shall keep constantly on site a General Foreman in charge of the Project who shall be experienced and fluent in English. He shall also keep other trades foremen as specified in Volume I (Section III, part 2.5) of these Bidding Documents who shall properly qualified and experienced in their trades all to the approval of the Project Manager.

Expenses in connection with Nominated Sub-Contractors should be allowed for in the attendance items under the relevant P.C. Sums. The Contractor shall also allow for thoroughly maintaining the same throughout the Contract and clearing away temporary installations and making good disturbed surfaces on completion. C CROSSINGS AND TEMPORARY ROADS The Contractor must allow for providing, forming and maintaining necessary crossings on to the site and temporary roads as may be required by the Project Manager and removing same at completion and making good damaged or disturbed surfaces as directed by and to the approval of the Project Manager.

The Contractor shall arrange for a telephone to be installed in the site office. The Contractor shall pay all charges for hire or purchase of equipment, licenses, connecting, rental and calls made. Cell phone services could also be provided for use on site and the contractor should be responsible for all expenses involved as in the case of normal land line. B WORK TO BE OPENED UP AT THE REQUEST OF THE PROJECT MANAGER The Contractor shall, at the request of the Project Manager within such time as the Project Manager shall name, open for inspection any work covered up, and should the Contractor refuse or neglect to comply with such request, the Project Manager may employ workmen other than those employed by the Contractor to open up the same. If the said work has been covered up in contravention of the Project Manager's instructions, or if, on being opened up, it be found not in accordance with the drawings, specifications or Bills of Quantities or the instructions of the Project Manager, the expenses of opening and covering it up again whether done by the Contractor or by the Project Manager, shall be borne by and be recoverable from the Contractor or may be deducted from any monies due to the Contractor. If the work has not been covered up in contravention of such instructions and be found in accordance with the said drawings and Bills of Quantities, then the expenses aforesaid shall be borne by the Employer, and be added to the Contract Sum; provided always that, in the case of foundations or of any other urgent work so opened up and requiring immediate attention, the Project Manager shall within a reasonable time after the work has been opened, make or cause to be made the inspection thereof, and at the expiration of such time, if such inspection shall not have been made the Contractor may cover up the same and shall not be required to open it up again for inspection except at the expense of the Employer. C SCAFFOLDING The Contractor shall allow for providing, erecting and dismantling all general scaffolding required for the works. The Contractor must allow here or in his rates for providing all special scaffolding required by his Sub-Contractors, other than Nominated Sub-Contractors, or other contractors engaged directly by the Employer, carrying out works for which P.C. Sums are required in these Bills. Where the Contractor is required to provide special scaffolding for these latter Sub-Contractors, an item is included for pricing under the relevant P.C. Sum.

The Contractor shall allow for the protection of his own and his Sub-Contractors work liable to damage including provision of temporary roofs, gutters, drains, etc., if necessary and shall case-up, cover or in other suitable ways protect all finished work liable to damage, to the satisfaction of the Project Manager until completion of the Contract. From the beginning to the completion of the works, the same shall be under the entire care and control of the Contractor, who shall take all precautions required by the Project Manager to prevent any nuisance, inconvenience or injury to the holders or occupiers of surrounding properties and to the public generally, and shall at all times keep all paths and roads affected by the works in a safe and clear state, and shall use proper precautions to ensure the safety of all wheeled traffic and pedestrians. The Contractor shall allow for providing all watching, lighting, barriers, covering open trenches and protection of the works, including Sub-Contract works, as may be necessary for the safety of the works and for the protection of the public and his own Sub-Contractors employees. In event of any damage or loss occurring to the works, or to materials or any sewers, gullies, drains, paths, or other works on the site in temporary possession of the Contractor for the purpose of this Contract, either from the weather, want of proper protection, defects, theft, insufficiency of the works, or any other cause whatsoever during the progress of the works, or for any accident or damage to property or persons by the reason of the said works, the Contractor alone shall be responsible and shall without extra charge, make good all damage and pay all costs incurred. B REMOVAL OF PLANT, RUBBISH ETC. The Contractor must allow for removing and clearing away all plant, rubbish and unused materials, and leaving the whole of the site of the works in a clean and tidy state at completion to the satisfaction of the Project Manager. He must also allow for removing all rubbish and dirt from the site as it accumulates during the performance of the Contract in accordance to provisions of the Kampala City Council (solid Waste Management ) Ordinance, 2000.

Description REMOVAL OF EXCAVATED MATERIALS The Contractor must allow for in his rates any restrictions imposed by the Government of Uganda, its agencies or local authorities. Such restrictions may relate to time of ferrying excavated material from site and restrictions on the location of dump sites. It shall be assumed that the contractor has acquainted himself to any such restriction and has identified suitable dumping sites approved by the Government of Uganda, its agencies or local authorities and rates for loading and carting away of such materials are deemed to include any resultant costs. It is the sole responsibility and risk of the Contractor to identify such suitable dumping site(s) and no claims shall be entertained whatsoever for his failure to do so.
