The 2014 Constitution and By-Laws of the University Student Government

Technological University of the Philippines

PREAMBLE
We, the students of the Technological University of the Philippines Manila, imploring
the aid of Almighty God, in order to establish a Student Government that shall unite, govern, and
uplift the condition of the whole student body, protect and exercise the democratic rights and
welfare of each student, foster closer relationship among the academic community and other
sectors of society, instill nationalistic, mass oriented, scientific and technological consciousness,
for the advancement of the students and the people as a whole, do hereby ordain and
promulgate this Constitution.

ARTICLE I GENERAL PROVISIONS


Section

NAME and DOMICILE. The government of the student body of the


Technological University of the Philippines - Manila shall be known as the
University Student Government, hereinafter referred to as USG. The
principal office shall be at the Technological University of the Philippines Manila, which shall hereinafter be referred to as the University. It is located
at Ayala Boulevard corner San Marcelino St., Ermita, Manila.

Section

EMBLEM. The official emblem of the USG shall be called the Industrial
Lion Logo. This shall represent its leadership and governance integrated
in a gear that resembles its industrial nature and character.

It is described by the following:


2.1

THE GEAR represents the industrial character and nature of the


University. The maroon color denotes victorious essence.

2.2

THE LION signifies the leadership and governing functions of the USG. It
is a symbol of pride, courage, leadership and governance. The Lion shall
be silver when depicted in the emblem.

2.3

THE SIX STARS the red, gray, orange, pink, blue and green star
represent respectively the six colleges of the University namely the
College of Science, College of Architecture and Fine Arts, College of
Engineering, College of Liberal Arts, College of Industrial Education and
the College of Industrial Technology.

2.4

THE OPEN WINGS signify protection of student welfare. The Right Red
Wing denotes courage to change things for the better and the Left Blue
Wing denotes nobility in service.

THE YELLOW BACKGROUND - means elevation of mind and adaptability


of the USG to change and triumph over the challenges of times.

Section

VISION. The USG shall be the leading student government in the country
and a model of excellence in student governance.

Section

MISSION. The USG, as the leading student government shall truly


represent the students by being an active participant in the policy making
of the University, protect and promote the Students rights and welfare,
uphold democratic consultation and at all times vigilant to irregularities. It
shall provide relevant services intended for student development
towards the realization of the Universitys goal of producing
world class graduates.

ARTICLE II DECLARATION OF PRINCIPLES


Section

The USG shall be a democratic student government whose sovereignty


resides in the students and all government authority emanates from them.

Section

The USG promulgates and implements rules and policies that are
reflective of the thrusts, ideals and aspirations of the students consistent
with the policies of the University.

Section

The USG shall safeguard the general interest, promote common welfare
and protect the rights of the student body.

Section

The USG takes part in the formulation, implementation and evaluation of


the University policies with the higher University authorities on matters
affecting the students and the University as a whole.

Section

The USG pursues in improving and uplifting the physical mental, emotional
and spiritual well being and social, cultural, political and environmental
consciousness of the students.

Section

The USG aims to be transparent in all its official transactions and ensures
that the interests of the students are truly served.

ARTICLE III DUTIES OF THE USG


Section

The USG shall promote democratic rights, ideals and welfare of the
student body and the University;

Section

The USG shall uphold democratic representation and ventilation of ideas


in the campus provided that such representations shall be recognized and
must neither be correlated with moral turpitude nor character
assassination;

Section

The USG shall represent the University in external students activities with
the permission of the concerned University officials;

Section

The USG shall assist the administration in the dissemination of rules and
regulations pertaining to students proper conduct and discipline and

general information in the form of announcements, updates, news and the


like in any medium;
Section

The USG shall administer the Student Privilege Fee and Student Welfare
Fund with utmost responsibility and accountability. It shall be its duty to
allocate funds for student-related internal activities and external invitational
events where the University demands representation, subject to the
approval of concerned University officials;

Section

The USG shall serve as a linkage between the student body and the
Administration towards mutual cooperation for the development of the
University;

Section

The USG shall perform such other duties as the University authorities may
assign from time to time in accordance with the provisions herein stated;

Section

The USG shall implement, organize and execute projects that will benefit
the students.

ARTICLE IV - MEMBERSHIP, DUTIES AND OBLIGATIONS OF THE STUDENTS


Section

All bona fide undergraduate students of the University shall automatically


become members of the USG.

Section

All students shall pay the Student Privilege Fee, as part of the
miscellaneous fees, duly collected by the Administration.

Section

All students shall have the obligation to be responsible at all times by:

observing and upholding the laws of the country and the rules and
regulations of the University;

3.2

striving to be competitive in the academic and technological atmosphere in


the University;

3.3

coordinating with the USG in being vigilant to inconsistencies and


irregularities that may arise in the University.

Section

All students shall participate in major activities and other social affairs of
the USG and University.

Section

All students shall exercise their rights properly, observe their duties and
responsibilities and respect the rights of others.

Section

All students shall uphold, protect and abide the USG Constitution and By
Laws.

ARTICLE V BILL OF RIGHTS


Section

Every student shall enjoy the rights and privileges provided by the
Philippine Constitution.

Section

Every student shall have equal protection of the law by this organization.

Section

Every student has the right to have an access of University records and
pertinent documents that directly affect them, subject to such limitations as
may be provided by the University regulations.

Section

Every student shall have the freedom of speech and the right to
responsibly assemble and make petitions against authorities for redress
and grievances.

Section

Every student shall have the right to join and/or establish organizations
subject to the University rules, regulations and objectives.

Section

Every student shall have the right to suffrage, pertaining to student


elections.

Section

Every student shall have the right to be nominated, appointed and/or


elected into office of any organization provided that he meets the
prescribed requirements.

Section

Every student shall be free from affliction to any individual or group and no
any forms of violence that vitiate the freewill shall be used against him.

Section

Every student shall have the right to circulate leaflets, newsletters, posters,
manifestos, petitions, and other materials of similar nature provided that it
has the approval of the Office of the Student Affairs unless otherwise
posted in FREEDOM WALL and the like.

Section

Every student shall have the right to use University facilities such as
classrooms, conference halls and the like with the permission from
concerned University officials provided that such use will not be disruptive
to classes.

Section

11

Every student shall enjoy the right to publish articles in University


recognized student publications in accordance with the provision of
Campus Journalism Act.

Section

12

Every student shall have the right to undergo a due process.

Section

13

Every student shall have the right to be fairly evaluated according to his
academic performance based on objective criteria.

ARTICLE VI STRUCTURE OF THE USG


Section

The USG shall be composed of the Supreme Student Council and the
College Student Council.

1.1

The Supreme Student Council, which shall hereinafter be referred to as


the SSC, is composed of the President, Vice President, Six (6) Senators
with their respective Associates and the Head of the League of Student
Organizations, which shall hereinafter be referred to as the LSO.

1.2

The College Student Council, which shall hereinafter be referred to as the


CSC, is composed of the Governor, Vice Governor, Executive Secretary,
Councilor for Internal Control, Councilor for Public Relations, Councilor for
Finance and Councilor for Ways and Means.

Section

All positions, except for the LSO Head, Associates, Executive Secretary
and Councilors, shall be elected at large during the student elections.

ARTICLE VII THE SSC


Section

It shall be the main duty of the SSC to plan, propose, and implement
policies, projects and activities that shall benefit the entire student body.

Section

The President shall be the Chief Executive Officer of the USG. It shall be
his duty to:

head the USG;

2.2

preside as the Chairman of all the bilateral meetings of the SSC and the
CSC;

2.3

strongly monitor implementation of rules and regulations of the University;

2.4

sign all resolutions, correspondences and pertinent documents of the


USG;

2.5

create special committees and confirm the Heads and its members as
recommended by the Committee on Appointments;

2.6

represent the USG in his official capacity on occasions and events where
the organization needs representation unless otherwise he is incapable of
doing so;

2.7

supervise the status of the officers and the projects or activities undertaken
by them;

2.8

perform such duties, as deemed necessary or incidental to the discharge


of the functions of his officers.

It shall be the duty of the Vice President to:

support the President where his assistance may be required;

3.2

act as the Officer-in-Charge in the absence of the President in cases of


illness, inability and permanent vacancies such as death, resignation,
expulsion and impeachment;

3.3

serve as the liaison officer for external affairs of the USG for the
professional advancement of the organization;

3.4

perform such other functions as deemed necessary by the President.

There shall be six (6) executive standing committees headed by each


Senator. The committees are as follows:

Section

The head of each standing committee shall be determined and endorsed


by the Committee on Appointments.

Section

The Committee on Appointments shall:

6.1

be composed of the six (6) Senators headed by the Vice President;

6.2

recommend appointee of the Head and members of the special


committees created, subject to the approval of the President;

6.3

set criteria and guidelines in the selection of the head and members of
each committee;

6.4

initiate re-appointments if the head or members of the committees are


dysfunctional.

The Committee on Secretariat shall be composed of the head, associate


secretary and documentations officer;

7.1

It shall be the duty of the head of Secretariat to:

7.1.1

compile and keep all pertinent documents of the USG such as resolutions,
proceedings of the meetings, journals, memoranda, and the like;

7.1.2

maintain and update the USG archives;

7.1.3

verify and certify all USG resolutions;

7.1.4

serve as a property custodian by conducting annual inventory of the


acquired equipments and properties of the USG;

7.1.5

perform such other functions as deemed necessary by the President.

7.2

It shall be the duty of the Associate Secretary to:

7.2.1

be the cooperating assistant to the secretariat and perform such duties


under the committee;

7.2.2

be the liaisons officer/representative to the Senator in meetings and


discussions of any USG matter in the case of absence or unavailability and
with due permission;

7.2.3

perform such other functions as deemed necessary by the secretariat.

7.3

It shall be the duty of the Documentations Officer to:

7.3.1

be the cooperating officer in maintaining, updating and organizing pertinent


USG documents such as current resolutions and minutes of the meetings
only;

7.3.2

perform such other functions as deemed necessary by the secretariat.

The Committee on Finance shall be composed of the Head, Associate


Secretary, Credit and Collections Assistant and Accounting Assistant;

8.1

It shall be the duty of the Head of Finance to:

8.1.1

take full accountability on the utilization, appropriation and financial


management of the USG;

8.1.2

represent the USG in all financial related transactions;

8.1.3

prepare an annual Program of Expenditures and consolidate all Project


Procurement Management Programs based on the approved Calendar of
Activities;

8.1.4

properly liquidate the expenses of every activity or program conducted by


the SSC;

8.1.5

audit and compile the liquidated expenses of the CSC;

8.1.6

submit a furnished copy of financial report to the Office of Student Affairs


and to the Philippine Artisan every semester for transparency;

8.1.7

perform such other functions as deemed necessary by the President.

8.2

It shall me the duty of the Associate Secretary to:

8.2.1

be the cooperating assistant to the Senator on Finance and perform such


duties under the committee;

8.2.2

be the liaisons officer/representative to the Senator in meetings and


discussions of any USG matters in the case of absence or unavailability
and with due permission;

8.2.3

perform such other functions as deemed necessary by the Senator on


Finance.

8.3

It shall be the duty of the Credit and Collections Assistant to:

8.3.1

perform duties such as collecting financial reports of CSC and SSC and
update the budget remains of SPF and SWF;

8.3.2

compile USG
spreadsheets;

8.3.3

perform such other functions as deemed necessary by the Senator on


Finance.

8.4

It shall be the duty of the Accounting Assistant to:

8.4.1

Assist in preparing financial reports with other committees and CSC;

8.4.2

perform such other functions as deemed necessary by the Senator on


Finance.

The Committee on Students Rights and Welfare shall be composed of the

9.1

It shall be the duty of the Head of the Committee on Students Rights and
Welfare to:

9.1.1

consistently promote, protect and uphold the rights and welfare of each
student in all forms possible;

9.1.2

hear out the students grievances and seek appropriate actions;

9.1.3

implement rules and regulations pertaining to the upright conduct and


discipline within the University with the approval of the Administration;

9.1.4

perform such other functions as deemed necessary by the President.

9.2

It shall be the duty of the Associate STRAW Officer to:

9.2.1

be the cooperating assistant to the Senator and head on STRAW


Committee;

9.2.2

be the liaisons officer/representative to the Senator in meetings and


discussions of any USG matters in the case of absence or unavailability
and with due permission;

9.2.3

perform such other functions as deemed necessary by the Senator and


head on STRAW Committee.

9.3

It shall be the duty of the Student Cases and Welfare Co-coordinator to:

9.3.1

coordinate and consolidate student cases with the Senator and initiate
investigations;

9.3.2

report and document all cases;

9.3.3

perform such other functions as deemed necessary by the Senator and


head on STRAW Committee.

9.4

It shall be the duty of the Programs and Event Manager to:

9.4.1

coordinate ideal projects and activities progressively plan and oversee all
aspects of an activity/project and discuss innovative possibilities along with
the Senator along with the Associate STRAW Officer;

9.4.2

perform such other functions as deemed necessary by the Senator and


head on STRAW Committee.

9.4.3

It shall be the duty of the Programs and Event Coordinators to:

9.4.4

coordinate and assist programs and events with the Senator and Associate
STRAW Officer at all times;

9.4.5

perform such other functions as deemed necessary by the Senator and


head on STRAW Committee.

10

The Committee on Information shall be composed of the Head, Associate


Information Officer, Councilor for Research and Development, Information
Project Assistant and Communications Coordinators;

It shall be the duty of the Head of the Committee on Information to:

10.1.1 act as the official spokesperson of the USG in answering students general
inquiry about the concerns of the organization;
10.1.2 disseminate announcements regarding important University events and
other related activities and release official statements with regards to the
issues associated with academic concerns, in any form of communication
media;
10.1.3 establish constant communication with the student body and foster smooth
relationship between the academic community;
10.1.4 perform such other functions as deemed necessary by the President.
10.2

It shall be the duty of the Associate Information Officer to:

10.2.1 be the cooperating assistant to the Senator and head on Information


Committee;
10.2.2 be the liaisons officer/representative to the Senator in meetings and
discussions of USG matters in the case of absence or unavailability and
with due permission;
10.2.3 perform such other functions as deemed necessary by the Senator and
head on Information Committee.
10.3

It shall be the duty of the Councilor for Research and Development to:

10.3.1 be responsible in formulating strategies and recommendations for the


committees appropriations;
10.3.2 commence collaborative researching and developing ideal activities and
programs for the committee;
10.3.3 perform such other functions as deemed necessary by the Senator and
head on Information Committee.
10.4

It shall be the duty of the Information Project Assistant to:

10.4.1 coordinate ideal projects and activities, progressively plan and oversee all
aspects of an activity/project and discuss innovative possibilities along with
the Senator along with the Associate Information Officer;
10.4.2 perform such other functions as deemed necessary by the Senator and
head on Information Committee.
10.5

It shall be the duty of the Communications Coordinators to:

10.5.1 appropriately manage USG and Administration information dissemination;


10.5.2 coordinate at all times with all USG officers;
10.5.3 perform such other functions as deemed necessary by the Senator and
head on Information Committee.

The Committee on Sports and Culture shall be composed of the Head,


Associate SPAC Officer, Councilor for Research and Development,
Programs and Event Manager, Sports Councilor and Cultural Councilor;

11.1

It shall be the duty of the Head of the Committee on Sports and Culture to:

11.1.1 initiate programs and activities that will contribute in preserving the cultural
heritage of our country and in developing the athleticism and physical wellbeing of each student;
11.1.2 encourage the physical improvements of the sports facility of the
University;
11.1.3 represent the University athletes and cultural performers in conveying their
suggestions and grievances to the Administration concerning issues on
sports and culture;
11.1.4 perform such other functions as deemed necessary by the President.
11.2

It shall be the duty of the Associate SPAC Officer to:

11.2.1 be the cooperating assistant to the Senator and head on SPAC


Committee;
11.2.2 be the liaisons officer/representative to the Senator in meetings and
discussions of any USG matters in the case of absence or unavailability
and with due permission;
11.2.3 perform such other functions as deemed necessary by the Senator and
head on SPAC Committee.
11.3

It shall be the duty of the Councilor for Research and Development to:

11.3.1 be responsible in formulating strategies and recommendations for the


committees appropriations;
11.3.2 commence collaborative researching and developing ideal activities and
programs for the committee;
11.3.3 perform such other functions as deemed necessary by the Senator and
head on SPAC Committee.
11.4

It shall be the duty of the Programs and Event Manager to:

11.4.1 coordinate ideal projects and activities progressively plan and oversee all
aspects of an activity/project and discuss innovative possibilities along with
the Senator along with the Associate SPAC Officer;
11.4.2 perform such other functions as deemed necessary by the Senator and
head on SPAC Committee.
11.5

It shall be the duty of the Sports Councilor to:

11.5.1 coordinate relative physical and athletic activities/projects with the Senator
at all times;
11.5.2 perform such other functions as deemed necessary by the Senator and
head on SPAC Committee.

11.6.1 coordinate relative cultural and nationalistic activities/projects with the


Senator;
11.6.2 perform such other functions as deemed necessary by the Senator and
head on SPAC Committee.

12

The Committee on Special Projects shall be composed of the Head,


Associate Special Projects Officer, Councilor for Research and
Development, Programs and Event Manager and Project Coordinators;

12.1

It shall be the duty of the Head of the Committee on Special Projects to:

12.1.1 formulate and supervise all income and resource generating activities of
the USG in collaboration with the Head of the Committee on Finance;
12.1.2 monitor project implementation and accomplishments of the CSC;
12.1.3 implement projects and activities promoting ecological awareness,
community involvement and physical development of the University
facilities;
12.1.4 perform such other functions as deemed necessary by the President.
12.2

It shall be the duty of the Associate Special Projects Officer to:

12.2.1 be the cooperating assistant to the Senator and head on Special Projects
Committee;
12.2.2 be the liaisons officer/representative to the Senator in meetings and
discussions of USG matters in the case of absence or unavailability and
with due permission;
12.2.3 perform such other functions as deemed necessary by the Senator and
head on Special Projects Committee.
12.3

It shall be the duty of the Councilor for Research and Development to:

12.3.1 be responsible in formulating strategies and recommendations for the


committees appropriations;
12.3.2 commence collaborative researching and developing ideal activities and
programs for the committee;
12.3.3 perform such other functions as deemed necessary by the Senator and
head on Special Projects Committee.
12.4

It shall be the duty of the Programs and Event Manager to:

12.4.1 coordinate ideal projects and activities progressively plan and oversee all
aspects of an activity/project and discuss innovative possibilities along with
the Senator along with the Associate Special Projects Officer;
12.4.2 perform such other functions as deemed necessary by the Senator and
head on Special Projects Committee.

12.5.1 coordinate and assist programs and events with the Senator and associate
Special Projects Officer;
12.5.2 perform such other functions as deemed necessary by the Senator and
head on Special Projects Committee.

The members of the SSC have the right to directly communicate with the
Administration regarding requests and student-related concerns with the
consent of the President of the USG.

Section

14

In cases of illness, inability and permanent vacancies such as death,


resignation, expulsion and impeachment of either the President or the Vice
President, the SSC and CSC, through a bilateral meeting, shall elect a
new President or Vice President among them. The terms of this section
shall only take effect if the provisions stated in Article 7 Section 3.2 are
found to be not applicable.

ARTICLE VIII THE CSC

It shall be the duty of the CSC to:

foster smooth and harmonious relationship between students,


Administration and faculty members of their respective Colleges;

1.2

implement rules and regulations promulgated by the SSC;

1.3

plan and implement programs and activities that will benefit the student
population of their respective colleges with the recommendation of the
Head of the Committee on Special Projects and approval of the President;

1.4

monitor the student condition of their respective colleges.

It shall be the duty of the Governor to:

head the CSC;

2.2

preside as the Chairman of all the meetings of the CSC;

2.3

represent the student population of their respective colleges in the


meetings called by the USG and the Administration;

2.4

sign all resolutions, correspondences and pertinent documents of the


CSC;

2.5

supervise the performance of the CSC officers and the projects


undertaken by them;

2.6

perform such duties as deemed necessary by the President;

It shall be the duty of the Vice Governor to:

support the Governor where his assistance may be required;

3.2

act as the Officer-in-Charge in the absence of the Governor in cases of


illness, inability and permanent vacancies such as death, resignation,
expulsion and impeachment;

perform such other functions as deemed necessary by the President;

It shall be the duty of the Executive Secretary to:

compile and keep all pertinent documents of the CSC such as resolutions,
proceedings of the meetings, journals, memoranda, and the like;

4.2

verify and certify all CSC resolutions and submit a copy to the Head of the
Secretariat for archiving;

4.3

perform such other functions as deemed necessary by the Governor;

It shall be the duty of the Councilor for Ways and Means to:

formulate recommendations
appropriations of the CSC;

6.2

initiate programs and activities that will facilitate resource generation for
the CSC;

6.3

monitor the implementation of income generating projects of the CSC;

6.4

perform such other functions as deemed necessary by the Governor;

It shall be the duty of the Councilor for Finance to:

7.1

assist in the financial management and utilization of the funds of the CSC;

7.2

prepare an annual Project Procurement Management Program based on


the approved Calendar of Activities of the CSC and submit them to the
Head of the Committee on Finance;

7.3

monitor all the resource generating activities of the CSC and account for
the total income of each activity. An income percentage of five (5) percent
from the total income of the activity shall be remitted to the Head of the
Committee on Finance as contingency fund of the USG;

7.4

properly liquidate the expenses of every activity or program conducted by


the CSC and submit them to the Councilor for Internal Control for audit;

7.5

perform such other functions as deemed necessary by the Governor;

It shall be the duty of the Councilor for Internal Control to:

audit all pertinent liquidations of the programs and activities of the CSC
prior in making a financial report to be submitted to the Head of the
Committee on Finance every semester;

8.2

formulate rules, guidelines and mechanics appropriate for the income


generating activities of the CSC;

8.3

perform such other functions as deemed necessary by the Governor;

It shall be the duty of the Councilor for Public Relations to:

disseminate important information and announcements with regards to


student concerns and organized activities of the CSC and the SSC in their
respective colleges;

answer student inquiry regarding college-related issues and concerns;

9.3

head the recruitment of interested student volunteers that will be staff of


the CSC and the USG;

perform such other functions as deemed necessary by the Governor;

The Executive Secretary shall automatically become a member of the


Secretariat.

The Councilor for Ways and Means, Councilor for Finance and Internal
Control shall automatically become members of the Committee on
Finance. The Head of the Committee on Finance shall assign specific
tasks and instructions to its members regarding requests and other related
financial concerns.

Section

12

The Councilor for Public Relations shall automatically become a member


of the Committee on Information.

Section

13

The Governor and Vice Governor shall appoint their councilors in their
respective colleges. The qualifications shall be determined by the
Committee on Appointments.

Section

14

The members of the CSC have the right to directly communicate with the
Administration regarding requests and student-related concerns with the
consent of the President of the USG.

ARTICLE IX THE ACCREDITED CLUBS AND STUDENT ORGANIZATION


Section

All student organizations and interest clubs existing in the University shall
undergo the process of recognition and accreditation according to the
provisions stated in the Rules and Regulations Governing Organized
Student Activities, which shall hereinafter be referred to as the RRGOSA.

Section

If the student organization or interest club satisfied the conditions


prescribed in the RRGOSA with regards to accreditation, the student
organization or interest club shall be recognized as one of the Accredited
Clubs and Student Organizations, which shall hereinafter be referred to as
the ACSO.

Section

Being a part of the University population, the ACSO are mandated to


comply with the provisions stated in this Constitution. They can still be
regarded as independent if and only if the terms stated in their Constitution
is consistent and parallel with the provisions herein stated.

ARTICLE X THE LSO


Section

The LSO shall be regarded as the assembly of all the ACSO Presidents.

Section

The LSO shall be composed of the Head, Deputy Head and Secretary
General.

Section

The elected Head of the LSO shall be a member of the SSC.

Section

It shall be the duty of the Head of the LSO to:

4.1

monitor the progress of all the ACSO under the supervision of the OSA;

4.2

manage the appropriation and utilization of the funds allocated to the


ACSO;

4.3

prepare an annual Project Procurement Management Program based on


the approved Calendar of Activities of the LSO and submit them to the
Head of the Committee on Finance

4.4

represent the ACSO in the SSC;

4.5

raise all resolutions of the Student Congress to the SSC for consideration
and approval;

4.6

create special committees and appoint respective Heads prior to the


conduct of programs and activities;

4.7

perform such other functions as deemed necessary by the President.

It shall be the duty of the Deputy Head of the LSO to:

5.1

support the Head where his assistance may be required;

5.2

act as the Officer-in-Charge in the absence of the Head in cases of illness,


inability and permanent vacancies such as death, resignation, expulsion
and impeachment;

5.3

perform such other functions as deemed necessary by the Head.

It shall be the duty of the Secretary General to:

6.1

compile and keep all pertinent documents of the LSO such as resolutions,
proceedings of the meetings, journals, memoranda, and the like;

6.2

verify and certify all LSO resolutions and submit a copy to the Head of the
Secretariat for archiving;

6.3

perform such other functions as deemed necessary by the Head.

It shall be the duty of the Information Officer to:

7.1

disseminate important information and announcements with regards to


student concerns and organized activities of the LSO.

7.3

establish constant communication and foster smooth relationship within


the LSO.

7.4

perform such other functions as deemed necessary by the Head.

Section

The Secretary General shall automatically become a member of the


Secretariat.

Section

LSO is entitled to a share of funding from the Student Privilege Fee, but
not to exceed 15% of the USGs entire budgetary appropriations for the
school year, provided that every activity requiring funding shall be
presented to the USG for consideration and approval.

ARTICLE XI THE STUDENT CONGRESS


Section

The Student Congress, which shall hereinafter be referred to as the SC,


shall be known as the legislative convention of the ACSO.

Section

The SC shall be composed of all the Presidents or Representatives of


each ACSO.

Section

The Office of Student Affairs, which shall hereinafter be referred to as the


OSA, together with the USG, shall facilitate the first SC of the semester
two weeks after the official roster of ACSO has been released. The SC
shall be in quorum in order to conduct the election of LSO officers. If the
election has been successfully carried out, the assembly shall confirm
elected officers by resolution. If not, another SC shall be conducted until
quorum has been achieved.

Section

The SC is vested the authority to deliberate and approve all the requests
of each ACSO or the LSO as a whole.

Section

An accumulated two-thirds (2/3) vote, when the SC is in quorum shall


approve a resolution.

ARTICLE XII THE STUDENT LEGISLATIVE ASSEMBLY


Section

The Student Legislative Assembly, which shall hereinafter be referred to as


the SLA, shall be the highest policy-making body of the USG that upholds
democratic consultation.

Section

The SLA shall be composed of the following:

SLA Representatives

It shall be the duty of the SLA to:

3.1

recommend and formulate policies that shall benefit the entire student
body of the University;

3.2

ratify or decline all legislative proposals, amendments and revisions;

3.3

ratify or decline the Codes of the Constitutional Commissions of the USG;

It shall be the duty of the Chief Legislator to:

4.1

preside as the Chairman of all the proceedings of the SLA;

4.2

create special committees among the SLA that will formulate and revise
existing Constitutions, Codes and Policies of the USG;

4.3

appoint Heads of each created Committees;

4.4

supervise all the legislative operations of the SLA.

It shall be the duty of the SLA Representative to:

duly represent his constituent in every proceedings of the SLA;

5.2

recommend Policies for the betterment of the student body;

5.3

perform such other functions as deemed necessary by the Chief


Legislator.

Section

The Vice President shall automatically become the Chief Legislator.

Section

The SLA Representatives shall be composed of the CSC, the LSO and the
Presidents of each Block Sections of the University.

8.

The Chief Legislator and the SSC are vested with the executive powers of
the SLA and are given the authority to formulate, revise or modify existing
Constitutions, Codes, Policies of the USG or the University, prior to the
approval of the SLA.

ARTICLE XIII CONSTITUTIONAL COMMISSION

to as the COMSELEC, shall be the sole Constitutional Commission of the
USG.

ARTICLE XIV THE COMSELEC


Section

The COMSELEC shall be recognized as the Student Electoral Board of the


University.

The COMSELEC shall execute and promulgate electoral processes and


provisions stipulated in the Election Code.

Section

It shall be the duty of the COMSELEC to:

formulate and implement consistently the provisions of the Election Code;

3.2

supervise and coordinate the election procedures;

3.3

disseminate information regarding USG elections;

3.4

screen all applicants for candidacy and announce official candidates;

3.5

process certificates of candidacy, ballots and other forms for the USG
positions and the election proceedings;

3.6

ensure availability of polling places;

3.7

appoint election tellers for every polling place which shall handle the
election proceedings;

3.8

prepare and inspect all polling places;

3.9

prepare ballots, tally boards and all election materials;

3.10

canvass election returns with the presence of two (2) representatives from
each party and independent candidate running for elective positions in the
USG;

3.11

proclaim the winning candidate;

3.12

issue identification cards to the official poll watchers;

3.13

post results of tabulations;

3.14

submit list of official winners to the OSA and school authorities concerned;

3.15

conduct hearings on controversies and election protests pending before it


upon proper motion of any party, taking into consideration the materiality
and number of witness presented.

The fiscal provisions of the COMSELEC shall be determined by the


allocated budget of the USG. All expenses of the COMSELEC shall be
properly liquidated and submitted to the Head of the Committee on
Finance for audit.

ARTICLE XV THE FEDERATION OF STUDENT COUNCILS AND GOVERNMENT


Section

The Federation of Student Councils and Government, which shall


hereinafter be referred to as the FSCG, shall be the union of all the
Student Councils and Governments of the Technological University of the
Philippines System.

Section

The USG shall be the authorized representative of the University in the


FSCG.

ARTICLE XVI PRIVILEGE OF USG OFFICERS


Section

The elected twenty (20) officers of the USG shall enjoy One hundred
percent (100%) tuition fee and miscellaneous fee discount.

Section

The fund for the Privilege shall be charged from the Student Welfare Fund
and shall be included in the Annual Program of Expenditures of the USG.

Section

If ever an elected USG officer has an existing scholarship, he shall get


50% refund of his tuition and miscellaneous fee.

ARTICLE XVII FUNDS AND FISCAL CONTROL

Section

The funds of the USG shall be derived from the summation of the duly
collected Student Privilege Fee, the remaining funds from the previous
term and the Student Welfare Fund.

Section

The USG shall conduct a budget hearing during the second quarter of the
year wherein the Head of the Committee on Finance shall present the
Annual Program of Expenditures along with the consolidated Annual
Procurement Management Program based from the approved Calendar of
Activities.

Section

No amount of money shall be disbursed without the approval of the SSC.

ARTICLE XVIII IMPEACHMENT


Section

All USG officers may be impeached and further be removed from office.

Section

The following are the grounds for impeachment:

2.1

Unlawful violation of the USG Constitution and By-Laws.

2.2

Gross negligence of duty.

2.3

Illegitimate disbursement of funds.

2.4

Any behavior which undermines the integrity of the USG.

2.5

Any other forms of gross misconduct as provided by the Implementing


Rules and Regulations.

2.6

betrayal of public trust

All bona fide student or USG officer may file a formal written complaint to
the SSC.

3.1

Students are required to present filers affidavit, written documents and


witness accounts upon filing a formal written complaint.

3.2

USG Officers are required to present a resolution of impeachment against


any officer of the USG upon filing a formal written complaint.

The following are the Policies for Impeachment:

4.1

The SSC shall execute all pertinent investigations of impeachment


complaints and determine the grounds for impeachment within seven (7)
school days after the written complaint has been filed. The SSC shall
determine whether to initiate impeachment or recall proceeding or not.
Should the SSC fail to meet the deadline, the impeachment complaint shall
automatically be dismissed.

4.2

The SSC shall issue Notice of Impeachment or summon persons involved


at least three (3) days before the date of the impeachment hearing. Any
USG officers whom received a Notice of Impeachment shall take Leave of
Absence for the duration of the impeachment.

4.3

The SSC, on its two-thirds (2/3) vote shall remove any officer of the USG
from office.

ARTICLE XIX AMENDMENTS


Section

All amendments of this Constitution and By-Laws shall be proposed by the


executive body of the SLA.

Section

All legislative proposals concerning this Constitution and By-Laws shall


undergo the due process of amendments stipulated in Article XII.

Section

No amendments of this Constitution and By-Laws shall be authorized


within three (3) academic years prior to the ratification of the SLA.

ARTICLE XX TRANSITORY PROVISIONS


Section

All existing resolutions, codes, Implementing Rules and Regulations, and


policies consistent with this Constitution and By-Laws shall remain
functional until amended, repealed or revoked.

Section

In cases where no election is conducted, the incumbent USG officers shall


automatically assume office in holdover capacity until such time that an
election is conducted, provided that the USG officers are officially enrolled
in the University.

ARTICLE XXI FINAL PROVISIONS


Section

SEPARABILITY CLAUSE. If any provision of this Constitution is declared


invalid, the remainder thereof not affected thereby shall continue in full
force and effect.

Section

REPEALING CLAUSES. All previous USG Constitution and By-Laws are


hereby repealed. To the extent that any of the provisions of this
Constitution and By-Laws are inconsistent with the terms of any other
University statute or regulation, the provisions of this Constitution and ByLaws shall control.

Section

EFFECTIVITY. This Constitution and By-Laws shall immediately take effect


upon ratification of the SLA and acknowledgment of the University
President.
