APPRENTICESHIP ACT

Apprentices Act, 1961
 The Act was introduced in the form of a bill on
August 19,1961, enacted in Dec’61 and was
implemented w.e.f 1.1.63.

 Objectives:
to provide for the regulation and control of
training of apprentices and for matters connected
therewith.
to utilize the facilities available in the industry for
imparting practical training with a view to meet
the requirement of the skilled workers.
Shop Floor Training
An Ex ITI Candidate engaged as an apprentice is
exempted from undergoing the basic training in the
corresponding trade and he will undergo only shop
floor training in the establishment.

During shop floor training an apprentice is expected


to work independently under the supervision of
supervisors.

He is also expected to do production work.


Leave and Holidays
 Leave:
Casual Leave : 12 days
Medical Leave : 15 days
Extra-ordinary Leave : 10 days

No deduction shall be made from the stipend for the


period during which an apprentice remains on casual leave
or medical leave.

Stipend shall, however, not be paid for the period for


which an apprentice remains on extraordinary leave.
Leave and Holidays
 Holidays:
An apprentice shall be entitled to such leave and
holidays as are observed in the establishment in
which he is undergoing training.

 Attendance:
Every apprentice shall have minimum attendance
of 240 days in a year where the establishment
works for 5½ or 6 days.
Absenteeism
 Unauthorized Absence: For unauthorized absence
of less than 10 consecutive days at a time the BTC
organization issue a written warning to the apprentice for
the first occasion. If the offence is repeated his case should
be reported to the establishment with a view to discharge.

 Absconders:
An apprentice who absents himself from the BTC for 10
consecutive days without permission or without informing
the principal of the centre of the reasons for his absence
should be treated as absconder and struck his name off the
rolls with effect from the first day of his absence.
Concession to Apprentices

 Monthly stipend as per the terms of contract


 Free workshop clothing at the rate of two.
 Free facilities for games, recreation and Medical treatment.
 Hostel accommodation wherever available.
Employer's liability for
compensation for injury
If personal injury is caused to an apprentice, by
accident arising out of and in the course of his
training as an apprentice, his employer shall be liable
to pay compensation which shall be determined and
paid, so far as may be, in accordance with the
provisions of the Workmen's Compensation Act,
1923, subject to the modifications specified in the
Schedule.
