OBJECTIVES
At the end of the presentation, participants will
be able to:

 Specify expected actions to be undertaken by


the LGUs
 Explain the guidelines on road clearing
operations
 Identify the various road obstructions
 Identify properly the type of roads within their
jurisdiction
 Implement proper road clearing operations
within their jurisdiction
DILG MC 2020-027
 In line with the President’s directive during his SONA
2019 to reclaim public roads being used for private
ends
 A sequel to DILG MC 2019-121 which directs all
LGUs to clear road of illegal obstructions
 Pursuant to Section 17 (b) of the Local Government
Code of 1991 which mandates all LGUs to manage
and maintain roads within their jurisdiction as a
basic service and facility.
Specific actions to be taken
by ALL LGUs
1. Enact or review existing ordinance/s that provide for the
conduct of road of clearing operations and the prohibition of
road obstructing structures and constructions
2. Conduct an inventory of roads within its jurisdiction which
shall provide information on:
 Road Classification
 Road measurement

3. Conduct an inventory of obstructed roads and natures of


obstructions
4. Cause the REMOVAL of said obstructions through the
REGULAR CONDUCT OF ROAD CLEARING OPERATIONS in all:
Provincial Roads
City Roads
Municipal Roads
Barangay Roads
National Primary and Secondary Roads (in coordination with
the DPWH

5. Implement a displacement strategy for those affected by the


conduct of road clearing operations which may include
designation of unused spaces for their relocation, provision
of alternative livelihood for vendors and other similar efforts
6. Ensure that cleared roads are rehabilitated and restored for
public use through:
Cleaning
Flushing
Installation of street lights
Installation of appropriate signage
Setting of speed limit and the like
7. Establish a grievance mechanism, physical or electronic,
through which citizens can report
Additional Roles of LCEs

• For Mayors:
• Monitor the implementation of the road clearing directive at
the barangay level
• Craft strategies to ensure the compliance and cooperation of
the Punong Barangays, which may include the turnover of
the maintenance of cleared roads to the barangay
government

• For Punong Barangays:


• All PBs shall be in charge of the conduct of road clearing
operations in barangay roads and minor public-use streets
within their jurisdiction, as well as the maintenance of other
local roads turned over by the city or municipal government
• Harmonize barangay ordinances with the road clearing
directive
• Collaborate and coordinate with the Mayor in regards to
road clearing, and
• Undertake the information and dissemination campaigns in
their respective barangays
• Submit monthly reports to DILG through the Municipal Road
Clearing Focal Person

Clearing Operations

• Road Clearing – shall mean the removal of illegal or


unauthorized obstructions along the road right-of-way, which
encompases the entire width of the road carriageway
(including travel way for motor vehicles and road shoulders)
and sidewalk.

• Caveat: The widening of the scope of the existing road right-


of-way and activities undertaken for such purpose are
BEYOND THE SCOPE OF THE DIRECTIVE.

• Road obstructions – are structures, materials, or activities


within the road right-of-way that impede the free and clear
passage of motor vehicles or pedestrians and/or pose danger or
cause injury to motorists, pedestrians, or occupants of nearby
structures
Specific Provisions of
RA 4136
• Sec. 46. Parking prohibited in specific places – No driver shall
park a vehicle, or permit it to stand, whether attended or
unattended, upon a highway in any of the following places:
a) Within an intersection
b) On a crosswalk
c) Within 6 meters of the intersection of curb lines
d) Within 4 meters of the driveway entrance to any fire
station
e) In front of a private driveway
f) On the roadway wide of any vehicle stopped or parked
at the curb or edge of the highway
g) At any place where official signs have been erected
prohibiting parking
Specific Provisions of
RA 4136
• Section. 52. Driving or parking on sidewalk – No person shall
drive or park a motor vehicle upon or along any sidewalk or
path or alley not intended for vehicular traffic or parking.
• Section 54. Obstruction of traffic – No person shall drive his
motor vehicle in such a manner as to obstruct or impede the
passage of any vehicle, nor while discharging or taking on
passengers or loading or unloading freight, obstruct free
passage of other vehicles on the highway.

• The DO directs all Regional/District Engineering Offices to
immediately remove or cause the removal of all obstructions
and prohibited uses within the right-of-way of all NATIONAL
ROADS as well as strictly disallow the building, erection,
construction, planting and fabrication of same, thus:
• All kinds of temporary and permanent structures, such as
building, houses, shanties, stores, shops, stalls, sheds,
canopies, billboards, signages, advertisements, fences,
walls, railings, basketball courts, barangay halls, garbage
receptacles, and the like;
• Post and towers of Electric Cooperatives, and Major
Electric Power Distributors; distribution lines; posts for
cables of phones and mobile service providers;
• Driveways and ramps, occupying or protruding to the
sidewalk

• Trees, shrubs, and plant boxes
• Humps, whether permanent or temporary
• Dumping and storage of construction materials, such as
sand, gravel, cement, lumber and steel bars, earth spoils,
waste materials, debris, embankment, heaps and the like
• Vehicles and equipment, including junk items that are
parked, occupying or protruding to the sidewalk or
shoulder
• Vending, repair of vehicles and other businesses within
the sidewalk and other parts of the road right of way
• Disposal of household/ commercial/industrial wastewater
and sewage into the sidewalk, curb and gutter and
carriageway

• thus:
• Raising of animals or allowing them to roam within the
ROW
• Washing and drying of clothes, crops and similar items

• Obstructing and/or hazardous trees may be pruned or removed by


the LGU in accordance with rules imposed by the DENR
• In cases where structures or facilities owned by utility service
providers such as post, meters, instrumentation boxes, and the like,
cause obstruction to the road right-of-way, due coordination shall be
made by the concerned utility company and the LGU to remove or
relocate the obstruction.
• Measures shall be done to ensure that such relocation and the conduct of road
clearing does not cause disruption
• In cases, where materials, equipment and structures temporarily
obstruct the road right of way due to undertaking of a project by a
national government agency, the LGU may coordinate with the
concerned agency to relocate obstructions or agree to a timetable for its
removal

• LGUs may coordinate with DPWH in conducting road clearing


operations in national roads or any other roads under the
direct management and maintenance of DPWH.
• Barangays which have parts of the National Road within its
territory are advised to document and send a report of
obstructions found. The report must be stamped received by
the DPWH office as proof of submission.
• LGUs may coordinate with and request the assistance from the
PNP and BFP in ensuring security and order during the conduct
of road clearing operations.

• In relation to MC 2020-004 entitled: Guidelines in the Review


or revisiting the City or Municipal Tricycle and Pedicab
Franchise and Regulatory Ordinance or Code and Barangay
Ordinance on the use of Public Roads, Pathways and Alleys:
• All Sanggunians are hereby directed to review, amend or
revoke all existing ordinances or code contrary to policies on
Road Clearing, i.e. Ordinances on one side parking and
establishment of tricyle or pedicab terminals along the
pathways, and ensure that all tricycle and pedicab drivers
and operators of TODAs faithfully comply with the local laws
and related issuances.

• In relation to MC 2020-036 entitled: Prohibiting Tricycles,


Pedicabs and Motorized Pedicabs from Operating on National
Highways:
• To better ensure safety, NO TRICYCLE or PEDICAB SHOULD
OPERATE ON NATIONAL HIGHWAYS utilized by 4-wheel
vehicles greater than 4 tons and where normal speed
exceeds 40kph.
• The prohibition includes the use of tricycles and pedicabs of
national highways for crossing and making a U-turn

Monitoring, Assessment and
Validation

• Validation Team:
• MLGOO
• PNP
• BFP
• During the 75-day implementation: Once every 2 weeks the
validation team will interface with LCEs to discuss implementation
and compliance of the LGU.
• After the 75-day implementation: Cross-posting or rotation of
validation teams to conduct an assessment and validation of a
new LGU assignment.
• LGUs are to submit the monthly monitoring report (using Annex A
for Barangays, Annex B for consolidated report)
• A quarterly regular report will be submitted by the municipality.
Sanctions
• Mayors and Punong Barangays shall be issued show-cause
order in case of non-compliance
• Failure to provide sufficient response shall result to the filing of
appropriate administrative cases pursuant to Section 60 (c) of
the Local Government Code of 1991 and other existing laws
and policies.
• It must be the responsibility of the LCE to exact accountability
and impose corresponding sanctions, after observance of due
process, against non-supportive and/or non-compliant local
officials and employees
