1. AIM AND PURPOSE

a. The NUALS National Trial Advocacy Competition 2025 aims to nurture student’s
understanding of trial court procedures and litigation strategies by providing a platform
that bridges theory and real-world practice. It challenges participants to think critically,
argue persuasively, and apply their legal knowledge to complex scenarios, enhancing
both their analytical and communication skills. The competition provides invaluable
insights into the art and science of effective trial advocacy, equipping students with
the essential tools to excel in the courtroom.
b. The Trial Proposition of the NUALS National Trial Advocacy Competition 2025 is
made in accordance with the provisions of the Bharatiya Nyaya Sanhita, 2023,
Bharatiya Nagarik Suraksha Sanhita, 2023, and Bharatiya Sakshya Adhiniyam, 2023.
The competition will help in aiding in the understanding of Criminal Law
Jurisprudence and familiarizing the participants with the newly enacted criminal laws.
c. The NUALS National Trial Advocacy Competition, 2025 will be conducted in two
stages: the Qualifier Round, held via an online platform, and the Advanced Rounds,
hosted at the NUALS campus in Kochi.

2. DEFINITIONS

a. ‘CLARIFICATIONS’ refers to the clarification(s) to the Trial Proposition issued by


the Organizing Committee;
b. ‘COMPETITION’ refers to the NUALS National Trial Advocacy Competition, 2025;
c. ‘DISQUALIFICATION’ means that the team members will be prohibited from further
participation in the Competition and will forfeit their eligibility for a Certificate of
Participation, as well as any cash prizes or awards;
d. ‘JUDGE’ means any person appointed by the Organizing Committee to evaluate any
phase or round of the competition;
e. ‘ORGANIZING COMMITTEE’ means the Centre for Law and Development,
NUALS, the various sub-committees constituted, and any person appointed/authorized
by the said committee;

f. ‘PARTICIPANT’ refers to a student who, upon completing the registration process for
the Competition, officially represents their College/University and is acknowledged by
the Organizing Committee as eligible to participate in the Competition.
g. ‘PENALTY’ means the points which are deductible on account of non-adherence to
limitations of time and on any other ground as determined by the Organizing
Committee
h. ‘RULES’ refers to the Competition’s Rules and Regulations, along with any
supplementary rules issued and communicated by the Organizing Committee as
deemed necessary and the general rules and code of conduct of the National University
of Advanced Legal Studies, Kochi.
i. ‘TRIAL PROPOSITION’ refers to the annexures, along with all evidence and
testimonies associated with the competition, as provided or published by the
Organizing Committee.

3. LANGUAGE

a. For the purpose of this competition, the language of communication shall be English
only. Use of vernacular language by the participants during the said competition is
strictly prohibited.

4. DRESS CODE

a. Dress Code during the competition shall be comparable to Advocate’s Attire, i.e.:

i. Gentlemen - Black trousers and White shirt, Plain Black Blazer (without
College/ University logo), Black Tie, and Black shoes.
ii. Ladies - Black trousers and White shirt, Plain Black Blazer (without College/
University logo), and Black shoes.

b. The dress code for the competition shall be strictly adhered to. The participating teams
shall also adhere to the dress code while attending the inaugural and valedictory
ceremonies of the Competition.

5. DATE AND VENUE

a. The Qualifier Rounds of the NUALS National Trial Advocacy Competition, 2025 is
scheduled to take place virtually through Google Meet on 11th January 2025. The
Advanced Rounds will be conducted in person at the NUALS campus from 31st
January to 2nd February 2025.

6. TEAM COMPOSITION

a. The Competition is open to all law colleges, law schools, universities, and departments
of law in India, recognized by the Bar Council of India. Eligibility is restricted to LL.B.
students enrolled in either the three-year or five-year law programs.
b. Each team shall consist of a maximum of three members, comprising two speakers and
one researcher. The team composition must be confirmed during registration, with any
changes communicated to the organizers no later than the final date for registration.
Teams shall not alter the assigned roles or form new combinations at any stage of the
competition. No coach, assistant, or additional personnel will be permitted in the trial
room during the proceedings, apart from the participating team members.
c. Each team will be assigned a unique competition code, and the identity of the teams
must remain confidential throughout the competition. Any breach of this
confidentiality may result in penalties, including disqualification, at the discretion of
the Organizing Committee.

7. REGISTRATION

A. GENERAL RULES
a. Participation in the NUALS National Trial Advocacy Competition, 2025 is restricted
to 64 teams only. The slots shall be reserved based on a ‘first come ’ basis for the first
64 teams.
b. Kindly note that only two teams per College/Institution/University shall be permitted
to take part in the Competition.

c. Teams wishing to participate in the competition must complete the registration process
by 15th December 2024, by submitting the duly filled Proforma available on the website
of the Centre for Law and Development. The registration link is provided below -
https://nuals.ac.in/Centre-for-Law-and-Development.aspx
d. Registration will open on November 1st, 2024. Upon successful submission of the
proforma, participants will receive an acknowledgment of their provisional
registration. The payment process will only commence after the last date of
registration. The link for the payment gateway along with the instructions will be
provided through e-mail to the participants.
e. During the online registration process, teams must upload a scanned copy of a bona
fide certificate or an official letter from their respective college/institution/university,
signed by one of the following authorities: Faculty-in-Charge of Moot Court Society
(MCS)/Moot Court Association (MCA), Registrar, Principal, Dean, Director, Head of
the Institution, Vice-Chancellor or Chancellor. The letter must confirm the names of
the participants, their current year or semester of study, and their representation of the
institution in the competition.
f. Registrations submitted without a valid scanned copy of the approval letter or bona fide
certificate will not be accepted.
g. Once registration is finalized, no changes in the team members’ names will be allowed.
However, in exceptional circumstances, if a change becomes necessary, a fresh
registration, along with a new approval letter or duly attested registration form clearly
explaining the reason for the change, must be submitted. The new form must be signed
and sealed by an authorized signatory of the institution. Such changes are subject to
the discretion of the Organizing Committee.

B. REGISTRATION FEE
a. A two-tiered registration fee structure applies to the Competition. All participating
teams are required to pay a base registration fee of Rs. 2000/- (Rupees Two Thousand
Only) on or before 15th December, 2024. Additionally, the sixteen (16) teams
qualifying for the Advanced Rounds will be required to pay an additional fee of Rs.
3000/- (Rupees Three Thousand Only) by 15th January, 2025.
b. After the last date of the registration, a mail will be sent with the instructions and link
for the Payment Gateway which shall be used to complete the payment process of the
registration fees. The non-payment of the registration fees within 3 days of the receipt
of this email will be

deemed as a cancellation of your provisional registration, and your spot will be


forfeited. However, in exceptional circumstances, this may be reconsidered at the
discretion of the organizing committee, provided a formal request is submitted.
c. Please note that registration fees, once paid, will not be refunded
d. Registration will be deemed complete only upon receipt of confirmation from the
Organizing Committee. The Organizing Committee assumes no responsibility for
payment errors arising from the bank or third-party applications.

8. ROUNDS

a. There shall be Two Phases of Competition Rounds:

i. PHASE I: Qualifier Rounds


ii. PHASE II: Advanced Rounds

b. The top 16 teams that qualify Phase I will move on to Phase II of the Competition.

8.1. PHASE I: QUALIFIER ROUND


8.1.1. GENERAL STRUCTURE
a. The qualifier round will be conducted for all the teams that register for the competition
via virtual mode. The platform for the virtual round will be Google Meet. The top 16
teams of this round will qualify into the Advanced Rounds which will be held offline
at the National University of Advanced Legal Studies, Kochi. The Qualifier Round will
test the procedural knowledge and the advocacy skills of the teams balancing
theoretical knowledge with practical skills, ensuring that the selected teams are well-
rounded in both aspects of trial advocacy.
b. The Qualifier Round of the National Trial Advocacy Competition is specifically
focused on the issues of framing charges against the accused and the consideration of
discharge of the accused. In the Qualifier Rounds, the Prosecution must argue that there
is sufficient prima facie evidence to justify framing charges against the accused,
presenting facts and evidence that support moving forward with a trial. Their goal is to
show that the evidence warrants the continuation of proceedings. On the other hand,
the Defence must demonstrate that the evidence is inadequate for framing of

charges and argue for the discharge of the accused, pointing out any gaps or
inconsistencies in the Prosecution’s case. Both sides must focus on these procedural
matters, making concise, legally sound arguments to either proceed to trial or discharge
the accused.
c. The Qualifier Phase shall consist of two components, namely,
i. Submission of Argument Note, and
ii. Oral Rounds

8.1.2. ARGUMENT NOTE SUBMISSION


a. The following requirements for Argument Note must be strictly followed. Non-
conformities will be penalized:
b. Each team must prepare Argument Note for both parties to the lis (Prosecution and
Defence).
c. The Argument Note for the Qualifier Round of the National Trial Advocacy
Competition is specifically focused on the issues of framing charges against the
accused and the consideration of discharge of the accused. Participants are required to
limit their submissions to arguments relevant to these preliminary procedural matters,
avoiding any discussion beyond this scope. The Argument Note should present a clear
analysis of whether, based on the available evidence, there exists a prima facie case to
justify the framing of charges. Additionally, participants must explore whether the
accused is entitled to discharge due to insufficient evidence or legal grounds.
d. The Argument Note shall not exceed 10 pages. The Font Style should be Times New
Roman, Font Size should be 12, with 1.5 line spacing. Footnotes must be in Times New
Roman Font, Font size should be 10, with single spacing, with a uniform style of
citations. The Argument Note must have a margin measuring one inch on all sides of
the page. The Argument Note shall be paginated with page numbers at the bottom of
the page.
e. The Argument Note should be named as follows: "Team Code_Argument Note for
Prosecution/Defence_NUALS NTAC."
f. The Argument Note shall be submitted with the covers in the following colours: light
blue for the prosecution and light red for the defence.

g. The Argument Note must contain:


• The Cover Page
• The Statement of Facts (shall not exceed 1 page)
• The Arguments Advanced
• The Prayer
h. The Cover Page of the Argument Note shall state the following:
• The Name of the Competition
• The Team Code (on the top right corner)
• The Cause Title
• Identity of Argument Note as Prosecution or Defence.
i. Identity of the institution shall not be revealed anywhere in the memorial. Violation of
this provision shall result in penalties including disqualification. The decision of the
Organizing Committee shall be final.
j. The submission deadline for the argument note is 11.59 pm, January 3rd, 2025. Late
submissions will incur a penalty of 1 point per hour of delay, applicable up until 10:00
AM on January 4th, 2025. Submissions received after this deadline will not be
considered for evaluation.
k. The argument note will be evaluated based on the following criteria on a scale of 0-40
points:

l. The Argument Note submitted by the participants will be evaluated solely for the
purpose of the Qualifier Round.

8.1.3. ORAL ROUNDS


a. The Oral Rounds will consist of each team participating in one round, representing
either the Prosecution or the Defence. The side (Prosecution or Defence) will be
assigned to each team prior to the rounds through draw of lots.
b. The prosecution is required to argue that a prima facie case exists against the accused,
justifying the framing of charges, and must oppose both the discharge of the accused
and the grant of bail. On the other hand, the defence is tasked with arguing that no
prima facie case is made out, seeking the discharge of the accused and advocating for
the grant of bail. The purpose is to argue convincingly for or against proceeding to trial,
without delving into the full merits of the case
c. The Oral Rounds will be for a total of 30 minutes, divided as follows:

Prosecution Arguments 10 minutes


Defence Arguments 10 minutes
Prosecution rebuttal 5 minutes
Defence surrebuttal 5 minutes

d. Judges may interrupt at any time to ask questions. The teams can expect to be
questioned on procedural law during this round. Time spent answering questions will
be included in the team's allotted time.
e. The oral arguments will be evaluated based on the following criteria on a scale of 0-60
points:

8.1.4. Advancement to the Next Round


a. Teams will be ranked based on their combined scores of the argument note and oral
rounds. In case of a tie, the team with the higher marks in orals will be selected.
b. The top 16 teams will advance to the next phase of the competition.
c. In case any team(s) of the Qualifying - 16 back(s) out or expresses their interest not to
appear in Phase II Rounds, the team(s) next in the rank list shall be reached out to fill
in their vacancy.

8.2. PHASE II: ADVANCED ROUNDS


8.2.1. GENERAL RULES
a. There will be two preliminary rounds of arguments, a quarterfinal, a semifinal and a
final round.
b. The team can decide the number of witnesses to be examined and must examine them
within the time allotted to them.
c. Teams must submit, as part of their Memorial, a definitive list of witnesses they intend
to examine during the trial. This list shall be final and no modifications will be
permitted. Teams are required to notify the court officers of the same prior to the
commencement of each round.
d. The Organizing Committee will provide the witnesses. The witnesses will be generally
briefed (not on the detailed facts or its relative merits) and assigned by the Organizing
Committee. However, each team will have an opportunity to specifically brief their
witnesses on the evidence they seek to present through such witness.
e. Any team, in the course of examination, may seek leave of the court to withdraw any
of the witnesses included in the list.
f. Teams will be provided with their opponent’s memorial after draw of lots. Return of
the other side’s memorial immediately after the round is compulsory.
g. The oral arguments need not be confined to issues presented in the memorials.
h. Teams have the discretion to assign speakers for both chief examination and cross-
examination, allowing for flexibility in their roles. However, each speaker must deliver
either the opening statement or the closing argument during the round.
i. The Organizing Committee reserve the right to amend the schedule / rounds as per the
number of participating teams.

8.2.2. PRELIMINARY ROUNDS & QUARTER FINALS


a. There will be two preliminary rounds of arguments per team, once for Prosecution and
the other for Defence.
b. No team will face each other more than once in the preliminary rounds.
c. Each team will face a different two-judge bench in their second round of arguments in
the preliminary round.
d. Top eight teams from the Preliminary Rounds will advance to the Quarter final rounds.
In case of a tie, the team with the higher memorial marks will qualify.
e. The Quarter Finals shall be a knockout round. Draw of lots will decide the side and
opponents of the teams.
f. The Witnesses to be briefed will be assigned to the prosecution team forty-five minutes
prior, and to the defence team thirty minutes prior, to the commencement of their
respective rounds for briefing.
g. The Rounds will be for a total of ninety minutes. Every minute of extra time will attract
automatic penalties for the speaker crossing the limit unless it is with the leave of the
Court.
h. The rounds would be divided among the following stages/sequence:

Opening statement by the Prosecution 02 minutes


Opening statement by the Defence 02 minutes
Examination in Chief by the Prosecution 18 minutes
Cross Examination by the Defence 24 minutes
Examination in Chief by the Defence 12 minutes
Cross Examination by the Prosecution 16 minutes
Closing Arguments by the Prosecution 08 minutes
Closing Arguments by the Defence 08 minutes

The allotted time for each segment is the maximum that the respective speaker can
avail of.
i. The time allocated for any of the aforementioned phases of the Trial, if not utilised,
shall not be utilised for any other phase of the Trial. The time allocated for each phase
of the Trial shall not be paused during the objections raised, the objection argument,
the Court questions to the witnesses in either of their examinations, and the questions
posed to the Counsels in both Opening Statement and Closing Arguments.

8.1.1. SEMI FINALS & FINAL ROUND

a. The Witnesses to be briefed will be assigned to the prosecution team sixty minutes
prior, and to the defence team forty minutes prior, to the commencement of their
respective rounds for briefing.
b. The Rounds will be for a total of ninety minutes. Every minute of extra time will attract
automatic penalties for the speaker crossing the limit unless it is with the leave of the
Court.
c. The rounds would be divided among the following stages/sequence:

Opening statement by the Prosecution 05 minutes


Opening statement by the Defence 05 minutes
Examination in Chief by the Prosecution 24 minutes
Cross Examination by the Defence 30 minutes
Examination in Chief by the Defence 16 minutes
Cross Examination by the Prosecution 20 minutes
Closing Arguments by the Prosecution 10 minutes
Closing Arguments by the Defence 10 minutes

The allotted time for each segment is the maximum that the respective speaker can
avail of.
d. The time allocated for any of the aforementioned phases of the Trial, if not utilised,
shall not be utilised for any other phase of the Trial. The time allocated for each phase
of the Trial shall not be paused during the objections raised, the objection argument,
the Court questions to the witnesses in either of their examinations, and the questions
posed to the Counsels in both Opening Statement and Closing Arguments.
e. The Semi Finals and Final Round shall be knock out rounds. Draw of lots will decide
the side and the opponents of the teams.

9. RECORDING OF EVIDENCE

a. The recording of evidence shall be done by the Court Officers. But the teams are
expected to take notes of the question and answers during chief / cross
examinations.

10. MEMORIALS

a. The following requirements for memorials must be strictly followed. Non-conformities


will be penalised:
b. Each team must prepare memorials for both parties to the dispute (Prosecution and
Defence).
c. Once the memorials have been submitted, no revisions, supplements, or additions will
be allowed.
d. The soft copy of the Memorials for the Prosecution and the Defence should be
submitted through the proforma available in the website of the Centre for Law and
Development on or before 24th January 2025 latest by 11.59 PM. Late submissions
will incur a penalty of 1 point per hour of delay, applicable up until 10:00 AM on 25th
January, 2025. Submissions received after this deadline will not be considered for
evaluation.
e. The Soft copy and the Hard copy of the memorial submitted shall be the same and
identical in all aspects. If any change is found, the memorial shall be rejected and no
marks shall be awarded.
f. Each team must bring 5 copies of the Memorials for either side and submit them during
registration on 31st January 2025.
g. The memorials have to be submitted on typed A4 size paper printed on one side and
must contain:
● Cover Page
● The table of contents
● The index of authorities
● The statement of jurisdiction
● The statement of facts (Those exceeding one page and submissions of an
argumentative statement of facts would attract penalties)
● The statement of charges
● The Witness List (Only the Witnesses mentioned in this list shall be made
available during oral rounds)
● The summary of arguments
● The arguments advanced (15 pages)
● The prayer

h. The soft copy of the memorial should be named as follows: "Team Code_Memorial for
Prosecution/Defence_NUALS NTAC."
i. Arguments must not exceed 15 (fifteen) pages. The Font Style should be Times New
Roman, Font Size should be 12, with 1.5 line spacing. Footnotes must be in Times New
Roman Font, Font size should be 10, with single spacing and a uniform style of
citations. The Argument Note must have a margin measuring one inch on all sides of
the page. The Argument Note shall be paginated with page numbers at the bottom of
the page.
j. Memorials should be preferably staple bound. Comb/spiral or any other form of
binding will be considered improper binding. Please avoid plastic front
sheets/separators.
k. The identity of the institution shall not be revealed anywhere in the memorial. Instead,
code numbers allotted to the students by the host institution should be mentioned.
Violation of this provision shall result in penalties including disqualification. The
decision of the Organizing Committee shall be final.
l. Covers must be placed on briefs as follows:
Prosecution: Pale Blue Color | Defence: Light Red Color.

m. The cover page of Memorials must state the following:


● The Team Code (Right Hand Corner)
● The Name of the Competition
● The Cause Title
● Identity of brief as Prosecution or Defence.

n. The teams shall have the option to submit a compendium (printed on both sides), which
may carry all the case laws that has been referred to in the memorial. The paper book
shall have a white cover and the copy shall be in possession of the participants & can
be passed on to the bench through the court officers. Any identifying marks/seal of the
college on the paper book shall attract severe penalties including disqualification. The
submission of this paper book does not entitle the team to any additional marks.

11. SCORING (ADVANCED ROUNDS)


a. Memorial scores will be added to the oral scores obtained by the participants in only
the preliminary rounds.

A. ORALS
a. Parameters for judging, on a scale of 0 – 100 points are:

B. WRITTEN SUBMISSIONS (MEMORIALS)


a. Any revisions, supplements or additions to the memorials after submission shall attract
severe penalties subject to the discretion of the Organizing Committee
b. Parameters for judging on a scale of 0-50 points are:

12. SCOUTING

a. Teams will not be allowed to observe the oral rounds of any other teams other than
their current opponents Scouting is strictly prohibited. Scouting by any of the teams
will result in disqualification.
b. Any team can file a written complaint with the Organizing Committee, regarding a
case of scouting. The decision of the Organizing Committee shall be final.
c. The researchers shall sit with the speakers at the time of the oral rounds and shall not
attend the court sessions of any other team participating in the competition.

13. AWARDS

a. The following are the awards for The NUALS National Trial Advocacy Competition,
2025:

Best Trial Advocacy Team Award A Trophy and cash prize of Rs 50,000/-

Second Best Trial Advocacy Team Award A Trophy and a cash prize of Rs. 30,000/-

Best Trial Advocate Award A Trophy and cash prize of Rs. 10,000/-

Second Best Trial Advocate Award A Trophy and cash prize of Rs. 5,000/-

Best Memorial Award A Trophy and cash prize of Rs. 15,000/-

Second Best Memorial Award A Trophy and cash prize of Rs. 7,500/-

b. In addition to the above awards, merit certificates will be provided to the top 16
teams which has qualified to the advanced rounds, and rest everyone will be given
participation certificates.

14. ANONYMITY

a. Student counsel may introduce him/herself to the court in the usual manner and may
also state their names. However, the team's shall not disclose their institutional
affiliation at any time.
b. Further, all team members, coaches, advisors, and observers shall refrain from
disclosing their team’s identity or institution at any time and in any manner, including,
but not limited to, wearing any identifying items (such as college clothing, ties, patches
or pins) or carrying identifying material (such as books with a college logo or college
seal etc.)

15. ACCOMMODATION AND TRANSPORT

a. The Organizing Committee will provide accommodation and transport between the
place of accommodation and the competition venue to the participating teams. Extra
members over and above the prescribed number will not be entertained and
accommodated under any circumstances.
b. Accommodation for the Competition will be available on an individual basis. Each
individual participant opting for accommodation shall be required to pay a fee of
Rs.500/- (Rupees Five Hundred Only) per night.
c. The accommodation fee is non-refundable.
d. Teams have the option to arrange their own accommodation and transportation if they
prefer.
e. Teams shall inform their travel plan and whether they need accommodation and
transport by sending an email to [email protected] on or before 15th January, 2025.
f. Misbehaviour of any sort by the participants will be dealt with very seriously and will
lead to disqualification.
g. Accommodation shall be provided to the participants only on the days of the
Competition. Teams which intend to arrive prior to or leave after the specified dates
are required to make their own arrangements.
h. Teams shall be responsible for their transportation to and from the airport / railway
station / bus station to the accommodation. They will be coordinated by the members
of the Organizing Committee

16. QUERIES AND CLARIFICATIONS

a. Queries to the Trial Proposition shall be sought by filling the proforma available on the
website of the Centre for Law and Development on or before 18th December, 2024. A
set of Final Clarifications shall be released on 21st December, 2024.

17. MISCELLANEOUS

a. The Organizing Committee reserves the right to modify any of the Rules of the
Competition. The Organizing Committee shall communicate any changes made in the
Rules of the Competition to the Teams.
b. The Organizing Committee reserves the right to take decisions on any matter not
mentioned in the Rules of the Competition. Any such decision taken by the
Organizing Committee shall be final and binding.
c. The Organizing Committee reserves the right to interpret any of the Rules of the
Competition. Such interpretation shall be final and binding.
d. If any one member of a team is notified or informed of any detail or information
concerning the Competition, it shall be deemed as if the said team as a whole has been
duly notified or informed.
e. Along with the initial Trial Proposition, there will be a staggered release of copies of
video and documentary annexures will be released in due course of time. It shall be
published on the website of the Centre for Law and Development and the official
Instagram page with the handle ‘@cldnuals’. The same shall also be made available
to the participants via email.
f. The copyright in the Written Submissions of Teams shall vest with the Centre for
Law and Development, National University of Advanced Legal Studies, Kochi
(NUALS). CLD, NUALS shall not be responsible for any liability accrued to any
person or for any loss caused to any person because of the content of the Written
Submissions.
g. No audio recording or videotaping of oral pleadings is permitted. The Organizing
Committee reserves all rights to audio recording and videotaping, or any other form
of audio or visual reproduction of any oral round or part thereof.

h. If a Team is of the view that the Rules of the Competition have been violated at
any stage of the Competition, the Team shall, within half an hour after the
completion of the round in which the alleged violation has occurred, register a
complaint with the Faculty Coordinator of the Competition.
