Who is a Consumer?

A consumer is a person who


purchases a product or service for
their personal use. They are the
decision maker. A consumer decides
that based on what product they
will buy, how much they will buy
and from which store.
Malpractice in the Market
Places
Malpractice in the marketplace occurs when
consumers expect a certain value for money
in products or services. This can include
high prices, adulteration in food, false
advertising, and creating an artificial
society through black marketing. Consumers
often lack knowledge or ignorance about
the product's manufacturing date, expiry
date, and MRP, leading to potential
trouble.
Need For Consumer Protection
Consumer Protection refers to the measures adopted to
safeguard the interests and rights of consumers and to
help them in getting their complaints resolved.
Consumer protection is crucial due to the vulnerability of
consumers to market malpractices, lack of transparency,
and the need for regulation. Consumers are often
unaware of their rights and vulnerable to false
information, fraudulent practices, and poor-quality
products. Market malpractices prioritize profit over
quality and safety, leading to low-quality goods and
services. Lack of transparency makes informed decisions
difficult. Governments play a crucial role in enforcing
laws, while consumer education empowers them to
make informed choices.
Consumer Movements
The consumer movement in India began in
the 1960s to protect consumers from
unfair trade practices. It aims to
promote consumer education, ensure fair
trade practices, and provide a platform
for consumers to raise their voice
against the injustice they faced.
However, the movement faces challenges
such as limited consumer education,
insufficient funds, and government
support.
Problems with
Consumer Movements
The consumer movement in India has faced numerous
challenges, including limited awareness, lack of
competition, government support, NGOs
fragmentation, corruption, slow justice, and
limited budgets. Many consumers are unaware of
their rights and services, making it difficult for
the movement to grow. The government's failure to
implement consumer protection laws effectively
hindered the movement's
progress. Consumers themselves often fail to play
an active role in the movement, leading to a
lack of support for consumer organizations.
Addressing these issues is crucial to revive the
movement and protect consumer’s interests
effectively.
COPRA 1986
The Consumer Protection Act (COPRA), 1986 was
passed in the year 1986.
The objective of the Consumer Protection Act is
to protect the interests of the consumers from
being exploited from the markets that aim to
increase their profits.
This Act also teaches the consumers about their
rights such as Right to Information about
quality, quantity, Right to protection against
unfair means and measures, Right to access goods
and services at market rates, etc. and make them
aware about how one can get redressal if they
face any form of exploitation.
Consumer Rights
To safeguard consumers from these fraudsters some laws have been made to
protect their rights. Some of those laws are-

1. Right to Safety: This right ensures that consumers are protected


against the marketing of goods and services that are hazardous to life
and property. Consumers should insist on the quality of products and
services and prefer products with quality marks like ISI or AGMARK.

2. Right to be Informed: This right means that consumers have the right
to be informed about the quality, quantity, standard, and price of goods
or services. This helps consumers make informed choices and protects them
against unfair trade practices.

3. Right to Choose: This right assures consumers of access to a variety


of goods and services at competitive prices. In cases of monopolies, it
ensures satisfactory quality and service at a fair price. This right also
includes the right to basic goods and services.
4. Right to be Heard: This right means that consumer's interests will receive
due consideration at appropriate forums. Consumers can form non-political and
non-commercial organizations to represent their interests in various
committees and forums.

5. Right to Seek Redressal: This right allows consumers to seek redressal


against unfair trade practices or exploitation. Consumers can file complaints
and seek fair settlement of their grievances.

6. Right to Consumer Education: This right means that consumers have the right
to acquire knowledge and skills to be informed consumers throughout their
lives. This includes knowing their rights and exercising them effectively to
avoid exploitation.
Learning to Become
Knowlegeable a Consumer
To become a well-informed consumer, a person
should know their responsibilities i.e checking
quality of the product, looking at the
manufacturing and expiry date and MRP of the
product.The consumer have all the rights to
question about the product to sellers. They
should be aware of their rights and should
always check the ingredients before buying any
product and always look for ISI or FSSAI mark.
Alertness is the key to become a knowledgeable
consumer.
FSSAI
The Food Safety and Standards
Authority of India (FSSAI) was
set up in 2008 for the proper
monitoring of food hygiene and
quality in India. It was
functional from 2011 and ever
since has been responsible for
managing food safety in our
country.
ISI Mark
ISI was founded to establish
standards for the orderly growth
of industries and for
maintaining industrial output
efficiency. It offers an ISI
mark which is a standards-
compliance mark for industrial
products in India. It is the
most common and identified
certification mark throughout
the Indian sub-continent so far.
Survey Analysis
Conclusion
In conclusion, consumer rights are essential for ensuring that
consumers are protected from exploitation and unfair trade
practices. The Consumer Protection Act, 1986, has been a
significant step in this direction, providing a framework for
consumers to seek redressal against unfair practices. However,
there are still several challenges that consumers face in
exercising their rights, including lack of awareness, limited
access to information, and inadequate enforcement of laws. It
is crucial that consumers remain vigilant and proactive in
asserting their rights, and that governments and businesses
work together to create a more unbiased and transparent
marketplace.
