Purpose This paper aims to examine how a partnering contract facilitates project values and the culture in a construction project and the consequences of said facilitation. Hence, it answers the following research questions: 1) How does the contractual framework in Bispevika facilitate relational culture? 2) What effects of this facilitation can be identified in the early phase of development? Design/Methodology/Approach An explorative approach is taken into a single case. A literature study into the topics of relational contracting and culture provides a backdrop for the study. The empirical work consists of a study of the construction contracts and six in-depth interviews with actors from the supply-chain. Findings Contractual elements affect the project organizations’ motivation. On the basis of existing literature, five contractual elements are identified explicitly in the contracts: “shared goals”, “incentives and bonus”, “open book”, “colocation”, and “design-build”. Targeting integration in construction, this study compares the suitability of various factors and strategies to provide suitable contractual and noncontractual incentives for building a relational contracting (RC) culture and fostering effective teamwork. Results from statistical analyses of 96 questionnaire responses from Singapore contractors, consultants, and clients are presented. Despite obvious differences in perceptions among different groups of respondents on the relative usefulness of individual factors, it was observed that trust should broadly be at the core of RC and teambuilding. Although some factors appear to be more important than others, the overall results indicate that Singaporean industry participants prefer to target integration in construction through (i) trust-based contractual and operational arrangements and (ii) extended use of relational qualities in team selection for postcontract partnering-type RC arrangements between clients and contractors. The results also suggest the need for an interrelated and consolidated approach, both for propagating RC and for building integrated project teams. Like many other countries, the results indicate the readiness of Singaporean industry participants to incorporate RC and team-building techniques in a move towards improved performance and value for money. The results may be applicable to other countries or contracting regimes, especially where the practice of RC is at an early stage. Outcomes of this study are expected to benefit both industry practitioners and researchers in exploring, designing, and implementing suitable contractual and noncontractual incentives.

Managing the relationships between the various parties involved in construction is becoming more crucial as the industry moves away from fragmented and adversarial ways of working. Under less-adversarial procurement routes and contractual arrangements such as partnering, it is essential that the parties develop mutually beneficial objectives and a high level of commitment, cooperation and trust. When disputes do occur, without good relationships between the parties they are likely to refer back to the clauses of the contract which, in turn, may start a return to adversarial ways of working. The concept of ‘relational contracting’ has been developed by Macneil (1974, 1980, 1981 and 1983). This considers a contract to represent a relationship between the parties and introduces a degree of flexibility into the contract on the basis of understanding the other party’s objectives. Based on a review of recent literature, this paper explores the dimensions of relational contracting that are applicable to the construction industry. Since the principles of relational contracting have received relatively little attention in the construction management literature, work from other disciplines have been explored in order to promote a fuller understanding of its implications to understanding the way in which people from different organizations work together. It is suggested that previous work has viewed the concept of relational contracting in isolation rather than as an integrated set of relational principles. It is argued that when viewed as a joined-up set of dimensions, relational contracting has the potential to facilitate a better understanding of interorganizational relationships within the industry. Keywords: relational contracting, long-term relationship, construction supply chain.

The importance of good relationship among parties in the construction industry has been accepted as one of the central issues of an organisation's success. The growing acceptance to the Relational Contracting approaches that representing partnering, supply chain alliances and other types of collaborative working relationships shows how construction organisations are moving forward from the traditional adversarial culture to a more harmonious working environment. However the application of the Relational Contracting ...

The purpose of this paper is to engage in a comprehensive understanding of alliance skills, cultures, and management behaviours in construction alliances. Alliance Contracting has been introduced to overcome some of the challenges caused by adversarial contracts, by: aligning the incentives of the partners, clearly defining their rights and responsibilities, and providing the means for resolving disputes when they arise. A qualitative technique of semi-structured in-depth interviews was used to gather primary data in response to a series of research questions. The responses were analysed by means of a code-based content analysis. The results show that the key contributor to the success was the development of a supportive culture within the alliance. In addition, the alliance benefited its members by providing learning experiences, which contributed to the success of future projects. This created benefits beyond the life of the alliance, and transferred knowledge back into the partne...
Traditional project design and construction delivery is segmental. Researchers and practitioners often cite the separation, or " silo effect, " as a reason for poor project outcomes. In response, new forms of integrated contracts have emerged, fostering more collaborative efforts and a focus on successful project outcomes, instead of individual organizational outcomes. Relational contract theory provides a basis for understanding these new integrated forms of agreement through a set of relational contracting norms. This study operationalizes the relational contracting norms designed to measure project integration. The norms and their dimensions were developed through a rigorous construct mapping methodology and then tested, analyzed, and validated with a survey of owners and owners' representatives from 314 completed projects using exploratory and confirmatory factor analyses. The study validates the measures and demonstrates the potential that the measures have to illuminate the nature of relational contracting in construction project teams. The validated scales can be used in future research to better understand when and how contracts influence integration and project performance.
O rganizations promoting new infrastructure projects range from private owners of airports, hospitals, and utilities to governments and local authorities. They typically chose to strategically position themselves as the project clients. Instead of building in-house capabilities to design and build new infrastructure, they opt to intermittently source works from the fragmented architecture-engineering-construction supply chain. In the last decade, infrastructure promoters have become increasingly interested in translating the Toyota lean management paradigm-its underlying business infrastructure as well as technical processes-into the project environments associated with new infrastructure developments. 1 A prerequisite at the core of this strategic approach is the development of cooperative relationships with the project suppliers. To enable this, infrastructure promoters realized they needed to rethink commercial practices and started to experiment with "relational" contracts. A relational contracting strategy-or "intertwined" strategy in that personal relations become heavily intertwined with the economic exchange 2 -presumes that the project clients are willing to discard hard-nosed lump-sum forms of contracting for others that nurture cooperative, long-term relationships with the preferred project suppliers.
Traditional 'transactional' contracting methods have been criticised over recent years for being inequitable, adversarial and inefficient. Relationship Contracting however, is proposed as a way to improve construction process efficiency and project outcomes by improving the relationships between project stakeholders, through the use of equitable asset delivery strategies.
Targeting integration in construction, the study reported here compares the suitability of various factors and strategies, in order to provide suitable contractual and non-contractual incentives for building a Relational Contracting (RC) culture and effective teamwork. Results from statistical analyses of 96 questionnaire responses from Singapore contractors, consultants and clients are presented. Despite differences of perceptions among different groups of respondents on the relative priorities of various individual items, it was observed that trust should be at the core of RC. Also, some factors appear to be more important depending on the project, client, and other contracting parties. However, there are some factors that are substantially common. The results suggest the need for an interrelated and consolidated approach, both for propagating RC and building integrated project teams for RC. Like many other countries, the results indicate the readiness of Singaporean construction industry stakeholders to incorporate RC and teambuilding techniques in a move towards improved performance and value for money.

The strategic importance of relationship style contracting is recognised in the construction industry. Both public and private sector clients are stipulating more integrated and collaborative forms of procurement. Despite relationship and integrated contractual arrangement being available for some time, it is clear that construction firms have been slow to adopt them. Hence it is timely to examine how social exchanges, via unwritten agreement and behaviours, are being nurtured in construction projects. This paper adopted the concept of Psychological Contracts (PC) to describe unwritten agreement and behaviours. A conceptual model of the PC is developed and validated using the results from a questionnaire survey administered to construction professionals in Australia. The results uncovered the relationships that existed amongst relational conditions and relational benefits, the PC and the partners' satisfaction. The results show that all the hypotheses in the conceptual model of the PC are supported, suggesting the PC model is important and may have an effect on project performance and relationship quality among contracting parties. A validated model of the PC in construction was then developed based on the correlations among each component. The managerial implications are that past relationships and relationship characteristics should be taken into account in the selection of procurement partners and the promise of future resources, support and tangible relational outcomes are also vital. It is important for contracting parties to pay attention to unwritten agreements (the PC) and behaviours when managing construction projects.
ARTIFICIAL INTELLIGENCE AND HUMAN RIGHTS IN MEXICO: CHALLENGES AND OPPORTUNITIES (Atena Editora), 2024
