THE BASES?
•Republic Act No. 6713 of 1989 - “Code of
Conduct & Ethical Standards for Public
Officials & Employees”
•Article XI, 1987 Philippine Constitution –
“public service is a public trust and that
public officers and employees must, at all
times, be accountable to the people, serve
them with utmost responsibility, integrity,
loyalty, and efficiency; act with patriotism
and justice and lead modest lives.”
THE BASES?
Administrative Order 255 of 2009 –

issued by Her Excellency Gloria
Macapagal Arroyo directing the
heads of the Executive
Department to lead moral renewal
in their agencies.
Rule 1: NORMS OF
BEHAVIOR
Sec.1: Core Values and Principles of Conduct
Sec.2: Fidelity to duty – shall agree to serve
the public loyally, in good faith and in
accordance with the Agency’s
mandate and statutory provisions.
Sec.3: Transparency – openness in
transactions involving public interest
Sec.4: Confidentiality – shall not disclose any
confidential information in the course
of or by reason of their employment.
Rule 1: NORMS OF
BEHAVIOR
Sec.5: Outside employment/ private
practice of profession – shall not
accept part-time or full-time
employment while on full time
employment with the agency. The
employee, however, may be allowed
to engage in private practice of
profession on a limited basis subject
to different conditions.
Sec.6: Post employment
Rule 2: POLICY ON
NEPOTISM
Sec.1: Pursuant to civil service law & rules on
nepotism, no appointments in the career
service shall be issued to DSWD personnel
by an official as the head of the agency/
appointing authority/ immediate supervisor,
who is a relative of the appointee within the
3rd degree of affinity or consanguinity.
Sec.2: In case of marriage between officials/
employees of the same OBS, the
supervisor concerned shall recommend for
a transfer of at least one of the subject
officials / employees.
Rule 3: CONFLICT OF
INTEREST
Sec.1: DSWD officials and employees shall
not engage, directly or indirectly, to
acts such as: entering into contract
with DSWD; participate in any official
action which will benefit his/her
immediate family or relatives;
recommend any person for
employment to other person doing
business with the Department; and
give undue advantage to anyone to
further his/ her private interests.
Rule 3: CONFLICT OF
INTEREST
Sec.2: No DSWD official or employee shall

receive tips or other remuneration
for assisting or attending to parties
engaged in transactions or involved
in actions or proceedings with the
Department.
Rule 4: POLICY ON GIFT GIVING,
ACCEPTING OF GIFTS,
DONATIONS & SPONSORSHIP
In general, DSWD shall follow a
“no gift policy”
Exemptions:
1. Tokens of gratitude as appropriate to
the ceremony or occasion to which
the official acted as RP outside the
Department.
Rule 4: POLICY ON GIFT GIVING,
ACCEPTING OF GIFTS,
DONATIONS & SPONSORSHIP
2. Gifts received from institutions not
covered in Section 2 of Rule 4, provided
that it is delivered in the workplace & be
registered in the Registry Book of Gifts.
3. Gifts, donations & sponsorship for the
benefit of DSWD clients are subject to
existing guidelines on & accepting
donations.
Rule 5: POLICY ON PUBLIC
DISCLOSURE
Sec.1: Every unit of the Department shall
make official information available
for public knowledge, scrutiny,
copying or reproduction, but still
subject to conditions.
Sec.2: Documents and papers exempted
from disclosure:
a. “confidential”
DISCLOSURE
b. disclosure will deprive a person of
the right to a fair or an impartial
adjudication
c. disclosure will pose a danger to the
security of the state
d. documents/ papers for “internal use
only”
e. when non-disclosure is allowed by
law
DISCLOSURE
Sec.3: The appropriate OBSU shall comply with
the request for information w/in 15 working
days or within a reasonable time mutually
agreed by both the person making the
request and the DSWD OBSU concerned.
Sec.4: In case of denial of request in whole or in
part, the head of the agency shall notify
the requesting party w/in 5 working days
stating the name, designation or position
of the person making the denial & the
reasons.
Rule 6: POLICY ON
WHISTLE BLOWING
Sec.1: Encouraging reporting of

malpractices, corruption and
other protected disclosures
Sec.2: Protection and rights of
whistleblowers.
Sec.3: Remedies and administrative
sanctions
Rule 7: RECEIVING & HANDLING
COMPLAINTS
Sec.1: No DSWD personnel shall be removed
nor suspended except for cause as
provided by law & after due process.
Sec.2: Any complaint against any officer or
personnel of the Department under this
Code shall be initiated by a verified
complaint, or if not verified, is
verifiable & supported by necessary
evidence.
Rule 7: RECEIVING & HANDLING
COMPLAINTS
Sec.3: Complaints whether verified or not
shall be referred to the Personnel
Management Division (PMD) for
appropriate administrative action.
Sec.4: Any violation of this Code shall be
subject to the pertinent provisions of
the Civil Service Rules on
administrative due process, actions,
sanctions and remedies.
Rule 8: INCENTIVES, AWARDS
& RECOGNITION
Examples of incentives and rewards given to
DSWD employees:
1. Local and foreign scholarship grants
2. Attendances to conferences on official time
3. Awarding of citations like trophies, plaques or
appreciation or certificates
4. Membership to professional organizations
*All proposals for the provision of the
rewards/incentives must be submitted to the
PRAISE committee for review and endorsement.
