Once again, what is happening in reality mirrors something that I have already been working on, but then I have 20 different incomplete inquiries at any one time, so that's par for the course.

Looks like we won't get a Trump January 6th Trial before ethe election. We will get, however, a series of hearings before Judge Chutkan, in which Jack Smith will be obliged to prove that Trump's coup was a private project for his own benefit, and not some part of his official duties.

So basically a trial, going far beyond what's in the indictment.

Finally found the thing I was looking for that seems to demonstrate that co-conspirator 6 is definitely Mike Roman.

Firstly, I always thought it was him, as he was involved in Pennsylvania, which Roman basically ran. But there's parity in charging both Chesebro and Roman. What Chesebro was to the legal part, Roman was to the organizational part.

The key was to find out who took part in the conference call with PA fake electors, Giuliani and Chesebro on December 12, 2020. Image

Guilty on the top charge. Questioning Spazzo's guilt on the seditious conspiracy count are understandable: they basically had to pick one of the footsoldiers to join the case to highlight the violent nature of the plot, but compartmentalization makes him seem less culpable. I was concerned that they might be hung on the seditious conspiracy charge for all defendants. A hung jury for Pezzola? Seems fine, he'll still get plenty of time for the other counts.

Now maybe the DOJ can move on to the organizers, since they've freed up some AUSAs.

Of course, the January 6th "patriots" are going to claim this is further evidence of a "fedsurrection."

To my mind, it's just further evidence of overlap between far-right authoritarianism and law enforcement. Thanks to the person who called this in.

In the meantime, the FBI needs to run the BOLO photos through to compare them with ID photos at the FBI and other federal law enforcement agencies.

One of the back burner stories of the January 6th investigation is the question of Joseph Cuffari, Trump's DHS Inspector General, still in office despite calls for his resignation.

Epshteyn was paid $200k by Trump in 2022, and has had his phone seized by the DOJ. He was also a partner in Steve Bannon's $FJB crypto scam.

And, for some reason, he blew off the Committee's subpoena, but this was not the subject of a criminal referral.

Developing a spreadsheet of all testimony before the January sixth Committee, sorting by date because I am interested in when the Committee began to ask specific questions about if or if they were contacted by Alex Cannon or any other Trump attorney. Noticed that Doug Mastriano was only interviewed by the Committee on August 9, 2022.

That is extremely late. I started investigating this soon after the attack, and Mastriano was already established as an important figure by the very first sedition hunters.

Apparently Mike Pence thinks being president of the Senate means that he's part of the legislative branch, and therefore untouchable, thanks to the speech and debate clause.

This is one of the most ridiculous things I've ever heard.

Pence is up against every org chart of the executive branch ever produced. The vice president is part of the executive branch.

As you read the transcripts, you'll find investigators regularly asking Trump White House and campaign insiders what their current employment situation is.

This probably covers at least half of them. And the DOJ already knows where to look. Outfits like Elections LLC. Do they have other clients?

Sure. But these are often things like the Herschel Walker campaign, so it's a distinction without a difference. The money is coming from the same place.

Oh, hey, look, law enforcement didn't just use the Proud Boys as a source for information on the activities of the left, they were also feeding information to the Proud Boys for January 6th.

A lot of agencies have a lot to hide, it's not just one rogue lieutenant. h/t to Roger Parloff, @rparloff from Lawfare, who my followers probably already follow.

The government has been adamant that informants in the Proud Boys didn't tip them off about January sixth, the defense has been adamant they were provocateurs.

A quick thread on the law firms that represented multiple witnesses who testified before the January 6th Committee.

Not going to make any inferences about what it means that some of these witnesses are clients of the same firms, though the question of who's paying is a good one. Abel Bean, Jacksonville, Florida

Abel Bean had three witnesses as clients, one from the Trump Campaign, Arthur Schwartz, and two from the Trump White House, Andrew Surabian and Taylor Budowich.
