PERIOD OF PREVENTIVE IMPRISONMENT
DEDUCTED FROM THE TERM OF
IMPRISONMENT
ART. 29, RPC as amended by R.A. No. 10592
Preventive Imprisonment Refers to the
detention of accused while the case
against him is ongoing trial either because:
1. The crime he committed is a non-
bailable offense and evidence of guilt is
strong; or
2. The crime committed is a bailable
offense, but he does not have funds.
Rules in Deducting the Period of
Preventive Imprisonment
R.A. No 105932 provides that offenders
or accused who have undergone
preventive imprisonment shall be
credited in the service of their
sentence consisting of deprivation of
liberty in accordance with the following
rules:
1. If the detention prisoner agrees
voluntarily in writing, after being informed
of the effects thereof with the assistance of
counsel, to abide by the same disciplinary
rules imposed upon convicted prisoners,
the credit shall be full time during which
they have undergone preventive
imprisonment.
2. If the detention prisoner does not agree
to abide by the same disciplinary rules
imposed upon convicted prisoners, he shall
do so in writing with the assistance of a
counsel and shall be credited in the service
of his sentence with 4/5 of the time during
which he has undergone preventive
imprisonment.
 When it comes to the penalty of Reclusion Perpetua,
which is a life sentence, the credit for preventive
imprisonment is deducted from thirty (30) years. This
means that if a person has spent ten years in preventive
imprisonment, they would only serve an additional
twenty years for their Reclusion Perpetua sentence.
Who are disqualified:
a. When they are recidivists, or have
been convicted previously twice or
more times of any crime; and
b. When upon being summoned for the
execution of their sentence, they have
failed to surrender voluntarily.
Whenever an accused has undergone preventive
imprisonment for a period equal to the imposable
maximum imprisonment of the offense charged to
which he may be sentenced and his case is not
yet decided, he shall be released immediately
without prejudice to the continuation of the trial
thereof or the proceeding on appeal, if the same
is under review, except for the following:
1. Recidivist
2. Habitual Delinquent
3. Escapee
4. Person charged with heinous crimes

The good conduct of any offender qualified

for credit for preventive imprisonment
pursuant to Art. 29 of the Code, or of any
convicted prisoner in any penal institution,
rehabilitation or detention center or any
other local jail shall entitle him to
deductions from the period of his sentence.
IMPORTANT TERMS
"Accused" - an offender who is under detention and
against whom a Criminal Complaint or Prosecutor's
Information has been filed in a court law;

"BJMP" - Bureau of Jail Management and Penology;

"BUCOR" - Bureau of Corrections

"Chief" - Chief of BJMP;

"Commitment Order" - a written order of a court of law or

any other competent authority committing a person to
jail or prison for confinement;
"Convicted Prisoner" - a person who has undergone trial
and who has been convicted by a final judgment by a court
of law or tribunal, for the felony or offense he committed;

"Correctional Facility" - a prison or jail;

"Counsel" - a lawyer tasked or requested to assist a

detention prisoner in explaining the provisions of Article
29 of the Revised Penal Code regarding the benefit of
credit for preventive imprisonment;
OBJECTIVES
 1. Redeem and uplift valuable

and social usefulness;
2. Level the field of opportunity by
giving an increased time allowance
to motivate prisoners to pursue a
productive and law-abiding life; and
3. Implement the state policy of restorative
and compassionate justice by promoting the
reformation and rehabilitation of prisoners,
strengthening their moral fiber and
facilitating their successful reintegration in
the mainstream of society.
• The rules provided for new procedures
and standards of behavior for the grant
of good conduct time allowance, require
the creation of a Management, Screening
and Evaluation Committee (MSEC)

allowance under Republic Act No. 10592
shall be prospective in application.

DOJ Secretary Menardo Guevarra (L) and DILG Secretary Eduardo Año present the signed revised
IRR of the GCTA Law on Monday, September 16, 2019.
• The Department of Justice (DOJ) and the Department of
the Interior and Local Government (DILG) have
completed and signed the revised Implementing Rules and
Regulations (IRR) of the Republic Act 10592, or the law
that increases the time slashed from the prison term of
convicts due to good behavior.
• Included in the revised IRR is a clarified provision stating
“recidivists, habitual delinquents, escapists and those
convicted of heinous crimes” are disqualified to benefit
from the good conduct time allowance (GCTA).
Heinous crimes are the following:

murder, rape, big-time drug trafficking,

kidnapping for ransom, treason, piracy,
qualified bribery, parricide, infanticide,
plunder, kidnapping and serious illegal
detention, robbery with violence or
intimidation, qualified vehicle theft, and
arson.
 DEDUCTION FROM PERIOD OF
IMPRISONMENT DUE TO GOOD
CONDUCT ALLOWANCES
a.During the first two years of
imprisonment, he shall be allowed a
deduction of twenty days for each
month of good behavior during
detention;
b.During the third to the fifth year,
inclusive, of his imprisonment, he
shall be allowed a reduction of
twenty-three days for each month of
c) During the following years until the tenth years,
inclusive of his imprisonment he shall be
allowed a reduction of twenty-three days for
each month of good behavior during detention;
and
d) During the eleventh and successive years of his
imprisonment, he shall be allowed a deduction
of thirty days for each month of good behavior
during detention.
DEDUCTION FROM PERIOD OF IMPRISONMENT
DUE TO GOOD CONDUCT ALLOWANCES
 Management,
Screening and
Evaluation Committee
(MSEC)
The Director of the BUCOR, Chief of the BJMP
and Wardens of various provinces, cities,
districts and municipalities are mandated to
assess, evaluate and grant time deduction to
a deserving prisoner, whether detained or
convicted by final judgment, in the form of
GCTA, STAL and TASTM as prescribed by these
Rules through the creation of the MSEC.
• The composition of the MSEC shall be
determined by the Director of the BUCOR,
Chief of the BJMP or Wardens of Provincial
and Sub-Provincial, District, City and
Municipal Jails, respectively.
• Membership shall not be less than five (5)
and shall include a Probation and Parole
Officer, and if available, a psychologist and
a social worker.
• The MSEC shall prepare minutes of every
meeting to record each proceeding.
 Procedures for the Grant of
Good Conduct Time Allowance
1. The BUCOR, BJMP, and Provincial Jails shall give
special considerations to satisfactory behavior of a
detention or convicted prisoner consisting of active
involvement in rehabilitation programs, productive
participation in authorized work activities or
accomplishment of exemplary deeds. It is understood
that in all instances, the detained or convicted prisoner
must faithfully obey all prison/jail rules and regulations;
2. The BUCOR, BJMP and
Provincial Jails shall each
create the MSEC or such
appropriate number of MSECs
tasked to manage, screen and
evaluate the behavior or
conduct of a detention or
convicted prisoner;
3. After due consideration of the
behavior or conduct shown by a
detained or convicted prisoner, the
MSEC shall then recommend to the
appropriate official the appropriate
GCTA that may be credited in favor
of said prisoner ranging from the
minimum of the allowable credit to
the maximum credit thereof;
4. Acting on the recommendation of the MSEC, the appropriate
official name in Section 1 of Rule VII hereof shall either;
A. Approve the recommendation and issue a certification
granting GCTA to the prisoner for the particular period;
B. Disapprove the recommendation if the prisoner
recommended is not qualified to be granted the benefit or
the errors or irregularities attended the evaluation of the
prisoner; or
C. Return the recommendation, without action, for corrections
as regards the name, prison number or other clerical or
inadvertent errors, or for the further evaluation of the
conduct or behavior of the prisoner concerned.
4. The appropriate official
concerned shall ensure that
GCTAs are processed each
month and that there is proper
recording of a prisoner's good
behavior in the jail or prison
records.

FOR LOYALTY OF PRISONER

1. A deduction of 1/5 of the period of

sentence is granted to a prisoner
who, having evaded his preventive
imprisonment or the service of his
sentence, under the following
circumstances in Art. 158 of the RPC:
a. On the occasion of disorder, resulting
from a conflagration, earthquake,
explosion, or similar catastrophe; or
b. During a mutiny in which he has not
participated – gives himself up to the
authorities within 48 hours following
the issuance of the proclamation by
the President announcing the passing
away of the calamity or catastrophe.
 SPECIAL TIME ALLOWANCE
FOR LOYALTY OF PRISONER
2. A deduction of 2/5 of the period of his
sentence shall be granted in case said
prisoner chose to stay in the place of his
confinement notwithstanding the existence
of a calamity or catastrophe enumerated in
Art. 158 of this code.
 An appeal by the accused shall
not deprive him of entitlement
to the above allowances for
good conduct.
TIME ALLOWANCE FOR STUDY,
TEACHING AND MENTORING
a privilege granted to a prisoner, whether detained or
convicted by final judgment, as a reward for having
earned a post-graduate degree or college degree, a
certificate of completion of a vocational or technical
skills or values development course, a high school or
elementary diploma or to one serving his fellow
prisoner as teacher or mentor while incarcerated,
equivalent to a deduction of a maximum of fifteen (15)
days for every month of study or mentoring services
