This Privacy Policy describes how Blackbird Fabrics Inc. (the “Site” or “we”) collects, uses, and discloses your Personal Information when you visit or make a purchase from the Site.

Collecting Personal Information

When you visit the Site, we collect certain information about your device, your interaction with the Site, and information necessary to process your purchases. We may also collect additional information if you contact us for customer support. In this Privacy Policy, we refer to any information that can uniquely identify an individual (including the information below) as “Personal Information”. Device Information

Examples of Personal Information collected: the version of web browser, IP address, time zone, cookie information, what sites or products you view, search terms, and how you interact with the Site.
Purpose of collection: to load the Site accurately for you, and to perform analytics on Site usage to optimize our Site.
Source of collection: Collected automatically when you access our Site using cookies, log files, web beacons, tags, or pixels.
Disclosure for a business purpose: shared with our processor Shopify.

Order Information

Examples of Personal Information collected: name, billing address, shipping address, payment information (including credit card numbers, email address, and phone number).
Purpose of collection: to provide products or services to you to fulfill our contract, to process your payment information, arrange for shipping, and provide you with invoices and/or order confirmations, communicate with you, screen our orders for potential risk or fraud, and when in line with the preferences you have shared with us, provide you with information or advertising relating to our products or services.
Source of collection: collected from you.
Disclosure for a business purpose: shared with our processor Shopify (e-commerce platform) and Shipstation (fulfillment software)

Customer Support Information

Examples of Personal Information collected: name, email address, billing address, shipping address, payment information (including the payment processor used, email address, and phone number).
Purpose of collection: to provide customer support.
Source of collection: collected from you.

Email/SMS Marketing Information

Examples of Personal Information collected: name, email address, phone number, location. 
Purpose of collection: to ensure that customers who express consent to receive marketing information, including email newsletters and SMS marketing messages, are able to receive the requested information. 
Source of collection: collected from you.
Disclosure from our Email/SMS marketing application: This information will not be shared with any third parties. Third parties do not include subsidiaries and affiliates (i.e., companies under common control, as well as service providers who provide services on behalf of the customer). 

Sharing Personal Information

We share your Personal Information with service providers to help us provide our services and fulfill our contracts with you, as described above. For example:

  • We may share your Personal Information to comply with applicable laws and regulations, to respond to a subpoena, search warrant or other lawful requests for information we receive, or to otherwise protect our rights.
  • We use Google Analytics to help us understand how our customers use the Site. Google Analytics tracks website activity such as session duration, pages per session, bounce rate etc. of individuals using the site, along with the information on the source of the traffic.   • Our store uses Facebook Ads Conversion Tracking (Facebook Pixel) to learn about the behaviour, location and interests of visitors to our site. This is used to serve more relevant ads to visitors of our website and to gain insights into the conversions that result from our Facebook ads. 
  • Facebook Remarketing Ads: Our store uses Facebook remarketing services (Facebook Pixel) to display Facebook ads to users who have interacted with our website.
  • Facebook Pixel is an analytics tool that allows us to measure the effectiveness of our Facebook advertising by understanding the actions people take on our website.

Information You Disclose Publicly or to Others

We may permit you to submit ideas, photographs, user profiles, writings, music, video, audio recordings, computer graphics, pictures, data, questions, comments, suggestions or other content, including Personal Information, such as on blogs and forums, and in association with your account and user profile. We may store, display, reproduce, publish, distribute or otherwise use User Content online or offline in any media or format (currently existing or hereafter developed) and, if so, will attribute it to you. However, please think carefully before deciding what information you share, including Personal Information, in connection with your User Content. Please note that Blackbird Fabrics Inc. does not control who will have access to the information that you choose to make public, and cannot ensure that parties who have access to such publicly available information will respect your privacy or keep it secure. We are not responsible for the privacy or security of any information that you make publicly available to us or what others do with the information you share with them on the Service. We are not responsible for User Content you submit to Third Party Services via our site.

Sweepstakes, Contests, Surveys, Polls, and Promotions

We may offer sweepstakes, contests, surveys, polls, and other promotions (each, a “Promotion”) that may require registration or for you to submit Personal Information/Personal Data. These Promotions are strictly voluntary. If you choose to enter a Promotion, your Personal Information/Personal Data may be disclosed to third parties in connection with the administration of such Promotion, such as in connection with winner selection, prize fulfillment, and as required by law, such as on a winners list. By entering a Promotion, you are agreeing to the official rules that govern that Promotion, which may contain specific requirements of you, including, except where prohibited by law, allowing the sponsor and/or other parties to use your name, voice and/or likeness in advertising or marketing materials. Blackbird Fabrics may offer opportunities to enter a contest or sweepstakes or other feature that we offer jointly with a third party. As a result of your participation in such feature, your information may be shared with the third party that is jointly offering the feature, which will be disclosed at the time your information is collected.

Using Personal Information

We use your Personal Information to provide our services to you, which include: offering products for sale, processing payments, shipping and fulfillment of your order, and keeping you up to date on new products, services, and offers.

Lawful Basis

Pursuant to the General Data Protection Regulation (“GDPR”), if you are a resident of the European Economic Area (“EEA”), we process your personal information under the following lawful bases:

  • Your consent;
  • The performance of the contract between you and the Site;
  • Compliance with our legal obligations;
  • To protect your vital interests;
  • To perform a task carried out in the public interest;
  • For our legitimate interests, which do not override your fundamental rights and freedoms.

Retention

When you place an order through the Site, we will retain your Personal Information for our records unless and until you ask us to erase this information. For more information on your right of erasure, please see the ‘Your rights’ section below.

Automatic Decision-Making

If you are a resident of the EEA, you have the right to object to processing based solely on automated decision-making (which includes profiling), when that decision-making has a legal effect on you or otherwise significantly affects you.

We do not engage in fully automated decision-making that has a legal or otherwise significant effect using customer data.

Our processor Shopify uses limited automated decision-making to prevent fraud that does not have a legal or otherwise significant effect on you.

Services that include elements of automated decision-making include:

  • Temporary denylist of IP addresses associated with repeated failed transactions. This denylist persists for a small number of hours.
  • Temporary denylist of credit cards associated with deny listed IP addresses. This denylist persists for a small number of days.

    Your Rights

    GDPR

    If you are a resident of the EEA, you have the right to access the Personal Information we hold about you, to port it to a new service, and to ask that your Personal Information be corrected, updated, or erased.     Your Personal Information will be initially processed in Ireland and then will be transferred outside of Europe for storage and further processing, including to Canada and the United States.     CCPA

    If you are a resident of California, you have the right to access the Personal Information we hold about you (also known as the ‘Right to Know’), to port it to a new service, and to ask that your Personal Information be corrected, updated, or erased.     Personal Information Erasure Requests

    The GDPR gives individuals the right, in certain circumstances, to ask that their personal data be erased, or that a company restrict the processing of their personal data.

    "Personal data" means any data that can be used to identify an individual, including name, address, email, IP address, and credit card number.

    Personal data does not include information that is purely financial and cannot be linked to an individual, such as how many times a specific product has sold and how much revenue your store has made. 

    If you would like to request your personal data be erased, please contact us at [email protected] to begin the process. Once requested, Shopify will transmit your erasure request to all apps the site has installed at the time you make the request that may have access to that customer’s data.

    Shopify will not erase personal data if the customer has made an order in the last 6 months (180 days), in case a chargeback occurs. If a request for erasure is submitted in that time frame, then it will sit pending, and Shopify will action it once the appropriate time has passed. You do not need to submit another request.

    Cookies

    A cookie is a small amount of information that’s downloaded to your computer or device when you visit our Site. We use several different cookies, including functional, performance, advertising, and social media or content cookies. Cookies make your browsing experience better by allowing the website to remember your actions and preferences (such as login and region selection). This means you don’t have to re-enter this information each time you return to the site or browse from one page to another. Cookies also provide information on how people use the website, for instance, whether it’s their first time visiting or if they are frequent visitors.

    You do not need to allow cookies to visit most of the website. However, enabling cookies may allow for a more tailored browsing experience and is required for certain parts of the website to work. In the majority of cases, a cookie does not provide us with any of your personal information.

    We also use cookies to help keep track of items you put into your shopping cart, including when you have abandoned your cart, and this information is used to determine when to send cart reminder messages via SMS.

    Do Not Track

Like many websites and online services, Blackbird Fabrics currently does not alter its practices when it receives a “Do Not Track” signal from a visitor’s browser.
