Sexual harassment is a very serious crime which has a very negative effect on the peace
and order of society. Sexual harassment provides the basis for the incidence of rape in
society, which is an even greater courage for society. According to statistics released in
Pakistan, millions of cases of sexual harassment occur annually, which in turn prove to be
a precursor to rape. Security threats are created, and the wheel of social progress stops.
The situation is that tragic incidents of sexual harassment are taking place in national
buildings, highways, crowded bazaars, educational institutions and offices and they are
being publicized on social media. This affects the image of Pakistan in the world and
destroys the peace of the society. Although the serious section of society is saddened by
these incidents and wants legal action against those responsible, the sad fact is that a
large section of the youth has a trend to share videos of these incidents on social media
just for fun. Unfortunately, these incidents seem to be on the rise instead of decreasing.
And law enforcement agencies seem helpless. Not only women's but small kids, including
boys and girls at a very small age are affected by harassment including our transgender
community and many more. either its women kids' boy's girl's transgender or men's no one
is safe in this social circle. Our social surveys and interviews cleared the ways to which we
can put a stop to these harassment and rape cases.
INTRODUCTION
Now, if we consider the different forms of adultery, then forcible adultery is the worst of
them. And among other causes of rape, sexual harassment is the most important.
Sexual harassment includes a range of actions from verbal transgressions to sexual abuse
or assault. Harassment can occur in many different social settings such as the workplace,
the home, school, churches, etc.
Harassers or victims may be of any sex or gender.” In his famous book The Lecherous
Professor, the famous American lawyer Bale Wright Zack writes about sexual harassment:
"Sexual harassment involves many acts, from unintentional verbal abuse to sexual
assault or assault. Harassment can occur in many different social settings such as
the workplace, home, school, church, etc.
The key here is consent. In the light of these definitions, immoral acts or tampering that
involve the consent of the parties will not be considered a crime, while Islam's position is
very clear in cases where touching, seeing, teasing a non-mahram or making contact in any
illegal way, it is a crime even if it has the consent of the parties. As Allah says: And do not
go near adultery, for it is indecency and evil." Not even “going nearby" to adultery”. means
that it is necessary to refrain from any action that may result in adultery. Some critics on
Islamic laws consider Islamic restrictions as oppression and are fighting against them in
the field with the slogan of freedom. But when the inevitable consequences of these so-
called and unnatural freedoms come in the form of sexual harassment and rape, they do
not accept it either. Sexual harassment is an incomplete attempt of rape. Where the victim
suffers severe psychological distress and feels very insecure. The crime of sexual
harassment is increasing worldwide. It is not specific to any region, society or country. The
epidemic may be less or more. It can be in many forms, including being forced to meet
separately, being sexually blackmailed for passing an exam or passing an interview, taking
advantage of someone's compulsion to be financially stable, and having a relationship etc.
However, experts agree that sexual harassment is a complex issue, and it is very difficult to
set clear boundaries. Sociologists does not consider smiling, admiring someone's beauty,
or proposing marriage to be sexual harassment. But under the circumstances, sometimes
these acts are also considered sexual harassment. And this is also a fact that there are
also allegations of sexual harassment by women for various purposes, which cause
irreparable damage to the reputation of the other party. Therefore, sexual harassment is a
complex issue. a physical way sexual desire or behavior is evident, or bullying,
intimidation.
Incidents of sexual and physical abuse and sexual harassment of women, children and
minors have been on the rise in Pakistan for the past several years. Pakistan and Islam are
being ridiculed because of these incidents globally, while the administration seems
powerless to control them. These incidents are happening to people from almost all walks
of life. Whether it these are co-educational institutions for higher education, government
offices, private offices, public places, urban areas or rural areas, such incidents are taking
place during travel, in bazaars, with beggars and even in religious madrassas countrywide.
Sadly, these incidents are increasing instead of decreasing. According to a study, 36.2% of
women in the world face sexual harassment.10 While 72% Pakistani women are victim of
sexual harassment at some point in their lives.
The person giving interview told us a tragic incident about one of her friends that what that
victim goes through was miserable and was unbearable and was conscious many days the
people also told that not only women's but also the kids boys transgender and even men's
are also now adays harassed but in minimum number and the rate of this crime has been
going high day by day . A four year to above little kids is gang raped by people just because
they want to fulfill their desires.
The people giving answers to the question told how their heart felt shattered seeing a 12-
year-old boy brutally getting raped in madrasa the home where we pray five time the home
of our LOARD. Humanity has left the earth viping out innocent lives. Experiencing this kind
of trauma and nightmare is not at all easy. Sexual harassment is a punishable act and
there should be orders by the government to protect the lives, small lives of not only Pak
but the entire world.
1. Under Section 509 of the Pakistan Penal Code (1860), a person can be sentenced to
three years' imprisonment, or a fine or both, if he makes a lewd gesture to a woman about
her modesty, whether by gestures or words.
2. Under Section 496C of the Pakistan Penal Code (1860), anyone who falsely accuses
another woman will be sentenced to five years imprisonment and a fine.
3. A person who commits any act which is considered rude and obscene, including singing,
will be liable under Section 354A of the Pakistan Penal Code (1860) and may be liable to
imprisonment for three months or fine.
4. Anyone who attacks a woman uses physical force against her or takes off her clothes for
public viewing will be liable under Section 354 of the Pakistan Penal Code (1860). The
accused could face the death penalty or life imprisonment.
5. A person who forces a girl under the age of 18 to have sex with another person will be
liable under Section 366A of the Pakistan Penal Code (1860) and will be liable to
imprisonment for ten years or a fine.
2. Clear Policies and Procedures: Establish clear and strict policies against sexual
harassment. Ensure that these policies are communicated effectively to all employees and
are enforced consistently.
3. Promote a Culture of Respect: Foster a culture of respect and inclusivity within the
organization. Encourage open communication, mutual respect, and zero tolerance for any
form of harassment.
4. Support Systems: Provide support systems for victims of sexual harassment. Ensure
that there are confidential reporting mechanisms in place and that victims are supported
throughout the reporting and investigation process.
5. Accountability: Hold perpetrators of sexual harassment accountable for their actions.
Implement fair and thorough investigation procedures and take appropriate disciplinary
actions when harassment is substantiated.
RESULT OF DISSCUSSION
To stop sexual harassment in offices and schools, we need to ensure that everyone is
treated with respect and kindness. It's important to teach people about what sexual
harassment is and how to prevent it. Companies and schools should have clear rules
against it and make sure everyone knows about them. We should all work together to
create a safe and friendly environment where no one must face harassment. If someone
does something wrong, they should be held responsible for their actions. By following
these steps, we can help prevent sexual harassment in offices and schools and make sure
everyone feels safe and respected.
