    Performance Bank Guarantee

    To,
    Chairman,
    GPWSC,
    Village Mudar Pur and Part of Sanghera,
    Block Dharamkot,
    District Moga

    Whereas Sarwan Kumar Saini, Village: Dharamgarh, P.O Lalru, Tehsil Derabassi,
    District S.A.S Nagar (Pb) 140501 (Herein after called “the contractor”) has undertaken, in
    pursuance of contract no. PRWSS-W-DIV41-9776-1 to execute the work of
    Augmentation of Water Supply Scheme in Village Mudar Pur and Part of Sanghera,
    Block Dharamkot, District Moga (Under PRWSSIP-Sub Component 1A(iii)/JJM)
    (hereinafter called “the contract”)

    And whereas it has been stipulated by you in said contract that the contractor shall
    furnish you with a bank Guarantee by a recognized bank for the sum specified therein as
    security for Compliance with his obligation in accordance with the contract;

    And whereas we have agreed to give the Contractor such a bank Guarantee;

    Now, therefore we, Punjab National Bank, Branch Office Lalru (hereinafter referred to as
    guarantor bank term include successor or assignee), hereby affirm that we are the
    Guarantor and Responsible to you, on behalf of contractor, up to total of Rs.190700/-
    (One Lac Ninety Thousand and Seven Hundred Rupees) which include Performance
    Security of Rs. 185600/-( One Lac Eighty Five Thousand and Six Hundred Rupees) and
    Additional performance Security of Rs. 5100/-( Five Thousand and One Hundred
    Rupees) , such sum being payable in the types and proportions of currencies in which
    the contract price is payable ,and we are undertake to pay you ,upon your first written
    demand and without cavil or argument , any sum or sums within the limits of Rs.
    Rs.190700/-(One Lac Ninety Thousand and Seven Hundred Rupees) as aforesaid
    without your needing to prove or to show grounds or reasons for your demand for the
    sum specified therein.

    We hereby waive the necessity of your demanding the said debt from the contractor
    before presenting us with the demand.

    We further agree that no change or addition to or other modification of the terms of the
    contract or of the work to be performed thereunder or of any of the contract
    documents, which may be made between you and the contractor shall in any way
    release us from any liability under this Guarantee, and hereby waive notice of any such
    change, addition or modification.

    This Guarantee shall be valid till the expiry of the period of maintenance i.e upto
    20.06.2023

    (a) Notwithstanding anything contained herein above, Our liability under this Bank
    Guarantee will be limited to Rs.190700/-(One Lac Ninety Thousand and Seven
    Hundred Rupees) and shall remain valid upto 20.06.2023 ( Date of Expiration of
    Bank Guarantee) and we are liable to pay the guaranteed amount or any part
    thereof under this Bank Guarantee only and only if you serve upon us a written
    claim duly received by an authorized official of the bank or demand on or before
    20.06.2023 (Date of Expiration of Bank Guarantee ) (Including claim period of
    any, from the Date of Expiry of Bank Guarantee as mentioned above)
