MORTGAGE DEEDS
Without Possession deed

This, Agreement, made, at, Khekra, this, date 09/04/2024, between. Mr.
NOORDIN KHAN S/O NIJAMUDIN aged about 44 years R/O PREM PURI
LINE PAAR KHEKRA,TEHSIL-KHEKRA, BAGHPAT U.P. 250101. Here in
after referred as "THE FIRST PARTY/OWNER" (which expression shall
unless it be repugnant to the context or meaning there of be deemed to
include his/her/their heirs, executors, administrators and assigns), and
FINOVA CAPITAL PVT. LTD., incorporated under the Laws of India and
having its registered office at Office No. 702, Seventh Floor, Unique Aspire,
Plot No. 13- 14, Cosmo Colony, Amrapali, Marg, Vaishali, Nagar, Jaipur,
302021, Rajasthan, through its, authorized, Person, Shri., Mohit Sharma
S/o. Uma Shankar R/O jai, shree enclave colony Banthla Loni Ghaziabad
201102. here in after, referred, as "SECOND, PARTY/THE FINANCIAL
INSTITUTION" (which expression shall unless it be repugnant to the context
or meaning there of be deemed to include his/her/their heirs, executors,
administrators and assigns).

The Sale Deed dated 15.11.2019 executed by Mr.Latif S/O Samser in favour
of Mr.Noorrdin Khan s/o Nijamudin respect of House area measuring 60.20
sq. mtr. as Book no.1, Volume no.2279, Page no.253 to 278, Serial no. 3496
on dated 15.11.2019.

Whereas First Party/Owner, Seized And Possessed of The Property Area


65.83 YARD / 60.20 SQ MTR. 197.50 Sq.ft. Khasra No. 348 Village –
RATAUL BAGHPAT U.P 250101. Same was Registered as Book no.1,
Volume no.2279, Page no.253 to 278, Serial no. 3496 on dated
15.11.2019.

Mortgagor Acquired the Same (Here in after Referred as the Said Property) and
More Particularly Described in the First Schedule Hereunder Written.

AND WHEREAS the financial institution at the request of the first party/owner has
sanctioned and granted credit facility to the first party/owner against the Equitable
Mortgage by deposit of original title deeds of his immovable property.

AND WHEREAS first party/owner with intent to create a security by way of


Equitable Mortgage by deposit of original title deeds of the said property with the
financial institution, the first party/owner has agreed to do upon having the
repayment thereof with interest thereon in the manner agreed to pay and
between the parties hereto as also on terms and conditions mentioned in the
loan documents executed by the first party/owner in favour of the financial
institution.

AND WHEREAS the first party/owner have deposited the title deeds of the
said property with the financial institution at its Branch Office at Jaipur,
(particularly described in the SECOND SCHEDULE), with intent that the
same will be equitably charged as security with the financial institution
against the credit facility (more fully described in the Third Schedule) granted
to the first party/owner by the financial institution with interest, expenses
thereon at the request of the first party/owner. Further it was stated that the
physical possession of the property has not been given to the financial
institution.

AND WHEREAS the first party/owner have agreed to record the oral
completed transaction of equitable mortgage by deposit of title deeds and
documents more particularly described in the SECOND SCHEDULE
belonging to the first party/owner.
NOW THIS AGREEMENT WITNESSETH AS FOLLOWS:

1. The first party/owner declare and record that the original title deeds,
documents and writings comprised in the Second Schedule with respect
to the said property, were deposited by the first party/owner with
authorized person/ Manager Legal of FINOVA CAPITAL PVT. LTD. at
their Jaipur branch, as a security against the loan/credit facility granted
by the financial institution to the first party/owner with interest thereon
and for all costs, charges and expenses incurred by the financial
institution in connection therewith.

2. The first party/owner further declare and record that the title deeds and
documents and writings comprising in the Second Schedule relating to
the said property, accepted by authorized person/ Manager Legal of
FINOVA CAPITAL PVT. LTD. at their Jaipur branch, are the only
documents of title of the said property with the first party/owner and are
not previously deposited with any person/financial institution, whatsoever
and/or the copies thereon by the first party/owner.
IN WITNESS whereof the first party/owner and the financial
institution haveexecuted this Agreement in the terms and conditions
mentioned above.
