The volume is organized into three thematic sections, each of which deals with different aspects of democratic governance in the region. The first section examines political culture, civil society, and democracy. The second part offers comparative analyses of institutional design systems of political representation. The third section centres on aspects of political performance and governance such as human rights performance, security sector governance, and the external as well as internal 'peacefulness' of the political regimes in Southeast Asia. The final chapter connects the insights derived from individual chapters and presents a comparative assessment of political performance and governance in democratic and non-democratic regimes in the region. Furthermore, it provides a comparative analysis of factors that are conducive or obstructive to future democratic change and democratic stability in Southeast Asia.

It was accompanied by intensified conflict in the political arena, a dramatic increase of ethnic and religious violence and the danger of national disintegration. Ten years
after the collapse of the New Order, Indonesia has made significant progress, however the quality of democracy is still low.Theoretically innovative and empirically sound, this book is an in-depth analysis of the Indonesian reform process since 1998. Bünte beschäftigt sich mit grundlegenden Aspekten der indonesischen Innenpolitik. In den Mittelpunkt stellt er die vor allem in den letzten Jahren wieder forcierte Politik der lokalen und regionalen Dezentralisierung, die auch anhand detaillierter empirischer Beispiele dargestellt wird. Regional patterns have long been crucial to debates about presidentialism starting with the Latin... more Regional patterns have long been crucial to debates about presidentialism starting with the Latin American cases in which presidential systems were seen to have contributed to political instability. This special issue examines four cases of presidentialism in Southeast Asia. Both the ‘first’ wave of the presidentialism literature which focuses on ‘pure’ cases of presidentialism, and the ‘second’ wave, which concentrates on a complex mixture of presidentialism and other institutions, are relevant to Southeast Asia. Among ‘pure’ presidential systems, the Philippines appears to provide support to ‘the perils of presidentialism’ thesis given the collapse of democracy there several decades ago and periodic instability since then. But Indonesia, despite ostensibly having the additional institutional perils of multipartism, has proved stable. Among the hybrid cases of presidentialism, both Myanmar and Timor Leste have forged elite accommodation through creating presidential-style institutions, including one considered particularly unpromising for achieving political stability in the literature. Because presidentialism has been associated both with elite accommodation and stability as well as political conflict and instability, the Southeast Asia cases do not clearly demonstrate the dangers of presidentialism. They point instead to the relative lack of explanatory power of this institutional arrangement in understanding political stability.

Die Dezentralisierung staatlicher Macht wird in der Politikwissenschaft allgemein als pro-bates M... more Die Dezentralisierung staatlicher Macht wird in der Politikwissenschaft allgemein als pro-bates Mittel angesehen, um junge Demokratien zu konsolidieren und die Partizipation aus-zuweiten. Der Beitrag untersucht die Dezentralisierung politischer Macht in den " defekten Demokratien " Südostasiens. Es zeigt sich, dass informelle Institutionen (Klientelismus, Patronage, Korruption) wesentliche Hindernisse sowohl bei der Umsetzung der Dezentralisie-rung als auch bei der Ausweitung von Partizipation und Demokratisierung auf lokaler Ebene darstellen. Begründen lässt sich die Persistenz informeller Strukturen mit unterschiedlichen Pfaden der Staatsbildung und Demokratisierung. Um überhaupt umgesetzt zu werden, müssen Dezentralisierungsmaßnahmen im Interesse der Staatseliten liegen. Die Dezentralisierungs-bemühungen in Südostasien haben zwar neue Dynamiken bei der Machtverteilung zwischen nationaler und lokaler Ebene zur Folge gehabt und die Lokalität als Ort des Politischen gestärkt. Dennoch zeigt sich, dass lokale Parteien, lokale Zivilgesellschaft und die lokale Presse zu schwach sind, um Politiker zur Verantwortlichkeit anzuhalten. Die Verantwortlich-keitsmechanismen werden durch informelle Institutionen (Patronage, Stimmenkauf, Korrup-tion) unterlaufen und eine weitere Demokratisierung wird verhindert. From 1988 to 2011, the military built up institutions that guaranteed the military’s dominant position in the political arena. The second phase, since 2011, has seen a guided relaxation of the military’s coercive controls and the liberalisation of political spaces for the opposition and civil society. In order to contextualise Myanmar’s external relations, this article will first describe the military’s strategy and then outline the key changes that have been implemented in the country’s foreign policy.

Today, most military regimes have either given way to some form of democracy or been transformed ... more Today, most military regimes have either given way to some form of democracy or been transformed into another form of authoritarianism. This article formulates a framework for the analysis of the detachment of militaries from politics and applies it to the case of Burma/Myanmar, which is an example of deeply entrenched military rule. It is argued that after the retreat from direct rule the military is still in control, although the regime has embarked on a series of reforms that have liberalized the political system. The article identifies the internal dynamics within the military regime as a prime motive. External factors played only an indirect role, as the growing dependence on China was seen as a threat among nationalistic circles. The military decided to bridge the internal impasse and end the external isolation only after it consolidated its own power, finally allowing the leadership succession to run smoothly

Over the last twenty-five years the constitutional landscape of Southeast Asia has changed tremen... more Over the last twenty-five years the constitutional landscape of Southeast Asia has changed tremendously. As in the rest of the world, states in the region are dramatically altering their constitutions, often putting in place institutional safeguards for individual rights, such as constitutional courts and human rights commissions. Yet despite the numerous formal changes, actual constitutional practice in the region has been highly uneven. Four areas are particularly contested: constitutional drafting and design; individual and religious rights; the role of the military in constitutional politics; and the rule of law, courts and justice. How states in Southeast Asia resolve unfolding conflicts in these four areas will be critical to how constitutionalism evolves in the region. Replacing traditional legal scholarship with a new perspective on how constitutional politics are contested in the region, this article seeks to advance the scholarly debate by delving deeply into the dynamics that underpin unfolding constitutionalism trajectories and assessing whether countries in the region are actually deepening constitutional practice in a Western liberal sense or whether the model that seems to be emerging is quite different.

In Thailand schlug Premierministerin Yingluck Shinawatra Ende Dezember 2011 die Einrichtung einer... more In Thailand schlug Premierministerin Yingluck Shinawatra Ende Dezember 2011 die Einrichtung einer Verfassungskommission vor und stellte sich auch hinter die Forde-rung, das Volk in einem Referendum über die Zukunft der Verfassung entscheiden zu lassen. Die Reform der Verfassung, die im Jahr 2007 von der militärischen Übergangs-regierung geschrieben worden war, gehört zu ihren Wahlkampfversprechen. Analyse Thailand ist mit seinen bisher 18 Verfassungen und häufigen Militärputschen als Son-derfall in der Verfassungsentwicklung in Südostasien einzustufen. Es gab zwar in der letzten Dekade in zahlreichen Ländern der Region neue Verfassungen und Verfassungs-änderungen, ein Trend hin zu einem "neuen" Konstitutionalismus, wie er in anderen Regionen anzutreffen ist, ist jedoch nur sehr vage zu erkennen.

Jeder eingereichte Artikel wird zwei Gutachtern aus dem zuständigen Wissenschaftlichen Beirat der Gesellschaft anonymisiert zur Begutachtung zugeleitet (double-blind-Verfahren). ASIEN ist die Mitgliederzeitschrift der Deutschen Gesellschaft für Asienkunde e.V. Die Redaktion freut sich besonders, wenn Mitglieder der Deutschen Gesellschaft für Asienkunde die Zeitschrift durch Übersendung von Aufsätzen zu einschlägigen Themen sowie von Rezensionen, Konferenzberichten und Informationen zu Forschung und Lehre unterstützen. ASIEN erscheint vierteljährlich. Mitglieder erhalten ASIEN kostenlos. Ein Jahresabonnement kostet 60,00 Euro (zzgl. This article formulates a framework for the analysis of the detachment of militaries from politics and applies it to the case of Burma/Myanmar, which is an example of deeply entrenched military rule. It is argued that after the retreat from direct rule the military is still in control, although the regime has embarked on a series of reforms that have liberalized the political system. The article identifies the internal dynamics within the military regime as a prime motive. External factors played only an indirect role, as the growing dependence on China was seen as a threat among nationalistic circles. The military decided to bridge the internal impasse and end the external isolation only after it consolidated its own power, finally allowing the leadership succession to run smoothly

As in the rest of the world, states in the region are dramatically altering their constitutions, often putting in place institutional safeguards for individual rights, such as constitutional courts and human rights commissions. Yet despite the numerous formal changes, actual constitutional practice in the region has been highly uneven. Four areas are particularly contested: constitutional drafting and design; individual and religious rights; the role of the military in constitutional politics; and the rule of law, courts and justice. How states in Southeast Asia resolve unfolding conflicts in these four areas will be critical to how constitutionalism evolves in the region. Replacing traditional legal scholarship with a new perspective on how constitutional politics are contested in the region, this article seeks to advance the scholarly debate by delving deeply into the dynamics that underpin unfolding constitutionalism trajectories and assessing whether countries in the region are actually deepening constitutional practice in a Western liberal sense or whether the model that seems to be emerging is quite different.

Die Reform der Verfassung, die im Jahr 2007 von der militärischen Übergangs-regierung geschrieben worden war, gehört zu ihren Wahlkampfversprechen. Analyse Thailand ist mit seinen bisher 18 Verfassungen und häufigen Militärputschen als Son-derfall in der Verfassungsentwicklung in Südostasien einzustufen. Es gab zwar in der letzten Dekade in zahlreichen Ländern der Region neue Verfassungen und Verfassungs-änderungen, ein Trend hin zu einem "neuen" Konstitutionalismus, wie er in anderen Regionen anzutreffen ist, ist jedoch nur sehr vage zu erkennen.

Jeder eingereichte Artikel wird zwei Gutachtern aus dem zuständigen Wissenschaftlichen Beirat der Gesellschaft anonymisiert zur Begutachtung zugeleitet (double-blind-Verfahren). ASIEN ist die Mitgliederzeitschrift der Deutschen Gesellschaft für Asienkunde e.V. Die Redaktion freut sich besonders, wenn Mitglieder der Deutschen Gesellschaft für Asienkunde die Zeitschrift durch Übersendung von Aufsätzen zu einschlägigen Themen sowie von Rezensionen, Konferenzberichten und Informationen zu Forschung und Lehre unterstützen. The volume is organized into three thematic sections, each of which deals with different aspects of democratic governance in the region. The first section examines political culture, civil society, and democracy. The second part offers comparative analyses of institutional design systems of political representation. The third section centres on aspects of political performance and governance such as human rights performance, security sector governance, and the external as well as internal 'peacefulness' of the political regimes in Southeast Asia. The final chapter connects the insights derived from individual chapters and presents a comparative assessment of political performance and governance in democratic and non-democratic regimes in the region. It guarantees political stability and provides legitimacy in times of crisis. The King also serves as agenda setter and veto-player in certain policy arenas. The current political crisis shows that the dominant role of the King also has negative effects as political actors do not settle their conflicts without an active involvement of the King. Democratic institutions find it hard to consolidate. The lacking democratic political culture and growing legitimacy crisis demonstrate the weakness of the political system.

Ex... more This paper looks at the special case of military-guided electoral authoritarianism in Myanmar. Examining why electoral authoritarianism crumbled so easily, it looks into the historical importance of elections, the formation of the electoral authoritarian regime under military guidance, and its demise. This article identifies the strong charisma of the opposition leader, Aung San Suu Kyi, as well as the increasing struggles within the ruling party and the incumbent government's promise to the international community to hold free and fair elections as the main triggers of the downfall of electoral authoritarianism. This demise, however, did not bring an end to the dominant position of the military, which retains ultimate veto power for all far-reaching changes in the country.

The article identifies the internal dynamics within the military regime as a prime motive for a reform of the military regime. Although the external environment has completely changed over the last two decades, this had only a minor impact on military politics. The opposition could not profit from the regime's factionalization and external sanctions and pressure have been undermined by Asian engagement.

Nach knapp zwei Jahrzehnten trat im März 2011 der langjährige Vorsitzende des Staatsrats für Frieden und Entwicklung (SPDC), Senior General Than Shwe (1992 -2011) ab. Er löste den Militärrat auf und übergab die Macht an eine zivile Regierung unter Führung des neu gewählten Präsidenten Thein Sein. Als dieser bei seiner Amtseinführung weitreichende politische Reformen und eine Öffnung des lange abgeschotteten Landes versprach, glaubte zunächst niemand dem Präsidenten, der selbst langjähriges Mitglied des regierenden Militärrats war. Jedoch leitete Thein Sein in den ersten zweieinhalb Jahren zahlreiche politische Reformen ein, wie die Aussöhnung mit der oppositionellen Nationalen Liga für Demokratie (NLD) unter Vorsitz von Friedensnobelpreisträgerin Aung San Suu Kyi, die Freilassung zahlreicher politischer Gefangener und die Ausweitung politischer Freiheitsrechte. Thein Sein startete auch eine neue Friedensinitiative, die den ethnischen Gruppen des Vielvölkerstaats einen politischen Dialog in Aussicht stellte. Der Reformkurs resultiert nicht aus der Schwäche oder internen Spaltung des Die Reformpolitik des seit März 2011 amtierenden Präsidenten Thein Sein nährt -nach mehr als fünf Jahrzehnten Diktatur -weltweit Hoffnungen auf Frieden und Demokratie in Myanmar. Die Bilanz nach knapp drei Jahren fällt jedoch gemischt aus: positive Entwicklungen im Bereich der Pressefreiheit, bei den politischen Gefangenen, im Umgang mit der Opposition. Gleichzeitig aber Stagnation im Dialog mit den ethnischen Gruppen, Eskalation der Kämpfe in den Minderheitengebieten und religiös motivierte Gewalt in einigen Landesteilen. Der vorliegende Asia Policy Brief nimmt eine kritische Bestandsaufnahme der Reformpolitik vor und fragt nach den Chancen einer Demokratisierung des langjährigen Militärregimes. Ob das Land den Weg zur Demokratie einschlagen wird, hängt im Wesentlichen davon ab, ob das Parlamentskomitee zur Revision der Verfassung einen Kompromiss finden wird. Das 109 Mitglieder umfassende, alle Parteien repräsentierende Komitee wurde Ende Juli eingesetzt. Regierungs-und militärnahe Parteien haben die Mehrheit: Die USDP hat 52 Mitglieder, die Streitkräfte 25 -die NLD hingegen nur sieben. Die wichtigsten Reformfragen sind hierbei: 1) Die Frage der Präsidentschaft Aung San Suu Kyis: Gegenwärtig schließt ein Verfassungsartikel Kandidaten von der Präsidentschaft aus, die mit einem Ausländer verheiratet sind oder Kinder im Ausland haben.
