Resumen: Se trata aquí de advertir de manera somera acerca riesgo o amenaza sobre los logros regu... more Resumen: Se trata aquí de advertir de manera somera acerca riesgo o amenaza sobre los logros regulatorios de protección ambiental alcanzados debido a la crisis sanitaria provocada por la conocida como la pandemia por la enfermedad COVID-19. A pesar de la dificultad para su reconocimiento, el principio de no regresión ambiental es posible fundamentarlo a través de la prohibición del artículo 191 TFUE, el artículo 37 de la Carta de los Derechos Fundamentales de la Unión Europea y el artículo 193 TFUE que posibilita el “mantenimiento y adopción, por parte de cada Estado miembro, de medidas de mayor protección”. No obstante, ante la situación de catástrofe sanitaria, que se suma a la económica y ambiental ya existentes, se ha optado por la desregulación ambiental ante estos graves escenarios de la pandemia, pues algunas comunidades autónomas han dictado medidas de relajación. Esas normas que “flexibilizan” la protección ambiental deben ser cautelosas, además, en lo que hace a un eventual incumplimiento internacional (environmental compliance) del mecanismo de Aarhus (Comité de cumplimiento) que ha determinado expresamente la observancia de todos los requisitos de los tres pilares de la justicia ambiental, el segundo de la participación de los ciudadanos en esta materia con mayor intensidad, incluso durante la situación de pandemia y crisis actuales.
Abstract: It concerns of briefly warning about the threat on the regulatory achievements of environmental protection reached due to the sanitary crisis caused by the so-called pandemic disease COVID-19. Despite the difficulty of its recognition, the principle of environmental non-regression can be based on its prohibition established in article 191 TFUE, article 37 of the Charter of Fundamental Rights of the European Union and article 193 TFUE. However, in the face of the health, economic, and environmental catastrophe situation and in some regional decision-making areas, environmental deregulation has been opted to fight these serious pandemic scenarios, as Spanish regions have issued relaxation measures. These rules that “relax” environmental protection must also be cautious regarding possible international non-compliance with the Aarhus mechanism (Compliance Committee), which has expressly determined the observance of all the requirements of the three pillars of environmental justice, the second of the participation of citizens in this matter with greater intensity, even during the current pandemic and crisis.

La trazabilidad, como un elemento trascendental del sistema de seguridad alimentaria garantiza el control que permite la seguridad siendo reivindicada como cierre del sistema "desde la granja a la mesa". La utilización de la tecnología blockchain como herramienta facilitadora de la trazabilidad en la alimentación es el tema de este estudio que no pretende más que describir la regulación de la seguridad alimentaria en la actualidad y los retos de la aplicación del blockchain al sistema. Traceability in the European Union Food Law is defined as the ability to trace and follow a food, feed, food producing animal or substance intended to be, or expected to be incorporated into a food or feed, through all stage of production, processing and distribution. The use of blockchain technology helping and providing traceability system in food chain is the aim of this work and giving a general outline of food safety regulation and the challenge to apply the blockchain in the system.

The present study attempts to describe the complexity of the action of the public powers towards ... more The present study attempts to describe the complexity of the action of the public powers towards sustainable development and, more specifically, that related to the 2030 Agenda of the Sustainable Development Goals (SDG) of the United Nations. Facing the variety of political and legislative initiatives and redesigning the key public policies for this, combining this with an adequate budgetary allocation at all territorial levels, requires harmoniously contemplating the interconnection between economic development, environmental protection, agricultural markets, agri-food industry, or the pressure on natural resources such as water, energy and soil, as essential for agricultural crops. Sustainable production and consumption as the title of SDG number 12 involves multiple ways of acting or goals to be achieved. One of those goals is the proper management of food waste. By 2030, halve per capita global food waste at the retail and consumer levels and reduce food losses along production and supply chains, including post-harvest losses.

The energy is depleted and biofuels have been so far, one kind of alternative and renewable energ... more The energy is depleted and biofuels have been so far, one kind of alternative and renewable energy successful to tackling climate change. While biotechnology research that created this new kind of energy production has been widely supported and developed by institutions and companies given its versatility and extremely useful in other fields such as health, combating pollution or protection of the environment, among other beneficial effects for society. However biotechnology presents serious scientific uncertainty in relation to energy, food security, and agriculture. Given these problematic issues this case study suggests asking about the current formulation of sectoral policies in which these activities are organized; in the task of further refinement are involved different courses of action (alternatives, proposals, options) acceptable and relevant to deal public problems, then policies must be conceived as solutions to problems.

El 11 de marzo de 2015 se publicaba la Directiva (UE) 2015/412 del Parlamento Europeo y del Conse... more El 11 de marzo de 2015 se publicaba la Directiva (UE) 2015/412 del Parlamento Europeo y del Consejo por la que se modifica la Directiva 2001/18/CE en lo que respecta a la posibilidad de que los Estados miembros restrinjan o prohíban el cultivo de organismos modificados genéticamente (OMG) en su territorio. Posteriormente a la publicación de la misma, la Comisión hizo pública una Comunicación con idéntica temática: la posibilidad de que los Estados restrinjan o prohíban el cultivo de OMG en su territorio. Dicha Comunicación es el documento que se analiza en este capítulo.
