CONTRACT OFENGAGEMENT UNDER THE

DISTRICT HEALTH &FAMILY WELFARE SOCIETY

AGREEMENT FOR ENGAGEMENT made on this day, the ……..

…………….(hereinafter called the Employee) of the one part and the District Health and
Family Welfare Society (Arogyakeralam) (hereinafter called the Society),
…………………………..District represented by its Authorized Signatory on the other part.

WHEREAS, the National Health Mission [NHM] is a scheme conceived and


implemented by the Government of India through Societies set up at the National, State and
District levels to supplement, support and augment the public health facilities of State
governments through funds made available by the Government of India with the State
Governments;

AND WHEREAS, the NHM is implemented in the State of Kerala through the
Society aforementioned;
AND WHEREAS, the NHM is implemented each Financial Year [FY] depending
upon approvals obtained from the Government of India and the Government of Kerala under
the Record of Proceedings [RoP] with the entire finances extended by the two Governments;
AND WHEREAS, the NHM can only engage personnel on contract for each FY
depending upon the approval of such engagements for the period and depending upon the
availability and priority of finances allocated to such engagements.

AND WHEREAS the Society has offered contractual engagement to the Employee
and the Employee has accepted the same on the following terms and conditions.

NOW THEREFORE, THESE PRESENTS WITNESS AND THE Parties hereto


mutually agree as follows:-

1. The Employee will be on contractual engagementand shall remain in the service of the
Society as …………………………………………………………. (name of the post)
from……………….…to ………………......(hereinafter called ‘the contractual period’)
unless this contract is terminated earlier.

2. During the period of contract, while functioning as


…………………………………….,the Employee will be eligible for a consolidated
salary of ….………………………/-monthand as may be revised upwardly under ROP
2023-2024/2024-2026/GB/EC.
3. In addition to the consolidated salary, the Employee shall be entitled to receive such other
benefits / compensation such as TA/DA allowance while on tour,casual leave,maternity
leave/ loss of pay leave etc. in accordance with the Rules of the Society for the time being
in force.

4. The engagement of the Employee is purely on contract basis and the Employee will not
be entitled to any claims, rights, interests or further benefits in terms of regularization or
consideration of further engagement to the said post or any other post under the Society
or any preferential treatment for employment under the State Government.

5. The Employee agrees to perform duties as per the present job description prescribed for
the said post under the Society and as may be revised from time to time by the Society.

6. The Employee will render service at any place within the territorial jurisdiction of the
Society as he or she may be deployed from time to time as deemed necessary by the
Society.

7. The Employee further agrees to be governed by the Rules of the Society in force as well
as such other conditions of service as may be adopted by the Society from time to time.

8. The Employee agrees that if he/she avails Loss of Pay leave without prior sanction from
the competent authority during the contract period, his/her service shall stand
automatically terminated with effect from the date of commencement of absence. No
notice whatsoever is required to be served on the Employee who absents himself/herself
without prior sanction as stated above.
9. In case the Employee avails loss of pay leave without prior sanction from the competent
authority during the contract period, his/her service shall stand automatically terminated
with effect from the date of commencement of absence.

10. The service of the Employee shall stand automatically terminated at the expiry of contract
period.

11. The Employee does not have any right to claim engagement on contract for further or
extended periods by the Society. Any such engagement will be offered to the Employee
only at the discretion, and only on the requirements, needs and necessities of the Society.

12. The services of the Employee can be terminated at any time by the competent authority of
the Society if the Employee is found to be guilty of any insubordination, intemperance or
other misconduct or non-performance/non cooperation.

13. Notwithstanding anything contained hereinabove, the Society also reserves the right to
terminate this Agreement without assigning any reasons. In such cases, a written notice of
fifteen working days will be given to the Employee.

14. The Employee also has the right to terminate this contractual Agreement of employment
without assigning any reasons. The Employee should give a resignation notice of
fifteenworking days in order to resign from the post.

from the post and terminate this Agreement.
16. On resignation or at the end of the contractual period, the Employee has to handover all
the properties of the Society that had been entrusted to him/her including passwords to
email ids, etc used for official purposes. Failure to do so will be considered as theft of
public property and will be dealt with accordingly.

17. The Society, in lieu of written notice, may give the Employee an amount equal to that of
his/her consolidated emoluments for fifteen working days and for a shorter notice than
fifteen working days, an amount equal to that for the period of which such notice falls
short of fifteen working days.

18. The Employee, in lieu of written notice, should give the Society an amount equal to that
of his/her consolidated emoluments for fifteen working days and for shorter notice than
fifteen working days the proportionate amount for the period of which such notice falls
short of fifteen working days.

IN WITNESS WHEREOF, the Employee and the authorized signatory of the Society have
