AKTA IMIGRESEN, 1959/63

Kuasa Menteri : -
• Melarang kemasukan mana-mana orang atau
golongan orang ke Malaysia untuk tempoh
sementara atau selamanya
• Menghadkan bilangan orang yang dibenarkan
masuk ke Malaysia selama tempoh tertentu
• Menghadkan tempoh kebenaran tinggal di
Malaysia bagi mana-mana orang yang
memasuki Malaysia
Kuasa Ketau Pengarah:-
• Pindaan Akta Imigresen pada 1997 menyaksikan
penurunan kuasa Seksyen 9, Ordinan Imigresen,
1959 kepada Ketua Pengarah mengeluarkan
Perintah melarang serta menghad kemasukan
mana-mana orang ke Malaysia dan kuasa untuk
membatalkan pas atau permit, di bawah
peruntukan seksyen-seksyen di atas.
• Dibuat atas kuasa Menteri di bawah Seksyen 9,
Ordinan Imigresen, 1959

• Melarang kemasukan mana-mana orang ke


Malaysia

• Menetapkan kategori orang-orang yang boleh


dibenarkan masuk (rujuk Jadual)

• Berkuatkuasa mulai 16 September 1963, di


seluruh negara
Kemasukan ke Malaysia adalah dilarang terhadap
semua orang, melainkan :-
• Warganegara Malaysia
• Penduduk Tetap Malaysia
• Orang yang memiliki pas yang sah
• Orang yang diberi pengecualian daripada
Seksyen 6(1), Akta Imigresen, 1959/63
• Orang yang termasuk dalam kategori yang
ditetapkan dalan Jadual (Schedule) Perintah ini
Orang yang termasuk dalam kategori yang
ditetapkan dalan Jadual (Schedule) Perintah ini

a) Any person who has professional or specialist


qualifications which would enable him to follow his
profession or occupation in the Federation without
prejudicing the interests of citizens of and other
persons resident in the Federation with
corresponding or similar qualifications.
b) Any person who is in possession of a certificate
issued by the Minister certifying that his
admission would be in the economic interest of
the Federation.
c) The wife, and any child under six years of age, of
any person permitted to enter under paragraph A
or B of this Schedule.
d) The wife of any citizen of the Federation who –
 having been married before the 1st day of
December, 1954, has not at any time after that
date been living, separately from her husband for a
continious period of five years; or
 having been married on or after the 1st day of
December, 1954, has not at any time been living
separately from her husband for a continious
period of five years.
e) Any child under six years of age of a citizen of
the Federation.
f) Any person permitted by the Minister to enter
the Federation on special compassionate grounds.
Kemasukan ke Malaysia adalah dilarang terhadap
semua orang, melainkan
• Warganegara Malaysia
• Penduduk Tetap Malaysia
• Orang yang memiliki pas yang sah
• Orang yang diberi pengecualian daripada
Seksyen 6(1), Akta Imigresen, 1959/63
• Orang yang termasuk dalam kategori yang
ditetapkan dalan Jadual (Schedule) Perintah ini
• Orang yang diberi pengecualian daripada
Seksyen 6(1), Akta Imigresen, 1959/63 {Perintah
(Pengecualian) Imigresen, 1963}
a) Persons who at the beginning of May, 1959, were in
the service of the Government of the Federation or
Singapore, or of any State in the Federation or of
any City Council or Municipality in the Federation
or in Singapore, or who were then in the service of
any Government outside the Federation and
seconded to any such service as aforesaid.
b) Persons who immediately before Malaysia Day were
in the service of the Government of North Borneo
(Sabah) or Sarawak, or who were then in the service
of any Government outside the Federation and
seconded to that service
c) Members of any visiting force within the meaning of
any law for the time being in force regulating
visiting forces present in the Federation and
members of the Malaysian Armed Forces who are
Commonwealth Citizen.
d) Persons duly accredited as diplomatic or consular
representatives to the Federation.
e) Persons upon him the immunities and privileges
refered to in Part II or III of the First Schedule to the
Diplomatic and Consular Privilege Ordinance,
1957, have been conferred under that Ordinance
f) Wives and children of persons specified in the
Schedule.
• In Sabah, Muruts and Lundayuhs who are
Malaysian Citizen and who entered Sabah by Land
from Sarawak.
• In Sarawak, employees of the Brunei Shell Petroleum
Company Limited arriving by air or sea at Bintulu.
