CONTRACT OF LEASE
KNOW ALL MEN BY THESE PRESENTS:

This Contract of Lease is made and entered into by and between:

KRISTINE JOY MIRA-TAJANLANGIT, of legal age, married,


Filipino, and a resident of Molo, Iloilo City, hereafter referred to as the
“LESSOR”;

-and-

MA. ELENA S. HUINDA, of legal age, married, Filipino, and a


resident of 135 Brgy. Tabucan, Mandurriao, Iloilo City, hereafter
referred to as the “LESSEE”;

W I T N E S S E T H:

1. The LESSOR is the absolute owner of a parcel of land known


as Lot 2700-B situated at Brgy. So-oc, Mandurriao,
Iloilo City, with an area of Eight Hundred Fifty Six (856)
Square Meters;

2. The LESSEE desires to lease the above-mentioned lot and the


LESSOR have agreed to lease the same for a period of one
(1) year commencing on January 1, 2024 to December
31, 2024;

3. The rent will be at Five Thousand Pesos (P5,000.00) per


month to be covered by a post dated cash or check. The
LESSEE shall pay on the 5th day of each month starting
January 5, 2024 without the necessity of demand;

4. Monthly electricity and water consumption shall be for the


account of the LESSEE during the period of the lease;

5. The LESSEE shall not introduce any permanent improvements


or structures on the leased premises during the period of the
lease;

6. The LESSEE shall be entirely responsible for the maintenance


of the cleanliness and good sanitary condition of the subject
lot;

7. The LESSOR shall have the right to inspect the subject lot
provided it is done during a reasonable time;

8. The LESSOR, Cecile Mira and/or Ernesto Mira are the


authorized persons to collect the agreed rent from the
LESSEE;

9. The LESSEE hereby expressly acknowledges that the leased


premises are in good and tenantable condition. Any provision
of law, present or future, or any stipulation in this agreement
to the contract notwithstanding, the LESSEE hereby agrees
and binds herself to undertake at her exclusive expense, all
minor repairs, necessary or otherwise, such as may be
required to maintain the same in good state of repair;

10. This Contract may be renewed before its termination
subject to the new terms and conditions the parties may
agree. Anent thereto, the LESSEE shall inform his intent to
renew in writing to the LESSOR within at least 30 days prior to
the expiration of the original lease;

11. The LESSOR shall not be liable or responsible for any injury,
loss or damage whatsoever which the LESSEE, her family,
visitors or any third party might sustain in the leased
premises due to any and all causes. The LESSEE accepts
responsibility for such liabilities;

12. Upon expiration or termination of this Contract, the LESSEE


shall immediately vacate the leased premises and peacefully
surrender complete possession thereof to the LESSOR, devoid
of all occupants, furniture, articles and effects of any kind, in
the same good and tenantable condition, normal wear and
tear excepted and other than for such alterations, additions or
improvements which pertain to the LESSOR in accordance
with the provisions of this Contract;

13. The LESSEE shall not directly or indirectly sublease, assign,


transfer, convey, mortgage or any way encumber her right of
lease over the leased premises or any portion thereof under
any circumstances whatsoever;

14. Should the LESSEE decide to pre-terminate this Contract


without just cause the LESSOR shall forfeit as liquidated
damages in her favor the Security Deposit or any amount
already paid by the LESSEE;

15. The LESSOR reserve the right to pre-terminate the lease


for valid cause and claim damages against the LESSEE as
provided for under the terms and conditions of this contract,
under the Civil Code of the Philippines and other related laws.
Any action on this Contract of Lease shall be brought in a
competent court in Iloilo City, to the express exclusion of
other courts.

IN WITNESS WHEREOF, the parties have hereunto set their
