Sejarah besar yang memperlihatkan kebesaran negara pula, terhipnotis sebagian generasi untuk menggugat. Pokoknya menggugat. Acapkali, banyak yang lupa, bahwa sejarah besar yang satu disokong oleh sejarah besar yang lain. Sejarah besar tidaklah terpacak megah secara tunggal. Sejarah, mau besar atau kecil, terdiri dari beberapa tiang sebagai penyangga. Maka, keberadaan beberapa kerajaan besar dulu, dari perjalanan sebuah bangsa, di beberapa tanah bergabung yang kemudian bernama Indonesia, merupakan rangkaian dari beberapa sejarah besar yang sudah lama sekali. Pertarungan dari kebesaran beberapa sejarah pula, seperti yang kita rindukan, kita kenal dengan kerajaan Aceh, Kerajaan Majapahit, Kerajaan Mataram, Sriwijaya, Demak, dan sebagainya.

Damage is not only caused by the consumption aspect, but also due to government policy. Although it has great potential, but most of the traditional fishing communities are poor. This study seeks to answer three questions, namely: how to protect traditional fishermen in Aceh in connection with the consumption of fishery resources? What factors cause justice to be important in the context of the protection of traditional fishermen? How does the development of the law is supposed to do to protect traditional fishing? This study examines the law in non-doctrinal perspective with socio-legal approach. The third source of information is the Bureau of Maritime Affairs and Fisheries, FAO staff, the community of fishermen, fishery-environmental NGOs, and academics marine, fisheries, and the customary law of the sea. Protection of traditional fishermen is very important undertaken by the country in the consumption of fishery resources due to the presence of traditional fishermen in exploiting fisheries resources not only as an economic activity, but also related to culture. Fairness factor in the protection of traditional fishermen need to be explored to remember a few things, namely poverty, access, utilization, ease of access to markets, and access management. Development protection laws in connection with the issue of fishermen should be the most important principle, namely to bring the state in providing basic rights as outlined in the Constitution. Access restrictions or lack of interest will basically lead a traditional fishing in marginal conditions either political, social, cultural, or economic. This study suggests that in order to restore the traditional fishermen, it is important to conduct study on the various legislations, ranging from legal to technical regulations, to find a map of the position of traditional fishermen in Indonesia. Based on these maps, traditional fishing is authorized with the participation of various sectors of the program provided for the fishing communities.

Otoritas pelaksanaan syariat Islam ada pada pemerintahan baik provinsi, kabupaten/kota, maupun gampong. Namun demikian khusus untuk gampong, kewenangan tersebut sifatnya sangat terbatas. Kajian ini ingin menjawab dan memetakan kewenangan yang dimiliki gampong dalam pelaksanaan syariat Islam. Kajian dilakukan dengan pendekatan doktrinal dengan spesifikasi kajian yuridis normatif, di mana dipergunakan bahan hukum primer (peraturan perundang-undangan) dan bahan hukum sekunder (hasil penelitian). Pengolahan data dilakukan dengan melakukan penafsiran (interpretatif), sedangkan laporan disusun dengan paparan deskriptif. Dapat disimpulkan bahwa gampong memiliki kewenangan yang terbatas dalam pelaksanaan syariat Islam, yaitu: Pertama, dapat membentuk Wilayatul Hisbah pada tingkat gampong, yang tugasnya hanya terbatas pada menegur dan menasehati. Kedua, dalam struktur pemerintahan gampong, geusyik (lurah) dan imuem meunasah memiliki tugas dan kewajiban syariat dan mencegah kegiatan maksiat. Ketiga, dalam peraturan gampong, pelaksanaan syariat Islam merupakan salah satu materi yang dapat menjadi ketentuan yang diterapkan pada tingkat gampong. Keempat, dalam konteks penyelesaian kasus, beberapa kasus dapat diselesaikan dengan konsep peradilan gampong. Kelima, gampong sendiri dapat membentuk baitul mal di tingkat gampong. Kewenangan terbatas yang dimiliki gampong sebagaimana tersebut di atas, adalah wajar mengingat kemampuan penyelesaian pada tingkat gampong dengan struktur yang tersedia, sangat sederhana dibandingkan dengan pemerintahan yang di atasnya. The authority for the implementation of Islamic Shari'a is prevailed in government level: provincial, district/city as well as village. However, specific to village, the authority is very limited. This study tries to map the competency and authority of village in the implementation of Islamic law. The study was conducted with the doctrinal approach to the specification of normative studies, which used primary legal materials (legislation) and secondary legal materials (research). Data processing is done through interpretation (interpretative), while reports are prepared by exposure to descriptive. It can be concluded that village has limited authority in the implementation of Islamic law such: First, to form Wilayatul Hisbah at village level, the task is limited to admonish and advise. It is recommended that policy makers doing holistic approach to fisheries management.
