captioned quashing petition, praying for quashing
of the FIR No-14/2022 dated 10.03.2022 as
registered UIS 376 & 506 of the IPC in Women

kindly be read as part and parcel of the said
application.
2. That it may be respectfully submitted that during
the pendency of the petition, the parties have
compromised the matter and had agreed to get the
above FIR quashed on the basis of Compromise, ~s
arrived between the parties. The copy of the
compromise along with affidavit is being appended
herewith and marked as Annexure A-1 for the kind
perusal of this Hon 'ble Court.
3. That it may be respectfully submitted that earlier an
FIR bearing No-48/2020 was registered against the
applicant and it was alleged that they were staying
together and that the petitioner had promised to
marry her. It was further alleged that the petitioner
was having sexual relations with her for the past
three years and that now he had disappeared. The
petitioner was arrested on 19.11.2020 and
thereafter the Petitioner was enlarged on bail on
02.12.2020 by the Learned Additional Session
Judge, Nalagarh. However, the FIR was thereafter
quashed on the basis of compromise, wherein she
stated that she was under the wrong impression that
the petitioner is going to marry some other girl and
that now they have amicably settled the differences.

She further alleged /submitted that the Petitioner
has not maintained physical relations with her
without her consent and they are in love affair and
shall marry each other soon. The FIR was quashed
by this Hon 'ble Court vide Judgment dated
22.07.2021.
4. That thereafter, the Applicant approached the
family of the Respondent No.2 for their marriage,
but he was stunned and surprised to know that the
Respondent No.2 is already married and is having a
daughter who is 12 years old. The petitioner
immediately verified the facts from the husband of
the Respondent No.2 namely Shri Sonu Gautam
who is residing in Village Boli Taula Patwara,
Thana and Tehsil Nagor, District Satna M.P., who
informed the petitioner that his marriage with the
Respondent No.2 was solemnized thirteen years
ago and that they are having one daughter. He
further informed that the Respondent No.2 has left
him and, their daughter's company and has been
residing at Baddi. Despite his repeated requests she
has not returned back home. The husband of the
Respondent No.2 even sworn in an affidavit to this

such he inquired about the same from the

Respondent No.2, on which she go perplexed. The
Applicant asked her that since their marriage would
not be legal, she may seek divorce from her earlier
husband on which she refused and insisted that if
the petitioner does not marry her, he would bear the
consequences of the same and as such the present
FIR was lodged on false and frivolous grounds and
as such in this background the present petition for
quashing of FIR has been preferred. The
Respondent No-2 had rather admitted that the
relations between the parties were consensual, thus
no question of offence U/s 376 arises.
6. That however, during the pendency of the present
petition the parties have entered into the
compromise, wherein Respondent No-2 had
admitted the above fact that she is already married
and now she wish to reside with her husband and
the FIR was the result of her misunderstanding,
hence the present Application is being preferred for
quashing of the present FIR on the basis of
compromise, as the continuation of further
proceedings before the Learned Trial Court would
be nothing but the abuse of process of law and will
amount to wastage of precious time of the Hon 'hie • •. ·- •

Court as the parties have already entered into the
compromise.

PRAYER

Therefore, it is humbly prayed that the present

Application may kindly be allowed and the
Compromise (Annexure A-1) be kindly be taken on
record and the Fm NO-14/2022 dated 10.03.2022
as registered U/S 376 & 506 of the IPC in Women
Police Station Baddi, District Solan, Himachal
Pradesh, may kindly be. quashed and set aside on
the basis of compromise as entered into between
the parties, in the interest of justice and fair play.

RESPECTFULLY SHEWETH:

1. That the above noted writ petition is pending before

this Hon'ble Court.
2. That the Petitioner/ applicant have filed Annexure
A-1 which is in vernacular Hindi, however the same
is perfectly legible. The petitioner, therefore, craves
leave of this Hon'ble Court to exempt the
respondent from filing the English translation of the
same.

It is, therefore, prayed that this application may

kindly be allowed and the Applicant may kindly be

exempted from filing the English translation of the
above documents in Hindi vernacular in the interest
of justice.
Such other orders may also be passed in favour of
the petitioners as deemed fit and proper by this
Hon'ble court in the facts and circumstances of the
case.
