    Swiss Banking Secrecy Waiver

    Important Information

    We would like to inform you that the call centre services for EquatePlus were outsourced from Equatex
    AG ("Equatex") to Sykes Enterprises Berlin GmbH & Co. KG with registered address in Berlin, Germany
    (the "Sykes Call Centre"). The Sykes Call Centre forms part of Sykes Global Services Ltd, which is a
    leading company for call centre and customer services with 30 year customer service experience. Sykes
    Global Services Ltd was awarded this assignment after having proven to meet stringent confidentiality
    and security standards.
    Sykes Call Centre employees will have access to EquatePlus, including your personal and
    compensation plan related data (the "Data"), in order to answer any questions you might have and to
    enter transactions based on your instructions on EquatePlus. Sykes Call Centre is subject to stringent
    contractual data protection provisions, as well as German and European data protection laws and
    regulations. While Data disclosed to Sykes Call Centre will cease to enjoy protection by Swiss banking
    secrecy and Swiss data protection regulations, it is nevertheless treated with strict confidentiality and
    security. Please be aware that local laws and regulations may oblige Sykes Call Centre to provide
    access to your Data to competent local authorities, thereupon your records will become available to the
    respective local authorities. Please also note that upon request of your employer, your Sykes Call Centre
    call records will be shared with your employer and/or its affiliates in- or outside Switzerland and/or the
    European Union.
    If you agree that your Data is accessible to the Sykes Call Centre, please click on the "I Agree" button.
    However, if you do not want your Data to be accessible to the Sykes Call Centre we kindly ask you to
    click on the "I DO NOT Agree" button in EquatePlus, so that the access to your Data is blocked. Please
    note that in such case call centre services will not be available to you.
    Custody Services - flatex Bank AG
    To enable the implementation of the Trust and Custody Agreement between you and flatex Bank AG,
    Equatex will disclose your relevant personal data to flatex Bank AG. This data will cease to enjoy
    protection by Swiss banking secrecy and Swiss data protection regulations, it is nevertheless treated
    with strict confidentiality and security.
    Tax Reporting Services and Sovos
    Please note that Equatex may be required to disclose your Data to competent local and foreign
    authorities or flatex Bank AG or external service providers, for tax or regulatory purposes (e.g. in the
    context of the United States ("U.S.") 1099 tax reporting, the Foreign Account Tax Compliance Act
    (FATCA) and the Automatic Exchange of Financial Account Information (AEoI)).
    Please be aware that Equatex has outsourced the U.S. 1099 tax reporting services to Sovos Compliance
    LLC, Minnetonka, U.S. ("Sovos"), a specialist for U.S. tax reporting services. If you have any connection
    to the U. S., Equatex will provide Sovos with your Data, including any eligible transaction details (such
    as dividend payments), in order to comply with applicable U.S. tax reporting regulations.

    In addition to the above and in order to deliver best quality services with respect to the administration
    and related services relating to the company's compensation plans, Equatex may share your Data with
    Equatex affiliates and/or other selected external service providers in- or outside of Switzerland.
