Hello. I am requesting the undeletion of this image, which was speedied by User:Fred Chess a few day ago. It was deleted as a copyright violation because the image as it now appears on flickr says "all rights reserved". Originally, the image was licensed under CC-by-sa or CC-by (I don't remember which, but it was properly tagged). There was a discussion about a similar picture on wikipedia when it was nominated to be featured. You will find in that discussion independent confirmation of my claim (for instance another wikipedia editor quotes a passage where the photographer says he previously licensed all his photos under cc-by-sa). As I understand it, the author was contacted and permission was independently secured. As I'm sure most people know CC is cannot be rescinded, and the author is aware of our use of at least one other of his images and has not objected. --Kzollman 16:41, 21 December 2006 (UTC)[reply]
- Absolutely, this is why we have a policy now that all flickr images are reviewed by an administrator to determine whether they are free at any time. Unfortunately, while it may be that this image was in fact under a free license when you uploaded it, no administrator was able to see it at that time and therefore we have no corroberation of that fact. Incedentally, even images an administrator uploads from Flickr requires that corroberation. I apologize but unless you can get the author of this image to allow your use, it will remain deleted. —the preceding unsigned comment is by Bastique (talk • contribs)
- Why isn't the corroboration I provided (on the wikipedia discussion) sufficient? --Kzollman 21:19, 21 December 2006 (UTC)[reply]
- Umm, the current practice with Flickr review is to mark images not freely available as possibly unfree but to keep the image. There has been no discussion as yet about what to do with Category:Possibly unfree Flickr images. This is just one instance of this situation. I favour undeleting this image (but will not do so myself) and beginning a serious discussion about deciding what to do about this category's contents.--Nilfanion 21:47, 21 December 2006 (UTC)[reply]
- I've restored it. Someone had marked it as copyvio, which is why it was deleted. I had no idea these weren't deleted as a matter of course. Incedentally, you can't corroberate yourself. That defeats the purpose of corroberation Cary "Bastiq▼e" Bass demandez 21:59, 21 December 2006 (UTC)[reply]
- Thank you for restoring it. In the meantime, I have contacted the author of the picture which will hopefully resolve this matter fully. Re: corroboration. I was unclear. The corroboration was provided by someone else (you will see I did not comment on the Wikipedia FP request), I provided a link to the corroboration. --Kzollman 22:06, 21 December 2006 (UTC)[reply]
- I have received permission from the author. I don't know how it works on commons, but on wikipedia we send a copy of the confirmation to a permissions email address and put a tag on the image. Shall I do that here too? Here is the text of the email:
- Hi Kevin,
- No, you are free to use the image as long as proper credit (and preferably a link back to my Flickr page) is provide. Please provide me with a link once the image is back up.
- Thanks,
- Todd Klassy
- If anyone is concerned I can copy the email to you as well. --Kzollman 23:26, 21 December 2006 (UTC)[reply]
- The email to send to is permissions-commons (at symbol) wikimedia.org . Please note that he should allow it to be free to use for any purpose (as long as proper credit is provided). Please email and do not post the personal information online. Thanks. Cary "Bastiq▼e" Bass demandez 01:24, 22 December 2006 (UTC)[reply]
- I have confirmed that he is currently willing to license the image under CC-by. The email will be forwarded to the appropriate place. --Kzollman 09:21, 24 December 2006 (UTC)[reply]
- Okay, its been received by permissions, someone has responded. Can I change the confirmed tag myself, or will someone else do it? --Kzollman 22:03, 25 December 2006 (UTC)[reply]
- As you're who is confirming the license, i think you are the most appropiate to change the license and close this. Platonides 22:18, 27 December 2006 (UTC)[reply]

I do not think that is such a good idea. We will await someone with OTRS access to do it. / Fred Chess 00:40, 28 December 2006 (UTC)[reply]
