Due to the economic impacts induced by the recognition of the public health emergency in contract... more Due to the economic impacts induced by the recognition of the public health emergency in contractual relations that conducted to an increase in legal disputes on this subject, the purpose of this paper is to explore the permissive requirements for contractual review and its application in the COVID-19 pandemic context. The study is based on the analysis of a trial handed down by the São Paulo State Justice Court, reasoned essentially on the bibliographic review of the theories of contractual unpredictability and excessive onerousness, along with verification of the pertinent legislation. Finally, this paper concludes that the instruments already offered by the Brazilian legal system provide satisfactory protection to the conflicting interests of the parties, and the claims review should be in accordance with the dictates of good faith.

Nesta pesquisa, defendemos o estudo léxico-gramatical no ensino de língua materna sob a ótica enunciativa, visto este estudo encontrar-se no fundamento de toda e qualquer produção e compreensão textuais de natureza reflexiva, objetivo maior da aprendizagem de língua portuguesa. Assim, esse estudo implica, necessariamente, reconstituir o movimento sobre o qual se originam os usos linguísticos. Identidade lexical, funcionamento enunciativo e variação semântica para a Teoria das Operações En... more Identidade lexical, funcionamento enunciativo e variação semântica para a Teoria das Operações Enunciativas Lexical identity, enunciative functioning and semantic variation for the Theory of Enunciative Operations RESUMO-Este trabalho propõe uma abordagem semântica diferenciada da relação que os lexemas verbais mantêm com os contextos nos quais se inserem e cuja construção enunciativa sustentam. Fundamentase no princípio de que os modelos composicionais de constituição do sentido de um enunciado são insufi cientes para explicar, de um lado, as interações entre as unidades linguísticas que lhe dão forma, de outro, as variações semânticas observadas. Tomando como ilustração a análise do funcionamento enunciativo dos verbos romper e quebrar em português brasileiro (PB), busca evidenciar em que medida os processos semânticos próprios a estas unidades se aproximam e se distanciam nas cenas enunciativas que constroem. O quadro teórico-metodológico adotado é o da Teoria das Operações Enunciativas, referencial inscrito no campo da Linguística da Enunciação e que tem na prática de elaboração de glosas seu fundamento analítico. Operação sustentada pela atividade epilinguística constitutiva da linguagem, a glosa se estabelece pela manipulação controlada do material empírico, que expõe circunstâncias e restrições referentes ao emprego dos verbos em articulação com seus contextos de inserção. This article proposes to discuss the general features of the prefix from the point of view of Bra... more This article proposes to discuss the general features of the prefix from the point of view of Brazilian linguistic tradition and how the semantic properties of the prefix CO (i.e. co-, com-, con-, cor-, cum-) are presented by studies done so far, which focus mainly European Portuguese. Afterwards, we present the analysis of the enunciative functioning of the verbs sumir (i.e. to disappear, what is not shown, what is not longer here) and consumir (i.e. to consume, to exhaust, to deplete) in Brazilian Portuguese in order to examine the role of the prefix in the uses of consumir when compared to those of sumir. We also analyse the functioning of the verb comer (i.e. to eat, to devour, to consume), whose root com-, by referring to the prefix cum (cum edere > cumedere / comedere > comere > comer) delivers another perspective about the history of this form. The analysis of the uses of consumir and comer does not intend to delimit the role of the prefix CO in BP, but to consider the way it takes part in the semantic variation of these two verbs, which can contribute to the description of its enunciative role in forthcoming research.

A abordagem tem como ponto de partida a identificação de elementos de seu enredo que remetem a aspectos de práticas eugênicas e o exercício do biopoder, os quais exerceram forte influência nas correntes de pensamento dos séculos XIX e XX e deixaram marcas profundas nas obras literárias, tanto quanto na história da humanidade. Para tanto, dialogamos com obras de pensadores como Michel Foucault, Hannah Arendt e Nancy Leys Stepan.

mother t... more The word understood as a mere code and product of a mechanical decoding has hindered, in
mother tongue teaching, the existence of reflections that address the textual production and
comprehension as a process that allows to reflect on the verbal material itself constituting the
statements. In this research, we advocate the lexical grammar study in the teaching of mother
language under the enunciative view, but from an expository approach, as this study lies at the
foundation of any production and textual comprehension of reflexive nature, main goal of
learning Portuguese. Thus, this study implies, necessarily, reconstruct the motion on which
the linguistic usages are originated from. To do so, it is taken as its starting point the
manipulation of verbal material that composes the statements in order to get closer to the
internal structure that rules and authorizes the possibilities of construction of meaning of
lexical units when in use. Note that this research, developed from the perspective of Theory of
Enunciative Operations (CULIOLI, 1990, 1999a, 1999b, DE VOGUE, FRANCKEL,
PAILLARD, 2011), is a suggested activity to reflect upon the functioning of the language
involving linguistic and cognitive operations mobilized to produce meaning. To achieve this
goal, we started from the analysis of a precise linguistic unit, the verb ROMPER. That's
because, according to our theoretical framework, a unit characterized as an element that is not
part of a "semantic field" bounded independently of it, establishes a unique and singular
movement of enunciation, which study says much about the actual functioning of the activity
of language itself. More precisely, we seek to observe, on a meaning reconstruction of the
statements containing it, how is the integration between the representations of the nature of
language derived from texts collected from various sources, such as dictionaries, newspapers,
magazines and internet, and the ones built from literary productions, the context in which the
creative semantic freedom allows unique representations, but which relate to the verb and the
terms deployed by it to mean. Thus, the methodology proposed here is based on the concept
of "epilinguism" (ROMERO, 2011) defined by Culioli as nonconscious metalinguistic activity
(1999a), but which finds, in practice of linguistic manipulation of statements involving the
comment, a means of making conscious a nonconscious knowledge. We believe that this
practice, by making easier the planning of didactic situations that allow to "teach students to
think about their thinking" (REZENDE, 2008, p.96), assists on the promotion of activities that
make possible the reflective learning of the operation of mother tongue, contributing thus to
achieve a major goal - if not the greatest – of basic education in our country, that is, through
the development of reading and writing skills, provide the affirmation of the student as a
discursive being, involving him "with social processes of creating meaning through the use of
a language "(BRASIL, 1998, p.19).
