Introduction
Opening Statement
First of all, I would like to thank Vikrant and (counsels name) for accepting our
invite to tackle this particular issue by means of a mediation session and also to
the mediators for agreeing to mediate this session. Seeing the consensus of the
parties in choosing to use this method of consensual dispute resolution makes us
more hopeful about a solution through this session.
Now, as you know I’m the counsel for Abhay today. My role here is advisory in
nature and will primarily be assisting Abhay in today’s mediation. I will be
advocating Abhay’s interests at this table and would like to point it out that the
real decision-making power lies in the hands of my client. Further I would like to
highlight the part about the confidentiality because I believe that privacy is
extremely important to both of the parties.
Before we approach the dispute in hand (counsels name) I’m sure that you’d agree
that in law we speak about a lot of things in terms of black and white but the way
I see mediation is that it helps us transcend beyond the binary of black and white
and to actually delve into the heart of the matter. So, when my client approached
me about the said issue, I advised to take the mediation route because I strongly
feel that what can be resolved through discussions need not be dragged into
protracted litigation that why we are here today to work towards maintaining a
healthy relationship between the parties and arrive at a consensual agreement. We
are here today to put fourth our interests and also hear you on your concerns.
Now my client Abhay has very eloquently put forward what our concerns are but
I’ll briefly for everyone’s benefit sum up what our interests are today:-
• Credibility
• Press Freedom
• Mitigation, and
• Resolution
Now Vikrant and (counsels name) we have given you our perspective and will
give the floor to you to give yours.
Closing statement
I would like to begin by acknowledging the facts and details that have been laid
out in this matter. Both the parties, Mr. Vikrant Singhania and Mr. Abhay Das,
have significant interests at stake—whether it is the preservation of a hard-earned
reputation or the safeguarding of journalistic freedom. Throughout these
discussions, we have carefully considered the allegations, responses, and
respective positions of both parties.
While we have addressed several important issues today, I recognize that there
may still be certain aspects and finer details that require further clarification.
Considering this, we propose that both parties work together in good faith to draft
a mutually acceptable agreement. This contract will formalize the terms of
resolution, ensuring that the interests of both Mr. Singhania and Mr. Das are
appropriately balanced and protected.
In closing, we are committed to resolving this issue amicably and efficiently, and
we look forward to working together to bring this matter to a close in a manner
that is satisfactory to all involved."
