LAND LAWS INCLUDING TENURE AND TENANCY SYSTEM

1. (a) Elucidate the meaning and importance of Land Reform. 4+4


(b) Discuss the various land reform measures adopted in India. 12

2. (a) Enumerate the significance of the concept of operation barga. 8


(b) State the scope and objectives of the West Bengal Land Reforms Act, 1955. 6
(c) Define the term “bargadar” and “land” under the provisions of the West Bengal 6
Land Reforms Act, 1955.

3. (a) Discuss provisions relating to restriction on alienation of land by a raiyat belonging 8


to schedule tribe.
(b) What do you mean by Ceiling Area? Determine the ceiling area in the cases given 2+2
below in relation to both irrigated and other areas:
(i) In case of sole surviving Raiyat.
(ii) In case of Raiyat having family of more than five members.
(c) Elucidate the various grounds for filling suit of eviction against the tenant. 8

4. (a) Enumerate the provisions relating to fair rent under the West Bengal Premises 10
Tenancy Act, 1997.
(b) Explain the various condition precedent and procedure for deposit of rent with the 10
Controller.

5. (a) State the objectives and scope of the Land Acquisition Act, 1894. 4
(b) Define the term “Personal Cultivation”. 6
(c) Comparative Analysis on the procedure of acquisition of land under the Land 10
Acquisition Act, 1894 and the Right to Fair Compensation and Transparency in
Land Acquisition, Rehabilitation and Resettlement Act, 2013.

6. (a) Elucidate the various new aspects covered by the Right to Fair Compensation and 10
Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013.
(b) Explain the various grounds on which a Bargadar can be terminated under the West 10
Bengal Land Reforms Act, 1955.
