On 061712, I made contact with MICHAEL S. MAHER, DOB: 092481 in reference to possibly impersonating a
firefighter and being inside the secured fire line for the High Park Fire. MAHER admitted to having government
plates on his personal truck that he "got from a friend", possessing two USDA radios that he did not return after
being fired two years ago, a PFA sweatshirt, a case of MRE's, and several cases of water and Gatorade that he
stole from one of the fire station campsites, while he posed as a firefighter. MAHER was also in possession of
questionable firefighter credentials and two passport type photos of himself. MAHER was arrested for
Impersonating a Public Servant, Obstruction of a Fireman, Theft between $1,000 and $20,000, and Attempt to
Influence a Public Servant. Photos taken and evidence collected and a gun found in the truck was placed in
property for safekeeping and awaiting the results of MAHER'S criminal history.

On 061612 at approximately 2200 hours, I was working a shift as roving security at the High Park wildfire. I was
advised over our law group dispatch, that was dispatching the fire, that there had been a suspicious vehicle in the
area that was possibly impersonating a firefighter. The information received from the law group dispatch was that
we were looking for a newer model silver Toyota Tacoma bearing government plates A354026. They stated the
white male driver had been last seen leaving the fire area at Larimer County intersection of County Road 52E and
County Road 27E approximately 20 minutes earlier. He had been behaving suspiciously and at some point had
possibly shown fake firefighter credentials. He had also showed identification with the name MICHAEL MAHER.
Sighting of Vehicle
On 061712 at approximately 0200 while working the same fire security shift, we were advised over the law group
dispatch channel that someone had seen the vehicle in question parked near the intersection of Overland and
County Road 54G in Laporte.
Contact with MICHAEL MAHER
Upon arrival at the scene, near the intersection of County Road 54G and Overland Trail, I observed Corporal
BADBERG speaking with a white male described wearing a blue firefighter's type shirt, green Nomex pants,
firefighter boots and holding a Poudre Fire Authority sweatshirt in his hand. Corporal BADBERG was already
holding identifications in his possession identifying the male as MICHAEL MAHER. I listened in on the
conversation between the two as a cover officer for Corporal BADBERG. Please see Corporal BADBERG's
supplement for further investigative and interview information.
During this initial interview, MAHER stated that he was an independent firefighter looking for a fire company to
work with and had been in the fire scene for approximately the last two days.
Contact with MAHER's Truck
We were interviewing MICHAEL MAHER in the northwest corner of County Road 54G and Overland Trail and his
vehicle was parked directly south across the street in the Overland Foods parking lot, next to a large trash
dumpster. Corporal BADBERG asked if we could walk across the street to his vehicle at which point MAHER
stated we could. We all walked across the street towards his silver Toyota Tacoma.
While walking across the street, there was a return on MAHER's clear and list that was requested by Corporal
BADBERG which confirmed that MAHER was a registered sex offender and was on probation. I asked MAHER
what he was on probation for and he stated it was for a DWAI (Driving While Ability Impaired) out of Grand
County.
I then asked him where he was registered as a sex offender and he stated Denver County, he thought.

I then asked MAHER about the government plates on his vehicle. He initially stated nothing and just hung his
head and began shaking his head. All three of us stood silent for several seconds when Corporal BADBERG
asked if MAHER was going to answer about the plates. MAHER stated that he could answer us about the plates
and it would make sense but then that would incriminate him and he was afraid this was a DHS (Department of
Homeland Security) issue.
MAHER continued to state he could explain to us exactly what was going on but he knew this was going
incriminate himself. MAHER became visibly upset as his breathing became much more rapid and he was no
longer making eye contact. MAHER eventually stated that he was an employee for the USDA and had been fired
two years earlier but he had received the license plates from "a friend".
Stolen Items
In plain view in the rear of the vehicle, there were several cases of water, a case of Gatorade, a box of water and
a case of MREs. I asked MAHER where those items came from. He stated that he was given those at one of the
fire sub-stations possibly Rist Canyon Fire Station 1.
I then clarified if MAHER had been up working the fire. He stated that he had attempted to find a crew to work
with but he had not worked the fire and he had only been inside the fire scene. I then explained that the food,
water and Gatorade were for firefighters and emergency service personnel working the fire and he stated he
understood and that he knew it was wrong.
USDA Radios
Inside the truck were four firefighter or police type radios, two containing handwritten identification and stickers
from the USDA. MAHER admitted that the two larger firefighter radios did belong to the USDA and he did not
return them after he was terminated. MAHER continued by stating that the other two radios were his but when
asked where he had acquired them his only answer was "if you turn one of them one you can tell it doesn't work".
The question of where those two radios came from or how he acquired them was never answered. All four radios
were collected and placed into property as evidence.
Arrest of MAHER
I then placed MAHER in handcuffs. I double locked the cuffs and checked them for fit. I then patted MAHER
down again, as Corporal BADBERG had patted him down prior to my arrival. I then read MAHER his Miranda
Rights immediately upon putting on the cuffs. MAHER stated he understood his Miranda Rights and we continued
speaking with him.
Gun in Truck
While I was continuing my interview with MAHER, Deputy GARLAND had arrived and was beginning a vehicle
inventory incident to arrest. MAHER stated that he had a gun in the arm rest of the truck. GARLAND found the
weapon and did a clear and list on the gun and it came back clear. See his supplement for further information on

There were numerous other firefighter type items located within the bed of the truck and inside the cab of the
truck. All serial numbers were run and nothing returned as stolen. After giving MAHER his Miranda Rights, he stated that all the other items in the truck he had acquired himself and
the only stolen items were the food and beverage, the government plates on the vehicle and the two USDA
radios.
I then asked him about the sweatshirt that he was holding. He stated that he had found that at one of the fire

scenes. I then took the Poudre Fire Authority sweatshirt from him and it was placed into property as stolen
evidence.
Evidence Disposition
Deputy WEBER arrived and took photographs of the stolen food and water and returned them to the Incident
Command Post. Please see his supplement for further property value information. Any items that MAHER stated
were his were left in his vehicle. His vehicle was towed by Schmer's Towing.
Request for a Written Statement by BOB GANN
During the interview, MAHER stated that he had spoken with the Fire Chief from Rist Canyon Fire Station 1 but
did not recall the man's name. From reading the Voluntarily Written Statements from the National Guard units, it
appears as if this individual is BOB GANN and he is the person who identified MAHER initially as being
suspicious. I have put a phone call into GANN requesting a Voluntarily Written Statement but due to him being on
the fire, I have yet to receive a return phone call.
Case Status
MAHER is charged with Impersonating a Public Servant 18-8-113. MAHER admitted to impersonating a
firefighter in an attempt to join one of the fire crews within the fire scene. He also used this identification to make
entry into the fire along with the stolen government plates and the self applied number on his Toyota Tacoma.
The next charge is Obstruction of a Fireman 18-8-104. MAHER is charged with obstruction due to the fact of the
amount of hours and time taken away from the fire because of our investigation. We requested the assistance of
WAYNE ICHIYASU from the Night Operation with the Incident Command Team. ICHIYASU also arrived on scene
and stated that the fire credentials were questionable at best and was also very concerned about the two
passport type photographs that were on the driver's seat. ICHIYASU stated his fear was that MAHER was
attempting to find another firefighter's ID to place his photograph on. Those other two passport photographs were
also taken into evidence.
The next charge is Theft 18-4-401(c). The value of the two radios, ICHIYASU stated were approximately $1,000
each. The value of the food is still in question but is approximately a government price of $50 and a retail price of
$180. The cases of water were valued at approximately $5 each and the Gatorade at $10. The combined value,
even with just the approximates for the food, place this at the Felony IV level of a value of $1,000 to $20,000.
The fourth charge of Attempting to Influence a Public Servant 18-8-306. MAHER is charged with this due to the
evidence of him using stolen plates and possibly false Fire identification to influence the National Guard roadblock
members and the Fire Chief of Rist Canyon in an attempt to gain entry into the fire and possibly work the fire.

I heard deputies were in contact with a man who possibly impersonating a firefighter. I responded to the area
Overland Road and County Road 54G. This male had several stolen items in his possession. I heard he admitted
to taking some water, Gatorade, a case of MRE's, and two sack meals from a food stash inside the fire lines.

I took evidence photographs of the truck, to include the government plates, the marking on the windshield, and
some of the contents in the truck. I also photographed the stolen food. All photographs were later downloaded
onto the server at Larimer County Sheriff's Office.
Cost of Food Items Taken
I transported the food back to the supply depot at the High Park Incident Command Post. I returned the items and
learned their cost. NATHAN SABO, who works for the United States Forest Service, informed me a case of water
cost $12.80 and a case of Gatorade cost $18.00. This is the cost for the government to purchase these items at
their discounted rate. I learned from another person at the command post that a lunch meal cost $18.00 and a
breakfast meal cost $13.00. A case of MRE's (Meals Ready to Eat) was $103.40. Again, this was what the
government pays for at the discounted price.
The total for all of the items I returned to the command post was:
2 cases of water ($25.60) + 2 cases of Gatorade ($36.00) + 2 meals: lunch and breakfast ($31.00) + case of
MRE's ($103.40) = $196.00.
Written Statements
Deputy JACOBS requested me to give statements to the checkpoint who saw this vehicle come out from the fire
area. I responded to checkpoint 5, located at County Road 52E and County Road 27E. They completed
statements, which were later picked up by Deputy JA COBS.
BRYAN WHYARD informed me he saw this male driving this truck two days ago, again driving past their
checkpoint coming out of the fire area. BRYAN stated he could identify this male if he saw him again. When this
male came through two days ago, he stopped and conversed with BRYAN. Tonight, when he came through, he
did so quickly and did not stop. When the fire chief came by twenty minutes later, the fire chief explained his
concerns to BRYAN. BRYAN then gave this information to incident command to be on the lookout for this male.
BRYAN stated some time later, the firefighters who the suspect was trying to get on their crew with came out of
the fire through their checkpoint. One of the firefighters quickly returned and told BRYAN that the suspect was
parked in the area of County Road 54G and Overland Trail. This information was relayed to incident command,
which was then relayed to the street.

Initial Information
On 061712 at approximately 0133 hours, I received information from the incident command post regarding the
High Park Fire, requesting my assistance in attempting to contact a vehicle. I was requested to attempt contact
on a vehicle described as a silver Toyota Tacoma pickup with government license plate A354026. The
information was that the vehicle had the numerics O183 on the windshield and that a wildland fire chief suspected
that the subject provided fraudulent fire credentials and had no business in the fire area. I was advised to try to
make contact with the vehicle in the Laporte area, possibly near one of the bars near the area of County Road
54G and Overland Trail. The information also provided that the credentials of the subject listed him as MICHAEL
MAHER.

At approximately 0133 hours, I responded to the area of North Overland Trail and West County Road 54G in
Laporte. As I was driving around, I observed a silver colored Toyota Tundra pickup parked in the parking lot of
Overland Foods Grocery Store which is 3333 West County Road 54G in Laporte. The vehicle was parked in the
northeast corner of the parking lot near a dumpster being partially blocked behind a large recreational vehicle that
is parked in the parking lot with a "for sale" sign posted. I pulled into the parking lot and observed that the vehicle
had a rear license plate which appeared to be a government license plate of A354026 attached.
As I came up behind the vehicle, there did not appear to be anyone inside. I stopped my marked vehicle just to
the west, slightly behind the silver Toyota Tacoma and walked up to the vehicle. I did not activate any red or blue
lighting on my patrol car. As I walked up to the truck, I noticed in the back bed area of the pickup, there was a
chainsaw, and several packages of bottled water. As I walked around the cab area of the pickup, there appeared
to be several radios, one of which was marked US Forest Service. They were handheld radios. There also
appeared to be large amounts of fire type clothing, as in jackets, maps, hardhats, and other items that might be
associated with a fire fighter in the cab of the pickup.
I walked around to the front of the vehicle and observed that there was also a government license plate of
A354026 attached to the front of the vehicle. I looked around the area as far as the other cars in the lot and did
not see anyone else around. I felt the front of the engine area of the vehicle. I did not feel any heat coming from
the radiator or the hood of the vehicle.
Information of Suspect Location
At approximately 0144 hours, I received information from Communications that the male, who had been in the
vehicle, was apparently at the bar across the street in a crowd of people, wearing dirty brown fire pants and a
black colored shirt. I walked back to my patrol car and around the RV that was parked in the area, and observed
approximately four to five people standing on the east side of the parking lot of the Long Branch Bar at 3310 West
County Road 54G in Laporte. I got back into my patrol car and drove across the street over to the Long Branch
and pulled into the parking lot where I observed a subject matching the description, standing in a crowd of
approximately three to four people.
I approached the group of people and asked the male subject, who was wearing the black shirt, if I could speak
with him to which he consented. I walked with the male to the south to get away from the crowd of people. I
identified myself as Corporal BADBERG with the Larimer County Sheriff's Office.
Information from Incident Command Post
I was advised over the radio by the incident command post that other deputies were en-route as well as an official
from the fire team and I was to stand by with the subject until they arrived.
Information from MICHAEL MAHER
I asked the male subject if the vehicle parked across the street in the Overland Foods parking lot was his, the
silver Toyota pickup. The male seemed nervous and scared, looking around but eventually indicated that the
vehicle did belong to him. I asked the male if he had any identification on him. The subject asked me what this
was regarding. I told the male that this was in reference to a vehicle matching his vehicle description with a
government plates, being in the fire scene area. The male provided me with a laminated card. On it indicated a
US Government motor vehicle operator's identification card. There was no card number listed next to it. The
name associated was MICHAEL S. MAHER, DOB: 092481. The name and location of this unit was White River
National Forest in Glenwood Springs, Colorado with a zip code of 81602. The date of issue is 102109, date of
expire is 102113. The male also provided a US Department of Agriculture Employee Identification card, number
A397909 with the name of MICHAEL S. MAHER. It indicated agency and duty station with USDA Forest Service
at White River National Forest. The subject also provided a Colorado driver's license identifying himself as
MICHAEL MAHER with a birth date of 092481.

As I was speaking with Mr. MAHER, I was asking him why he was in the fire scene area. Mr. MAHER seemed
very nervous and initially started talking about the people who worked for fire agencies were coming up here and
contracting, working privately making money in the area. I asked Mr. MAHER if he was working for a unit in the
area. Mr. MAHER then produced a Colorado State Patrol business card for an Agent GABRIEL VELASQUEZ for
the Governor's protection detail but Mr. MAHER never explained what that business card was for. I began asking
him again about why he was in the fire scene area. Mr. MAHER indicated to me that apparently he went up to a
fire station, but did not know the name of it. He drew the roads in the dirt which appeared to be Rist Canyon.
When I brought up Rist Canyon, he indicated that was the fire station he had gone to. Mr. MAHER indicated that
he went up to talk to the fire chief at that fire station about getting on to help with the fire. Mr. MAHER indicated
that when he went up to talk with the fire chief, he could not recall the fire chief's name, MAHER was initially
placed on the fire engine and sent out. Mr. MAHER indicated that shortly thereafter, they called the engine back
because he did not have an active red card.
I asked him approximately the time that he went to the fire station. He stated it was around 1600 hours to 1630
hours. I asked him approximately what time did he come back down to the Laporte area to which he stated it was
approximately 2040 to 2140 hours; he was unsure. As I was talking with him, Deputy JACOBS and Deputy
GARLAND arrived on-scene to assist. There was also another male, later identified as MICHAEL RIVERA, the
manager of the Long Branch, who seemed very concerned by us talking to the subject, Mr. MAHER. Mr. RIVERA
had to be asked by us to move away on several occasions.
As I was speaking with Mr. MAHER, I observed that he had a folding knife in his right front pocket which I
removed from his person for my safety. I also asked Mr. MAHER if I could pat him down for my safety to which he
consented. I did not find any other contraband on him. I asked Mr. MAHER where he was currently living at to
which he indicated he was residing at an address at 664 Washington Street in Denver. I asked Mr. MAHER how
long he had actually been at the fire to which he indicated approximately the past two days. Mr. MAHER indicated
that he had spent one night at the fire command post at the armory.
As I was speaking with Mr. MAHER, I noticed he was holding a blue colored Poudre Fire Authority sweatshirt; it's
a pull over sweatshirt. I asked him where he got the sweatshirt. He stated he found it over at the camp area. At
this point, I asked him if I could hold on to the sweatshirt to which he consented. I placed it on the hood of my
patrol car during our contact along with the knife. I asked him if he had any paperwork regarding his vehicle and
the governmental plates affixed to the truck to which he indicated that he did and they were inside of the truck.
I asked dispatch to clear MAHER to which they advised that he was clear, a registered sex offender, and on
probation.
At this point, Deputy JACOBS and Deputy GARLAND, and I walked across the street to the pickup with Mr.
MAHER. I allowed Mr. MAHER to get into the driver's side seat of the vehicle. He looked up into the sun visor
area and in a silver colored law enforcement type of posse box but he was unable to find any type of registration
for the vehicle. Mr. MAHER indicated that he wanted to continue to look in the center console area but I asked
him to stop and exit the vehicle and I would locate information on the VIN (Vehicle Identification Number). Mr.
MAHER was very hesitant to get out of the vehicle and had to be told multiple times to exit the vehicle to which he
finally did. I had him step to the back of the vehicle with Deputy JACOBS and Deputy GARLAND.
Information from Dispatch
I had Dispatch clear the license plate, government plate A354026 to which they advised that the plate was
coming back with no record. I then had Dispatch clear the VIN on the vehicle which was 5TFBV 54138X035676.
Dispatch advised me over the radio that the V came back listed to MICHAEL STILLMAN MAHER on a 2008
IN Toyota pickup, silver in color, to an address at 305 Tall Timber in Avon, Colorado. The plate associated with the
vehicle is 317DVO.
Additional Information from MICHAEL MAHER
I questioned Mr. MAHER further about where he had received the plates and if they belonged to the vehicle. Mr.
MAHER was silent again and I asked him if he was going to answer the question to which he stated he was. Mr.

MAHER made the statement in reference that it would make sense if he would explain it but was not sure if he
wanted to incriminate himself. Mr. MAHER then went on to say that his friend had given him the plates. Mr.
MAHER went on to say that this is a DHS matter which I believed he was indicating a Department of Homeland
Security rather than Department of Human Services issue.
As I was speaking with him, a fire official arrived who is with the night operations division for the incident team.
This official was identified as WAYNE ICHIYASU. Mr. ICHIYASU asked Mr. MAHER if there was anyone who
could vouch for him or if he had any orders putting him in this area. Mr. MAHER stated he did not. At this point,
Mr. ICHIYASU spoke with him further. As he was speaking with Mr. MAHER, Deputy WEBER arrived on-scene to
assist.
During the conversation and interviews, Mr. MAHER began looking very nervous. He was constantly eyeing
around and becoming very fidgety. Deputy JACOBS decided to detain him while we figured out what was going
on. While I was speaking with Mr. MAHER, I did detect the odor of an alcoholic beverage coming from his breath.

Contact with MICHAEL RIVERA
As we were talking and dealing with Mr. MAHER, the manager of the Long Branch, MICHAEL RIV ERA, walked
across the street so I went over to speak with him. Mr. RIVERA indicated that the subject, identified as MICHAEL
MAHER, came into his bar, the Long Branch, sometime between 0000 hours and 0100 hours. Mr. RIVERA
indicated that the subject indicated he was fire fighter out of Denver who had been working the fire for
approximately one week helping fight the fire. Mr. RIV ERA indicated that the subject indicated he was going
home in the early morning hours and Mr. RIVERA indicated he offered his place for Mr. MAHER to get a couple of
hours sleep before driving back to Denver. I asked Mr. RIVERA if the subject, Mr. MAHER, had been drinking at
all inside the bar. Mr. RIVERA indicated he could not recall because he was not serving or doing the bartending
duties. He did recall that Mr. MAHER was drinking a pop. Mr. RIVERA indicated that when he came into the bar,
the crowd cheered for him and applauded his work as a fire fighter.
Mr. RIVERA also indicated that he spoke with Mr. MAHER about the pants that Mr. MAHER was wearing and that
Mr. RIV ERA had asked Mr. MAHER about them being fire proof. Mr. MAHER indicated that could go ahead and
try to light them on fire. Mr. RIVERA indicated that the subject was also telling him about the long sleeved type of
material that he had been wearing and they had talked about wearing light material for them to be able to move
around quickly during the fire. Mr. RIVERA indicated that he was out in the parking lot and saw me looking
around at Mr. MAHER's truck parked across the street. I asked Mr. RIVERA if Mr. MAHER was acting nervous or
suspicious at all to which he stated not that he could recall.
I asked Mr. RIVERA if he would be willing to fill out a voluntarily written statement in reference to his dealings with
Mr. MAHER to which he initially indicated that he would, then he changed his mind and stated he did not want to
fill out a statement. Mr. RIVERA then stated he wanted to think about it and then stated he did not feel like filling it
out that morning at the time of the contact on 061712. I left him with two voluntarily written statement forms and I
also provided him with my business card and asked him to contact Dispatch or myself if he decided to complete
the voluntarily written statement.
Evidence Collection
After I finished talking with Mr. RIVERA, I went back to the parking lot at Overland Foods. There Deputy WEBER,
Deputy GARLAND, and Deputy JACOBS were collecting evidence out of the pickup truck and advised me that the
truck was being towed. I collected a brown paper bag of numerous items including radios and identification
information from Deputy JACOBS. Deputy JACOBS also indicated that they located a pistol in the center console
area in the pickup. She provided me with a black colored firearm which was later identified as a Stoeger Cougar
8040F brand pistol in a Bianchi brand holster as well as a magazine full of ammunition. I collected all of these
items from Deputy JACOBS. For more information as to where it was found in the vehicle, please see her report.
I collected the items to assist her with logging into Evidence. Deputy WEBER had photographed the vehicle then
removed the governmental license plates, giving them to me so that I could log them into Evidence. Deputy
WEBER also collected the food and water that was in the back of the truck to take it back to the fire command

post so it could be utilized by the personnel there. I cleared the serial number on the chain saw that was in the
back of the pickup, and was advised by Dispatch that it came back clear, no record found.

On 061812 I received a phone call from JOHN ROACH, Jefferson County Sheriff's Office. ROACH stated that the
radio I had in property as evidence with was confirmed stolen through his department.
ROA CH stated that the radio was stolen during the Lower North Park Fire. ROACH also confirmed that it did not
register as being stolen when I did a clear and list on all the property yesterday because a few numbers had been

Initial Information
On Tuesday, June 19, 2012, I received an e-mail from Investigator BEN HESS of the Larimer County Sheriff's
Office Investigations Division. Investigator HESS requested assistance in executing a search warrant of a pickup
located at Schmer's Towing on Blue Spruce Drive in Fort Collins, Colorado. I learned later that this pickup had
been involved in a case in which the occupant\driver had been arrested for impersonating a fireman after illegally
gaining entrance into the perimeter of the High Park Fire in northwest Larimer County.
I responded to Investigator HESS's e-mail indicating that I would be available to assist.
Execution of Warrant
On Wednesday, June 20, 2012 at approximately 1000 hours, I arrived at Schmer's Towing. I found the pickup in
question, a gray 2008 Toyota Tundra extended cab pickup. At the time I observed the vehicle it had no front plates
as the plates that were on the vehicle, US government plates, had been removed as having been stolen. Shortly
after my arrival, Investigator HESS, as well as Sergeant IAN STEWART, arrived with the signed warrant. At

approximately 1005 hours the warrant was executed and the interior of the locked vehicle was entered via a key
provided by the tow company.
A ctions on Scene
While Investigator HESS was searching the vehicle, I took photos from various viewpoints and of various items
within and outside the vehicle. A total of 135 photos were taken of the vehicle and the items contained therein.
These photos consisted of overall, midrange, and close-up photos. Those photos were eventually downloaded
into the Larimer County Sheriff's Office database. See those photos for further information.
Upon completion of the photography work, I assisted Investigator HESS in the collection of the items he identified
as being pertinent to his investigation. I assisted Investigator HESS in the bagging of various items and the
transportation of the items back to the Larimer County Sheriff's Office.
Prior to leaving the scene, I witnessed Investigator HESS complete an inventory and return of the items he took
pursuant to the Search Warrant. A copy of this inventory as well as the Search Warrant itself were left in the
passenger compartment of the vehicle. The key we used to gain entry into the vehicle was returned to Investigator
HESS, who in turn returned it to tow company personnel.
Packaging of Evidence
A approximately 1300 hours on June 20, 2012, Investigator HESS and I removed all of the seized items from my
t vehicle where they had been secured since leaving the tow company yard. All of the items were packaged and sealed by this deputy. After labels were
affixed, the items were turned over to the Larimer County Sheriff's Office evidence custodian for storage.

Search Warrant
On 062112, I prepared a Search Warrant for MICHA MAHER's silver, 2008 Toyota Tundra that had been
EL impounded and was currently at Schmer's Towing Impound Yard, located at 1319 Blue Spruce Drive in Fort
Collins.
On 062112 at approximately 0945 hours, I presented the Search Warrant and Affidavit to the Honorable Judge

DA Filing and Case Disposition

On 062112 at 0830 hours, I met with Deputy District A ttorney (DDA) MIKE PIERSON and presented this case and
the Felony Filing sheet prepared by Deputy JACOBS. DDA PIERSON accepted one count of Theft, a class four
felony; one count of Attempting to Influence a Public Official, a class four felony. Both misdemeanor counts of
Impersonating a Public Servant and Obstruction of Fireman were dropped and one count of Criminal
Impersonation, a class six felony, and one additional count of Attempting to Influence a Public Official, a class four
felony, were added.
A dditional interviews were conducted and video evidence was obtained on 062112, reference this case, which
may lead to additional charges.

On 062112, I received written statements from husband and wife members of the Rist Canyon Volunteer Fire
Department (RCVFD), EDWARD "EDDIE" and LAURA FRANKLIN. The FRANKLINS had been assigned to a
firefighting crew out of RCVFD Station #1 on Saturday afternoon, 061612. The following is a summary of their
statements; for a detailed account of their involvement in this case see attached typed written statements.
LAURA and EDDIE arrived at Rist Canyon Station #1 at about 1800 hours on 061612 and met a lone firefighter
who introduced himself to them as MIKE MAHER and told them he was a "Federal Sawyer." The FRANKLINS
advised MAHER was assigned to ride in their truck to go up into the fire area with specific assignments to fight
active hot spots and disregard spots that were smoldering in areas that were already burned. The FRANKLINS
stated MAHER began to "order" them to stop at smoldering spots in the burned areas and disregard their original
assignment, even "lecturing" them on protocol.
The FRANKLINS stated because of who MAHER claimed to be and the fact they saw US Government plates on
his vehicle, the believed he was a federal employee and at one point thought he might be checking up on RCVFD
for the feds. The FRANKLINS related several instances of odd behavior by MAHER, to include asking where he
could find some "skanks" and playing the radio loudly in the truck and singing along to a Journey song. LAURA
stated this was odd because you cannot hear the command radio with the music blaring.
The FRANKLINS related it was not long after they began driving around that MAHER began writing down
addresses of houses they passed. Chief GANN eventually called them back to the fire station and began his

Statement from ERIK VON WILLIAMS

I received a written statement that had been forwarded to me in my mailbox from ERIK VON WILLIAMS, a
volunteer with the RCVFD. I observed the statement was signed by WILLIAMS but there was no witness
signature. The statement relates that WILLIAMS was working at Rist Canyon Station #1 on 061612 at about 1800
hours when he was approached by "MIKE," who claimed to be a wild land firefighter assigned to RCVFD and that
the assistant chief had already assigned him to a fire engine. WILLIAMS relates he directed MIKE to ride with the
FRANKLINS. See statement for details.
National Guard Video and Statement from Specialist ORVIS
On 062112, I was notified by Sergeant IAN STEWART there was supposedly a video shot by the National Guard
showing MAHER at one of the roadblocks that had ended up on YouTube. I contacted National Guard 2nd
Lieutenant SKYE ROBINSON at the Incident Command Post and was directed to a video hosting website where I
observed a video several minutes in length showing various National Gaurdsman performing duties at the High
Park Fire.
On 061212 at approximately 1800 hours, I contacted Specialist ORVIS who was working the same checkpoint. I
downloaded a low resolution copy of the video to my laptop computer from the website. I showed ORVIS the video
and he stated he remembered filming it and the interaction with the person in the truck. He stated after the truck
went through the checkpoint the driver stopped and asked for directions into the operational area, which they
provided on a map and is the interaction also filmed by the National Guard photographer. Specialist ORVIS
completed a written statement and indicates the subject was allowed through the checkpoint because he
appeared to be a firefighter and government employee based on his vehicle, clothing, and equipment. See

I requested Corporal HORWITZ download a high resolution copy of the video and enter it into evidence. See
supplemental report by Corporal HORWITZ for further information.
Information from Other Agencies
I spoke to USFS Special Agent KIM JONES and Jefferson County Sheriff's Office Detective RALPH GALLEGOS
reference this case. I was advised Agent JONES had conducted an interview with MAHER while he was still in the
Larimer County Jail on 061812, and that MAHER admitted taking the US Government license plates when he
was still employed by the USFS. I was also advised that MAHER admitted taking the two USFS radios at the
same time. I was further advised one of the USFS radios was related to Jefferson County Sheriff's Office case
#12-8718. This radio was confirmed as stolen by their agency, and Detective GALLEGOS came to the LCSO to
photograph the radio as evidence in their case.
I was informed MAHER and his attorney had met with Agent JONES and Detective GALLEGOS at his residence
at 664 Washington Street in Denver and gave consent for investigators to recover some additional stolen property
relating to the Jefferson County case. I received a copy of a written statement from MIKE MAHER given to Agent
JONES, as well as a signed Miranda Waiver and Consent to Search form dated 061812.

MAHER's written statement indicates he was in possession of two Bendex USFS radios as well as the
government plates, which he states he was planning on keeping as souvenirs on his wall. He also states he has
various other USFS gear, such as shirts and old signs that he was planning on returning. I will request Agent
JONES look at the USFS gear we recovered from MAHER's vehicle to see if it is the same gear.
The written statement and waivers area attached to this report. I forwarded this new information regarding the
National Guard video to Deputy District Attorney DAWN DOWNS who is prosecuting the case for the State of
Colorado.
