24692-00100, NAIROBI (hereinafter called the “Tenderer”) do hereby ordain, constitute,
nominate and appoint WATO DOKO YATTANI (holder of Kenyan Identity Card
No.22494594 and of Post Office Box Number 24692-00100, NAIROBI (hereinafter called the
“Donee”) to be our true and lawful Attorney and Agent with full power and authority for us and
in our names as our act and deed and for any account and benefit whatsoever (including, without
limitation, the account and benefit of the Attorney and Agent):
TO sign or execute and deliver in our name and on our behalf any agreements, contracts,
documents, letters, deeds or other instruments and certificates in respect of the tender to
NATIONAL WATER HARVESTING & STORAGE AUTHORITY P.O.BOX 30173-00100
Nairobi for the CONSTRUSTION OF SOLOLO FLOOD CONTROL WORKS
LOCATED IN MARSABIT COUNTY. Tender No: NWHSA/ONT/012/2023-
2024(hereinafter called “the Tender”) and to perform on our behalf any contract covenant or
obligations in respect of the Tender herein pursuant to any agreements and to do anything else
reasonably necessary so that the purpose and obligations of the Tender can be achieved as
effectively as if we had done it ourselves AND to obtain on our behalf all documents that we are
required to obtain in respect of the Tender, attend to any meetings and execute on our behalf all
documents in relation to the said tender and any other purposes pertaining to the Tender that we
are required to execute.
AND to execute and deliver any deeds, agreements and all other instruments and certificates in
pursuance of any of the foregoing; including the commencing and prosecuting or defending of
any proceedings in connection with any such agreement or the recession thereof or the recovery
of any moneys paid on the tender.
AND generally to do or cause to be done all such lawful acts deeds matters and things as shall or
may be deemed necessary or expedient in pursuance of this deed.
AND we the said SIXONE4 CONSTRUCTION LIMITED hereby agree to ratify whatsoever
our said attorney shall lawfully do or cause to be done by virtue of this deed.
The authority herein shall include such incidental acts as are reasonably required to carry out and
perform the said fiduciary capacity consistent with our best interest, as our attorney-in-fact in his
discretion deems advisable.
This power of attorney may be revoked by us at any time.
AND we hereby agree and covenant for our assigns to allow, ratify and confirm whatsoever our
Attorney and Agent shall do or cause to be done pursuant to the powers given hereunder.
